HomeMy WebLinkAbout02024 ORD - 01/21/1947AN ORDINANCE No • z 0 z `f REPEALING ORDINANCE NO. 1812 PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, ON THE 26TH DAY OF JUNE, 1945, BEING "AN ORDINANCE CREATING THE WEED AND RUBBISH CONTROL DIVISION OF THE CITY OF CORPUS CHRISTI, TEXAS; CREATING TEE OFFICE OF DIRECTOR OF SAID DIVISION AND DEFINING HIS DUTIES AND POKERS; PROVIDING FOR CONTRACTS TO BE MADE FOR THE CLEANING OF LOTS; PRO- VIDING FOR PENALTIES FOR THE VIOLATION HEREOF; AND DECLARING AN EMERGENCY "; AND ENACTING AN ORDINANCE CREATING THE WEED AND RUBBISH CONTROL DEPARTMENT; CREATING THE OFFICE OF DIRECTOR OF SAID DEPARTMENT AND DEFINING HIS DUTIES AND POWERS, GRANTING THE RIGHT OF INSPECTION OF PREMISES TO THE EMPLOYEES OF SAID DEPARTMENT; PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF; PROVIDING FOR COLLECTION AND DIS- POSITION OF MONEY COLLECTED BY SAID DEPARTMENT; AND DECLARING AN EMERGENCY. WHEREAS, heretofore, the City Council determined that it was necessary in the interest of public health and welfare to regulate and provide for the cleaning of lots within the City of Corpus Christi, Texas, to keep said lots free from weeds and rubbish as provided for in Ordi- nance No. 1601 of the City of Corpus Christi, Texas, and did, pursuant to such determination, pass and approve on the 26th day of June, 1945, Ordinance No. 1812 creating a Weed and Rubbish Control Division and a director of said division, and vesting in that division certain powers and administrative functions to keep lots free from weeds and rubbish and to enforce,Ordinanos No. 1601 of the City of Corpus Christi; and WHEREAS, with a view to extending the functions of the Weed and Rubbish Control Division and the placing of control and direction of that division under the City Health Officer as required by Article W6, Revised Civil Statutes of Texas, 1925, this Council now deems it desirable and necessary in the interest of promoting public health and welfare to repeal said Ordinance No. 1812 and enact in its stead the present ordinance, and WHEREAS, after full and due consideration this Council does now determine that it is necessary in the,interest of public health and welfare to regulate the cleaning of lots within the City of Corpus Christi, Texas, so that the same will be free from all objectionable, unsightly or insani- tary matter of whatever nature, and that the creation of the weed and Rub- bish Control Department will aid in the enforcement of Ordinance No. 1601 ��Z/ of the City of Corpus Christi, Texas, and will cause the lots in the City to be cleaned and kept in a sanitary manner; NOff, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF TBE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. Said Ordinance No. 1812 passed and approved by the City Council of the City of Corpus Christi, Texas, on the 26th day of June, 1945, and recorded in Volume 14, page 403 of the Ordinanoe- Resolution Records of said City, and entitled: "AN ORDINANCE CREATING THE WEED AND RUBBISH CONTROL DIVISION OF THE CITY OF CORPUS CHRISTI, TEXAS; CREATING THE OFFICE OF DIRECTOR OF SAID DIVISION AND DEFINING HIS DUTIES AND POWERS; PROVIDING FOR CONTRACTS TO BE MADE FOR THE CLEANING OF LOTS; PROVIDING FOR PENALTIES FOR VIOLATION HEREOF, AND DECLARING AN EMERGENCY," is hereby repealed and declared to be of no further force and effect. SECTION 2. There is hereby created the "Weed and Rubbish Control Department" as a sub - department of the Department of Public Health. Said sub - department is created for the purpose of carrying into effect the provisions of Ordinance No. 1601 of the City of Corpus Christi, Texas, and Article 1436, Revised Civil Statutes of Texas, 1925- SECTION 3. The City Health Officer shall be in charge of the Weed and Rubbish Control Department and when carrying out the functions assigned thereto shall be known as the Director of the Weed and Rubbish Control Department and shall have full authority to take all action necessary to enforce and carry into effect the provisions of Ordinance No. 1601 of the City of Corpus Christi, Texas, and Article 4 436 of the Revised Civil Statutes of Texas, 1925, SECTION 4. The Director of the Weed and Rubbish Control Depart- ment and the employees of said department shall have the right and authority at any time to go on any premises within the city limits of the City of Corpus Christi, Texas, for the purpose of making inspections to ascertain if the premises are free from weeds, rubbish or other noxious or unhealthy matter, and it shall be unlawful for any person to prevent said director or said employees from making such inspections or to interfere therewith in any manner. -2- SECTION 5. Any person who shall violate any part of Section 4 of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Corporation Court, shall be fined not less than Ten Dollars ($10.00) nor more than Two Hundred Dollars ($200.00). SECTION 6. All monies collected by said Weed and Rubbish Control Department shall be paid into the General Fund of the City of Corpus Christi, Texas, and the Director of the Weed and Rubbish Control Department shall make a proper bond payable to the Mayor of the City of Corpus Christi, Texas, and his successors in office in the sum of One Thousand Dollars ($1,000.00) conditioned that he will faithfully perform all the duties of his office and pay over into the General Fund of the City of Corpus Christi, Texas, all sums of money collected by him as Director of said Department, which said obligation shall be a continuing one and shall not be discharged by one recovery on said bond. SECTION 7. The fact that there now exists in the City of Corpus Christi, Texas, a number of lots in a condition constituting a menace to public health and the fact that the creation of the Weed and Rubbish Control Department with extended power and authority will be of great benefit to the citizens of Corpus Christi, Texas, and will aid materially in reducing the danger to public health which now exists, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that said Charter rule be suspended and that this ordinance take effect and be in full force and effect from and after its passage, IT IS, ACCORDINGLY, SO ORDAINED.
