AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE
CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE A CONTRACT
BY AND BETWEEN THE CITY OF CORPUS CHRISTI, TEXAS,
AND BAUER AND SMITH FOR THE CONSTRUCTION OF CERTAIN
IMPROVEMENTS DESCRIBED AS FOLLOWSi BAYFRONT STORM
PROTECTION CONCRETE GROINS AT COLE PARK AND SOUTH
SECTION OF SEAWALL; APPROPRIATING MONEY FOR SUCH
PURPOSE; AND DECLARING AN EMERGENCY," AND BEING ORDI-
NANCE NO. 2012, PASSED AND APPROVED BY THE CITY COUNCIL
OF THE CITY OF CORPUS CHRISTI ON THE 7TH DAY OF JANUARY,
A.D., 1947, BY MAKING CERTAIN CHANGES IN SECTION, I
THEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Corpus Christi, Texas,
by ordinance dated January 7, 1947, passed and approved an ordinance
authorizing and directing the City Manager of the City of Corpus Christi
to execute a contract by and between the City of Corpus Christi and Bauer
and Smith for the construction of bayfront storm protection concrete
groins at Cole Park and south section of seawall; and
WHEREAS, the writing of the name Bauer and Smith was a clerical
error, no bid having been submitted under such name, but a bid having
been submitted under the name of Bauer -Smith Dredging Company, Inc., the
full and proper name of the concern to whom such contract was awarded,
said concern's bid being the lowest and most advantageous to the City; and
WHEREAS, it is deemed by the City Council necessary to make
an amendment to Section 1 of said ordinance in order that the proper name
of the contractor will appear and in order that the contract might be
more effective and practical insofar as the general publicts welfare is
concerned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXASs
SECTION 1. That Ordinance No. 2012, passed and approved by
the City Council of the City of Corpus Christi, on the 7th day of January,
A. D., 1947, and recorded in Volume 15, Page 239, of the Ordinance and
Resolution Records of the City of Corpus Christi, and entitled,
,
"AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY
MANAGER OF THE CITY OF CORPUS CHRISTI, TEAS TO
EXECUTE A CONTRACT BY AND BETWEEN TEE CITY OF
CORPUS CHRISTI, TEAS, AND BAUER AND SMITH FOR
THE CONSTRUCTION OF CERTAIN IMPROVEMENTS DESCRIBED
AS FOLLOWS2 BAYFRONT STORM PROTECTION CONCRETE
GROINS AT COLE PARK AND SOUTH SECTION OF SEAWALL;
APPROPRIATING MONEY FOR SUCH PURPOSE; AND DECLARING
AN EMERGENCY,"
be amended as follows, towita
"SECTION 1. That the City Manager is hereby authorized and
directed to execute for and on behalf of the City of Corpus
Christi, Texas, a contract for the construction of certain
improvements described as followst Bayfront storm pro-
tection concrete groins at Cole Park and south section of
seawall, which contract has been awarded to Bauer -Smith
Dredging Company, Inc., in accordance with the plans and
specifications and contract documents as filed with the
Council on December 10, 1946, and according to the bid
of said Bauer -Smith Dredging Company, Inc., opened on the
3rd day of January, 1947, the said bid of Bauer -Smith
Dredging Company, Inc., being the lowest and most advan-
tageous to the City."
SECTION 2. The fact that it is to the great and beneficial
interest of the citizens of the City of Corpus Christi that said amend-
ment to said ordinance shall be made in order to speak the intention of
the Council and in order that the said contract might be more effective
and practical insofar as the general public's welfare is concerned,
creates a public emergency and an imperative public necessity, requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date it is introduced and that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such public emergency and imperative
necessity exist, and having requested that such Charter rule be suspended,
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of
the foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that no
ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution shall be read at
three meetings of the City Council; I, therefore, hereby request that
you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of
the City Council.
