AMENDING THE ORDINANCE ADOPTED BY THE CITY OF
CORPUS CHRISTI ON THE 15TH DAY OF MARCH, 1938,
AND APPEARING OF RECORD IN VOLUME 1U, AT PAGE
134 OF THE ORDINANCE AND RESOLUTION RECORDS OF
THE CITY OF CORPUS CHRISTI, ENTITLED "AN ORDI-
NANCE PROVIDING RULES AND REGULATIONS CONCERNING
TIE OPERATION OF THE CORPUS CHRISTI MUNICIPAL AIR-
PORT, CLIFF MAUS FIELD; PROVIDING PENALTIES FOR
VIOLATION THEREOF; AND DECLARING AN EMERGENCY ";
REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT THERENITH; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS;
SECTION I: That the ordinance of the City of Corpus Christi,
Texas, adopted on the 15th of March, 1938, appearing of record in
Volume 10, page 134 of the Ordinance and Resolution Records of the
City of Corpus Christi, Texas, entitled,
"AN ORDINANCE PROVIDING RULES AND REGULATIONS CONCERNING
THE OPERATION OF THE CORPUS CHRISTI MUNICIPAL AIRPORT,
CLIFF MAUS FIELD; PROVIDING PENALTIES FOR TEE VIOLATION
THEREOF; AND DECLARING AN EMERGENCY"
be and the same is hereby amended so that it shall read as follows:
SECTION I.
Art. 1 "Person" defined. - The term "person" as used in this
section shall be construed to include any person, firm, copartnership,
corporation, association, society or club, singular or plural.
Art. 2 Report of visiting pilots on arrival. - All visiting pilots
landing on the municipal airport shall report immediately upon landing
to the administration office and shall there register the following infor-
mation upon forms provided by the Airport Manager: (1) License number,
make and model of plane. (2) Owner of the plane. (3) Pilot of plane
and his license number. (4) Time of arrival. (5) Number of crew.
(6) Number of passengers. (7) Pilot's address (local) and telephone
number. (8) Such information as may be required for record purposes.
Art. 3 Report of visiting pilot before departure. - Immediately
prior to his departure each visiting pilot shall report to the administration
office and check out, reporting upon forms provided by the Airport
Manager.
Art. 4 Planes to be under control of licensed pilots. - No air-
craft may be flown from or taken off from Cliff Maus Field, except when
under the control of and flown by a licensed pilot, operating under a
license in good standing issued by the Civil Aeronautics Authority of
the United States, nor shall any such aircraft land at or upon Cliff
Beaus Field, except when under the control of and piloted by a person
holding a license in good standing issued by the Civil Aeronautics
Authority of the United States, or operating under a studentts training
permit.
Art. 5 Disposal of wrecked aircraft. - The aircraft owner, his
pilot or agent, shall be responsible for the prompt disposal of wrecked
aircraft and the parts thereof to avoid all interference with field
operations, unless directed by the Airport Manager to delay such action
pending investigation of the accident. If the owner, his pilot or agent
fails or refuses to remove a wrecked aircraft interferring with field
operations, then the Airport Manager is authorized to remove the wrecked
aircraft and charge the costs of removal to the owner of the wrecked
aircraft.
Art. 6 Accident reports. - Witnesses of and participants in acci-
dents involving aircraft on or near the airport shall report to the
admir_istration office as soon after such accidents as possible, leaving
their names and addresses and rendering such reports as may be required.
Art. 7 Taking off over hangars, etc. - Airplanes shall not land or
take off over hangars, buildings, obstructions, automobile parking areas
or groups of spectators.
Art. 8 Flying at low altitudes. It shall be unlawful for any person
to operate or fly any airplanes over the City of Corpus Christi at a lower
altitude than 1500 feet from the earths surface except in landing and
take off, and except as may be permitted under Art. 9, Section I of this
ordinance.

Art. 9 Exhibitions. - On special occasion and for the purpose of
exhibition or educational purposes or for photographer's work, the
City Council may authorize airplane exhibitions or flights to be con-
ducted under the direction of said governing body; provided, however,
that in-no case shall any airplane operate or perform any aerobatics or
what is commonly called "stunts" and no airplane shall give any exhibi-
tion or otherwise maneuver as herein prohibited unless especially
authorized by the City Council in writing so to do.
Art. 10 Test flights. - Personnel engaging in test flights and
student flying shall be limited in each case to the number of persons
necessary to perform properly the required test. At no time shall pas -
stingers be carried on such flights as ballast. The City of Corpus
Christi reserves the right to grant or refuse permission for such test
flights.
Art. 11 Condition of airplanes; operation by unskilled or intoxi-
cated persons. - No person shall hereafter knowingly operate any air-
plane above the City of Corpus Christi at any time unless such person
is fully capable of handling and controlling the machine or airplane so
operated, nor shall any person operate any aircraft while under the
influence of any drug or intoxicant of any nature.
Art. 12 The following rules with reference to field privileges
shall hereafter be in full force and effect;
(a) Privately owned aircraft may land and take off from the
Municipal Airport free of charge at all times.
(b) No person shall operate aircraft from the Cliff Maus
Field commercially, such as student instructions, passenger flights, etc.,
without first obtaining the written permission of the City Council of
the City of Corpus Christi.
Art. 13 Taxiing. - Upon landing on the airport, a pilot shall
assure himself that there is no danger of collision with other aircraft
taking off, landing or taxiing, before he begins to taxi and while he is
taxiing to the line or other part of the airport. All aircraft shall be

taxied at a slow and reasonable speed, not to exceed 10 m.p.h., par-
ticularly in the vicinity of the hangars and other buildings, and shall
be brought to a full stop when in the vicinity of landing airplanes.
When an aircraft is being taxied near buildings, an attendant shall be
at each wing unless the aircraft is provided with adequate brakes.
Aircraft taxiing for take off shall not out across or traverse the field
but instead shall taxi around the rim of the field until the desired
take -off position is obtained. Landing aircraft shall taxi directly to
the nearest rim of the field, and thence around the rim to the hangar
lines. No aircraft shall taxi off or onto the field from the hangar
lines under its own power, but must be moved by hand, by means of dollies
or otherwise. During wet weather all aircraft shall keep on the runways
and avoid cutting the surface of the field by running over the portions
thereof other than runways.
Art. 14 Prevention of Accidents. - It shall be the duty of all
flyers to so operate their machines or ships as to prevent injuries to
persons on the field, as well as to be prudent and careful in the manage-
ment of their machines or ships, so as to avoid unnecessary danger to
persons on the field.
Art. ly Parking. - All unhoused aircraft shall be parked in the
space designated for this purpose and shall be firmly secured to the
ground by ropes and stakes or otherwise, when left unattended, or during
weather conditions which indicate the necessity therefor. Between sunset
and sunrise, aircraft shall not be left unattended at any place on the
field other than where tie -down space is designated, and whether standing
or moving shall have their navigation lights on, unless the aircraft is
standing under a burning flood light on the ramp. Ships without naviga-
tion lights must land as soon as the field boundary lights are turned on.
Art. 16 Running engine. - No aircraft engine shall be started or
run unless a licensed pilot or competent mechanic is in the cockpit attend-
ing the controls and aircraft shall be started and warmed up only in the
places designated for such purposes by the Airport Manager. At no time
shall engines be tuned up while located in such position that hangars,
shops, or other buildings, or any group of people in the observation
area are in the path of the propeller stream.
Art. 17 Wheel Blocks. - Blocks, equipped with ropes or other suit-
able means of pulling them, shall always be placed in front of the wheels
of an airplane before the engine or engines are started unless the air-
plane is provided with thoroughly adequate parking brakes.
Art. 18 All aircraft to be rated. - No aircraft which has not been
rated or licensed by the Civil Aeronautics Authority of the United States
shall be flovm or taken off from Cliff Maus Field, or landed at or upon
Cliff Maus Field except aircraft of Foreign Nations operating with authority
of Civil Aeronautics Authority and United States and State Government
Aircraft.
Art. 19 Aircraft using Cliff Maus Field as a base. - All privately
owned aircraft, student training aircraft, aircraft carrying goods or
passengers for hire or reward and aircraft demonstrators, using and
operating from Cliff Maus Field, other than aircraft owned by the United
States Government, or by a state, territory, possession, or political
subdivision thereof, or aircraft licensed by a foreign country, shall
first obtain a permit in writing from the Manager of the Airport for the
use of Cliff Maus Field as a base of operations under the terms and pro-
visions of this section, and shall pay the fees and conform to the regu-
lations as may be provided by ordinance.
Art. 20 Conformity with air commerce regulations; adoption of air
traffic rules; observation required. - No person shall navigate any air-
craft over, land upon, or fly the same from, or service,maintain or repair
any aircraft on the airport, or conduct any aircraft operations on or from
the Airport otherwise than in conformity with the requirements of the
Civil Aeronautics Authority of the United states. No aircraft shall be
operated over or within the jurisdiction of the City of Corpus Christi
or the Airport, in violation of the air traffic rules as established by
the Civil Aeronautics Authority, An ich are hereby adopted by reference
and made part of this ordinance.

Art. 21 Liability of negligence. - The permission granted by the
City of Corpus Christi, to use the Airport and its facilities, or to
fly to, from, or over the same, shall at all times be conditioned upon
the assumption of full responsibility thereof by every person, firm or
corporation exercising or taking advantage of said permissiox,. It shall
be a further condition that each person, firm, or corporation, as a con-
sideration for the use of the Airport and its facilities, shall indemnify
and keep the City harmless from all claims, costs or judgments proximately
resulting from negligence of said persons or corporations in connection
with its operations, and its use and occupancy of said airport but no
person, firm, or corporation shall be responsible for the acts of negli-
gence of another person, firm, or corporation operatin, in or in connec-
tion with said Airport.
Art. 22 Aircraft permitted to use airport. - Only aircraft and
airmen licensed by the Civil Aeronautics ;authority of the United States
shall be permitted to operate over or within the jurisdiction of the
Gity of Corpus Christi sad the airport of Cliff Maus; provided, however,
that this restriction shall not apply to public aircraft of the federal
government or of a state, territory or possession, or of a political sub-
division thereof', or the aircraft licensed by a foreign country with
which the United States has a reciprocal agreement covering the operation
of such licensed aircraft.
Art. 23 No liability upon the City. - The City of Corpus Christi
shall never be liable on account of any accident to any person or property
or for any person or property by reason of the operation of the airports.
All persons using the said airports shall use the same at their own risk.
Art. 24 The following rules pertaining to gasoline and oil on the
municipal airport shall hereafter be in full force and effect, to -wit;
(a) No person or persons shall bring gasoline or oil to be
used in aircraft upon the airport without the written approval of the
Airport Kanager.
(b) All servicing of aircraft must be done by the employees of
the City of Corpus Christi unless other provisions are made in contracts
between the person and the City of Corpus Christi.

(c) Only Oil Company credit cards will be accepted on
charge sales. All other gasoline and oil sales must be paid at the
time of purchase. Exceptions must have .Airport Manager's written
approval.
(d) No gasoline shall be stored in cans or in drums in the
hangars of such airport.
(e) No state tax exemptions shall be issued on cash gasoline
sales unless applied for the same day the gasoline is delivered.
Art. 25 The following rules with reference to storage on the
municipal airport shall hereafter be in full force and effect, to -wit;
(a) All aircraft stored on a monthly basis at such airport shall
pay such storage in advance. All daily storage is to be paid at tie time
of the departure of the ship stored.
(b) The City of Corpus Christi is not responsible for the loss
of personal property left in aircraft or lost by fire or any other cause
to the aircraft or property therein.
(c) No person or persons shall solicit mechanical or other work
on aircraft at the municipal airport without first receiving written per-
mission therefor from the Airport Manager or his duly authorized representative.
(d) Repairing aircraft. - All repairs to aircraft and engines
snall be made in the spaces designated for that purpose and not on the area
reserved for landing and taking off.
Art. 26 There shall be no deviation from the rules sat out herein,
except when special circumstances render the departure from the rules
necessary, in which cases, the burden will be upon the pilot to prove that
such necessity of departure from the rules existed.
Art. 27 Operators and pilots carrying passengers at such municipal
airport shall take proper precautions to safeguard their passengers while
they are on the ramp or on the field, and shall take due precautions to
keep passengers from the path of moving airplanes and propellers.

Art. 28 Vehicles. - Vehicles other than those regularly employed
in the service of the airport shall stay within the limits of parking
spaces and drives and shall not enter the landing area, except with
written permission of the Airport Manager.
Fart. 29 Removal of violators. - Any person operating or handling any
aircraft in violation of this section, or any person, firm, or corporation
refusing to comply therewith, may be promptly removed or ejected from the
airport by or under the authority of the Airport Maiager, or under the
authority of the City Manager, and upon the order of the City Manager of
the City of Corpus Christi may be deprived of the further use of the airport
and its facilities for such length of time as may be required to insure the
safeguarding of the same and the public and its interests therein.
Art. 30 Authority of the Airport Manager at airport. - The Airport
Manager shall at all times have full authority over and will take such
action as may be necessary in the handling, conduct slid management of
municipally owned or maintained airports.
Art, 31 The Airport Manager is hereby authorized to ground any pilot
or plane using the municipal airport when in the opinion of the Airport
Wanaber or his authorized representatives, such action is deemed necessary
to obtain order and obeyance of rules and regulations, and the use of the
airport will be forbidden such pilot until such use is again restored to
him by the Airport Manager or by action of the City Council, brought to
the Council's attention by such pilot so grounded as an appeal from the
opinion of the Airport hbanager.
Art. 32 Suspending operations. - Except in the case of scheduled
operators, the Airport Irtanager shall have the authority to suspend opera-
tions on or from the airport when in his opinion the condition of the
landing area, or local meteorological conditions might make such operations
unsafe.
Art. 33 Plane Line. - The plane line shall be designated by the
Airport Manager.

Art. 34 Dead Line. - A dead line shall also be designated by the
Airport Manager, and no person, excepting a pilot or mechanic attached
to the airport or employed by the owner of a plane or an operator on
said airport, or an owner of such plane, or duly authorized officers or
officials charged with the duty d enforcing local, state or federal laws
or regulations, shall cross the dead line or enter the dead line or enter
upon the flying field unless he is to participate in a flight. If such
person is to participate in a flight lie shall not cross the dead line
until the plane in which he is to fly has come to a full stop and the
pilot thereof has signalled that he is ready to take on passengers. Such
person shall, upon alighting from the plane, leave the landing area by
the shortest possible route.
Art. 35 All operations on the municipal airport shall be conducted
with due regard for safety and any unsafe practices shall be considered
violations of the field rules, even if they are not specifically set out
lie re in.
Art. 36 It shall be unlawful for any person to operate a hydroplane
in or upon any reservoir or lake or body of water belonging to the City
of Corpus Christi, or under the control of the City of Corpus Christi without
prior approval of the City Council and if approval is granted, said hydro-
plane will be under the jurisdiction of all rulas and regulations set forth
in this section that might apply to its operation. Tais article shall not
apply to aircraft of the United States Army or Navy or of the State of Texas.
Art. 37 Severability. - if any article, paragraph, subdivision, clause,
phrase or provision of this section shall be adjudged invalid, or, to be
held unconstitutional, the same shall riot affect the validity of the section
as a whole or any part or provision thereof, other than the part so decided
to be invalid or held unconstitutional.
SECTION II. Penalty for Violation. Any person or corporation who
shall violate any of the provisions of this ordinance or any of the rules
and regulations prescribed therein shall be guilty of a misdemeanor and shall
be liable to fine of not more than two hundred dollars.

SECTION III. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION IV. The fact that increased air traffic and other
operations at the municipal airport render the present rules and regula-
tions covering these operations insufficient,to the detriment of the
safety and welfare of the citizens of Corpus Christi, creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction, and that said ordinance or resolution
shall be read at three several meetings of the City Council, and the
Mayor having declared that such emergency and imperative public necessity
exist, and requested that said Charter rule be suspended, and that this
ordinance be passed finally on the date of its introduction and that this
ordinance take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that
no ordinance or resolution shall be passed finally on the date it
is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, hereby request
that you suspend said Charter rule or requirement and pass this
ordinance finally on the date it is introduced, or at the present
meeting of the City Council.

whether standing or moving shall have their navigation 3ghts on, unless
the aircraft is standing under a burning flood light on the ramp. Ships
without navigation lights must land as soon as the field boundary lights
are turned on.
Art. 16 Running engine. - No aircraft engine shall be started
or run unless a licensed pilot or competent mechanic is in the cockpit
attending the controls and aircraft shall be started and warmed up only
in the places designated for such purposes by the Airport Manager. At
no time shall engines be tuned up while located in such position that
hangars, shops, or other buildings, or any group of people in the obser-
vation area are in the path of the propeller stream.

Art. 17 'i7heel iilocks. - Blocks, equipped with ropes or other
suitable means of pulling them, shall always be placed in front of the
wheels of an airplane before the ongine or engines are started unless
the airplane is provided with thoroughly adequate parking brakes.
Art. 18 1111 aircraft to be rated. - No aircraft which has not
been rated or licensed by the Civil Aeronautics _authority of the United
States shall be flown or taken off from Cliff DIaus Field, or landed at
or upon Cliff Piaus ?field except aircraft of iureidn ILtions operating
with authority of Civil Aeronautics ; uthority and United States and state
Government Aircraft.
Art. 19 Aircraft using Cliff Maus 'iold as a base. - All
privately owned aircraft, student training aircraft, aircraft carrying
goods or passencers for hire or reward and aircraft demonstrators, using
and operating from Cliff P.aus Field, other than aircraft owned by the
United States �,ovornment, or b,+ a state, territory, possession, or
political subdivision thereof, or aircraft licensed by a foreign country,
shall first obtain a permit in writing from the Idanager of the Airport
for the use of Cliff luaus Field as a base of operations under the terms
and provisions of this section, and shall pay- the fees and conform to
the regulations as may be provided by ordinance.
Art. 20. Conformity with air commerce regulations; adoption of
air traffic rules; observation required. - IQo person shall navigate any
aircraft over, land upon, or fly the same from, or service, maintain or
ropair any aircraft on the airport, or conduct any aircraft operations on
or from the Airport otherwise than in conformity with the requirements
of the Civil heronautics _authority of the United States. Ido aircraft
shall be operated over or -,within tree jurisdiction of the City of Corpus
Christi or the Airport, in violation of the air traffic rules as established
by the Civil Aeronautics Aut.lority, which are hereby adopted by reference and
made part of this ordinance.
Art. 21 Liability of negligence. - The permission granted by the
City of Corpus Christi, to use the Airport and its facilities, or to fly
to, from, or over tae same, shall at all times be conditioned upon the
assumption of lull responsibility thereof by every person, firm or corporation

exercising or taking advantage of said permission. It shall be a further
condition that each person, firm, or corporation, as a consideration for
the use of the Airport and its facilities, shall indemnify and keep the
City harmless from all claims, costs or judgments proxir.�ately resulting from
negligence of said persons or corporations in connection with its oper-
ations, and its use and occupancy of said airport but no person, firm, or
corporation shall be responsible for the acts of negligence of another
person, firm or corporation operating in or in connection with said P.irport.
Art. 22 Aircraft permitted to use airport. - only aircraft
and airmen licensed by the Civil :_eronautics,uthority of the United
States shall be permitted to op�orate over or within the jurisdiction of
the City of Corpus Christi and the 'iirport of Cliff Maus; provided, how-
ever, that this restriction slial4ot apply to public aircraft of the federal
government or of a state, territory or possession, or of a political sub-
division thereof, or the aircraft licensed by a foreign country with which
the united States has a reciprocal agreement coverin£ the operation of
such licensed aircraft.
Art. 23 No liability upon the City. - 'The City of Corpus Christi
shall never be liable on account of any accident to any person or property
or for any person or property by reason of the operation of the airports.
All persons using the said airports shall use the same at their own risk.
tLi{i, 24 The following rules pertaining to Gasoline and oil on
the municipal airport shall hereafter be in full force and effect, to -wit;
(a) No person or persons snall brim gasoline or oil to be used
in aircraft upon the airport without the written a,,)proval of tine airport

(b) All servicing of aircraft must be done by the employees of
the City of Corpus Christi unless other provisions are made in contracts
between the person and the city of Corpus Christi.
(c) Only Oil Company credit cards will be accepted on charge
sales. Gail other gasoline and oil sales must be paid at the time of pur-
chase. exceptions must have tirport Daniagcr's written approval.
(d) ido gasoline shall be stored in cans or in drwns in the han-
gars of such airport.

(e) No state tax exemptions shall be issued on cash gasoline
sales unless applied for the sa:ae day the gasoline is deliv<;red.
Art. 25 The folloa;ing rules with reference to storage on the
municipal airport shall hereafter be in full force and effect, to -uit:
(a) All aircraft stored on a monthly basis at such airport
shall pay such storage in advance. All daily storage is to be paid at
the -time of the departure of the snip stored.
(b) The City of Corpus Christi is not responsible for the loss
of personal property left in aircraft or lost by fire or any other cause
to the aircraft or �roperty therein.

"SECTION 1. That the City Manager is hereby authorized
and directed to execute for and on behalf of the City of
Corpus Christi, Texas, a contract for the construction
of certain improvements described as follows; Bayfront
storm protection concrete core wall on north and south
breakwaters, which contract has been awarded to Bauer -
Smith Dredging Company, Inc., in accordance with the
plans and specifications and contract documents as
filed with the Council on December 10, 1946, and accord-
ing to the bid of said Bauer -Smith Dredging Company, Inc.,
opened on the 3rd day of January, 1947, the said bid of
Bauer -Smith Dredging Company, Inc., being the lowest and
most advantageous to the City."
SECTION 2. The fact that it is to the great and beneficial
interest of the citizens of the City of Corpus Christi that said amend-
ment to said ordinance shall be made in order to speak the intention of
the Council and in order that the said contract might be more effective
and practieal insofar as the general public's welfare is concerned,
creates a public emergency and an imperative public necessity, requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date it is introduced and that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such public emergency and imperative
necessity exist, and having requested that such Charter rule be suspended,
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED.
