Marvin Townsend Assistant City Attorney Michael May Assistant City Secretary Bill Read Mayor Jason Luby called the meeting to order in the Council Chamber of the City Hall, stating the purpose of the Special Meeting was to hold public hearings on zoning applications and any other business as may properly come before the Council. City Manager Townsend presented Application #574-1, Xavier Perez, for change of zoning from "R -IB" One -family Dwelling District to "B-1" Neighborhood Business District on Lot 7, Block 1, Southwood Addition, located on the southwest corner of Southwood Street and Gollihar Road (3129 Gollihar). The request was heard by the Planning Commission May 21, 1974 and forwarded to the Council with the recommendation that it be denied but in lieu thereof a special permit be approved for a professional office use subject to approval of a site plan by the Commission. (On June 4, 1974, the Commission was advised that Mr. Perez wished his application to be forwarded to the City Council without submission of a site plan). The Planning Staff's recommenda- tion was that "B-1" should be denied on the basis that it would be an intrusion into an established residential district; that the present zoning line separating business from residential zoning along Southwood Street is a logical division rather than intruding farther into the residential area and establishing a side lot line as the division between these zones. Mr. Hugo Berlanga, spoke on behalf of the applicant and stated that Mr. Perez would be agreeable to the granting of "AB" zoning instead of the requested "B-1". No one appeared in opposition to the foregoing zoning application. Motion by Ricardo Gonzalez, seconded by Acuff and passed, that the hearing be closed. Motion by Ricardo Gonzalez, seconded by Lozano and passed, that Application #574-1, Xavier Perez, for change of zoning from "R -IB" One -family Dwelling District to "B-1" Neighborhood Business District on Lot 7, Block 1, Southwood Addition, be denied, but in lieu thereof, "AB" be granted, and that an ordinance be brought forward 111/1 • Minutes Special Council Meeting July 3, 1974 Page 2 effectuating the change. City Manager Townsend presented Application #674-1, H. L. Edens et al, for change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on the Swaco Tract (7.866 acres), located on the north side of Saratoga Boulevard, east of Greenwood Drive. The request was heard by the Planning Commission June 4, 1974 and forwarded to the Council with the recommendation that it be approved on the basis that it is located within Noise Zone 2 and immediately adjacent to Zone 3 which would provide the low density desired by the City Council and also due to commercial uses already in existence in the general area. The Staff recommended denial of "1-2" but in lieu thereof "B-3" be granted only on the area fronting along Saratoga Boulevard to a depth of 400 feet and that "R -1B" be retained on the remainder of the tract. Also, it was the staff's opinion that industrial zoning is not justified at this time and if it were approved, it would establish a pattern for future indus- trial uses in this undeveloped section of the City. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Acuff, seconded by Lozano and passed, that the hearing be closed. Motion by Stark, seconded by Acuff and passed, with Luby voting "Nay", that the recommendation of the Planning Commission be concurred in and Application 1674-1, District H. L. Edens et al, for change of zoning from "R -1B" One -family Dwelling/to "1-2" Light Industrial District on the Swaco Tract (7.866 acres), be approved as requested and an ordinance be brought forward effectuating the change. City Manager Townsend presented Application #674-2E, Lloyd R. Rice, for an Exception to the Screening Fence Requirement on 200' of the northwest side of Lot 4, Block K, and 82.5' along the northeast corner of Lot 3, Block L, Lexington Place, which is located on the north side of the 3000 Block of South Padre Island Drive west of Kostoryz Road. The request was heard by the Planning Commission on June 4, 1974, and forwarded to the Council with the recommendation that it be approved on the basis that the type of fence construction proposed by the applicant is a necessity for security reasons and also it would encourage other property owners in the area to construct the same type fence. The Planning Staff's opinion was that a variance along the extreme 82.5' of the northeast corner should be approved, but should not be approved on the 200' portion adjacent to South Park Junior High School on the basis that construction is presently underway on the "AB" zoned property adjacent to the north and 'lhutes Special Council Meeting July 3, 1974 Page 3 • this property owner will be required to construct the standard screening fence between his property and the school which would be a continuation of such fence and would provide screening between the business operation and school activities. Mrs. Lloyd Rice spoke on behalf of the request stating that the main reason they are requesting this security type fence is because of the school to discourage school children from walking across their property to attend the elementary and junior high schools in the area. Also, she stated the expense of constructing the standard screening fence is excessive. She explained that the property is being developed with 30 business units, and pointed out on the map the location of the fence requested for variance which is to the rear of the property. She predicted it would never be developed with residential uses and feels it is a reasonable request. No one appeared in opposition to the foregoing request. Motion by Ricardo Gonzalez, seconded by Acuff and passed, that the hearing be closed. Motion by Ricardo Gonzalez, seconded by Tom Gonzales and passed, with Stark voting "Nay", that the recommendation of the Planning Commission be concurred in and Application #674-2E, Lloyd R. Rice, for an Exception to the Screening Fence Requirement on 200' of northwest side of Lot 4, Block K, and 82.5' along the northeast corner of Lot 3, Block L, Lexington Place, be approved and an ordinance be brought forward effectuating the action. City Manager Townsend presented Application #674-3, James Todd, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple District, on Lot 6, Block 2, Washington Addition (861 West Point Road), located on the south side of West Point Road, between Angela Drive and Columbia Street, The request was heard by the Planning Commission on June 4, 1974, and forwarded to the Council with the recommenda- tion that it be approved as a logical zoning for this lot. The Planning Staff con- curred in this recommendation. Mr. Townsend reported that five letters had been received since the Commission hearing in favor and one in opposition. No one appeared in opposition to the foregoing request. Motion by Stark, seconded by Lozano and passed, that the hearing be closed. Motion by Lozano, seconded by Acuff and passed, that the recommendation of the Planning Commission be concurred in and Application #674-3, James Todd, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple District, on Lot 111/1 Minutes • Special Council Meeting July 3, 1974 Page 4 6, Block 2, Washington Addition, be approved and an ordinance be brought forward effectuating the. change. ORDINANCE NO. 12160 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF H. L. EDENS, ET AL, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON THE SWACO TRACT, A SUBDIVISION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Luby, Acuff, Branch, Tom Gonzales, Ricardo Gonzalez, Lozano and Stark, present and voting "Aye". ORDINANCE NO. 12161 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LLOYD R. RICE FOR AN EXCEPTION TO THE STANDARD SCREENING FENCE REQUIREMENT ON 200 FEET OF THE NORTHWEST SIDE OF LOT 4, BLOCK K, AND 82.5 FEET ALONG THE NORTHEAST CORNER OF LOT 3, BLOCK L, LEXINGTON PLACE, LOCATED ON THE NORTH SIDE OF THE 3000 BLOCK OF SOUTH PADRE ISLAND DRIVE WEST OF KOSTORYZ ROAD, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
