A 0 2 0 APPROPRIATING MONEY FROM STREET IMPROVEMENT FUND FOR THE PURCHASE OF RIGHT OF WAYS IN CONNECTION WITH PAVING AND CONSTRUCTION OF STORM SEWERS FOR LIPAN STREET, AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi on the 17th day of Septem- ber, A. D., 1946, entered into a contract with Brown & Root, Inc., for certain paving work on Lipan Street in the City and for the construction of storm sewers in connection therewith; and WHEREAS, it is necessary to obtain right of ways of the follow- ing property, towit: Lots 5, 6, and 7, in Block 3, Hillside Addition to the City of Corpus Christi, in Nueces County, Texas, to enable the con- struction of aforesaid storm sewers in connection with the said Lipan Street paving project; and WHERFAS, the City Council has determined that it is necessary that said right of ways be purchased from Jesus and Andrea Guerrero, the owner of said land; and WHEREAS, the estimated cost of purchasing such land aforesaid for right of ways is the sum of Five Thousand Dollars ($5,000.00); and, WHEREAS, there are sufficient funds in the Street Improvement Fund No. 220 which is now unemcumbered and which funds are available for this purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That there is hereby appropriated the sum of Five Thousand Dollars ($5,000.00) from the Street Improvement Fund No. 220 which money is to be used for the purchase of the premises for the right of ways above mentioned. SECTION II. The fact that storm sewers need to be constructed in connection with paving of Lipan Street in order to secure drainage thereof, and that right of ways over the property, herein above described, must be had in order to construct such storm sewers creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency Joao and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction, take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. Ci y/ Attorney Corpus Christi, Texas January 14, 1917 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen; For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Councils I, therefore, hereby request that you suspend said Charter rule or requirement and pass the ordinance finally on the date it is introduced, or at the present meeting of the City Council.
