TRAPSFERRING THE TAXICAB FRANCHISE FIELD
BY R. H. COMER AND J. D. IRAIN, DOING
BUSINESS AS UNION TAXICAB COMPANY, TO
UNION CAB COMPANY, A PRIVATE CORPORATION
INCORPORATED UNDER THE LAWS OF THE STATE
OF TEXAS, KID DECLARING AN EMERGENCY.
WHIUZEAS, the City Council of the City of Corpus Christi,
Texas, did on the 30th day of April, A. D. 1946, pass and approve
an Ordinance granting a franchise to R. H. Comer and J. D. Irwin,
doing business as the Union Taxicab Company, said Ordinance being
Ordinance No. 1894 under record in Volume 14, Page 578 of the
Resolutions and Ordinances Book of Corpus Christi, Texas; and
WHEREAS, SAID R. H. Comer and J. D. Irwin, doing busi-
ness as the Union Taxicab Company, were granted eight (8) taxicab
permits by the City of Corpus Christi, Texas; and
WHEREAS, Union Cab Company, a private corporation incor-
porated under the laws of the State of Texas, has purchased the
franchise from R. H. Comer and J. D. Irwin, doing business as the
Union Taxicab Company, including the eight (8) permits granted by
the City of Corpus Christi, the eight(8)meters used in connection
with said eight (8) permits, the name and good will of the Union
Taxicab Company, including the telephone numbers and telephone
sjvstem of said company, same being subject to approval of the City
Council of the City of Corpus Christi, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the taxi franchise and all rights and
privileges incident thereto which was issued to R. H. Comer and
J. D. Irwin, doing business as the Union Taxicab Company, is hereby
transferred to the Union Cab Company, a corporation incorporated
under the laws of the State of Texas, and the said transfer is hereby
approved.
.SECTION 2. That the said Union Cab Company, its officers
and/or employees shall be bound by all the terms, covenants and
obligations of the original franchise issued to R. H. Comer and
J. D. Irwin.
SECTION j. The fact that the Union Cab Company cannot
legally operate cabs under the aforesaid franchise without the
approval of the City Council creates a public emergency and public
imperative necessity requiring the suspension of the Charter rule
that no Ordinance or resolution shall be passed finally on the
date it is introduced and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor
having declared that such public emergency and imperative necessity
exist, and having requested that such Charter rule be suspended, and
that this ordinance be passed finally on the date of its introduc-
tion and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORD INED.

Gentlemen;
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that
no ordinance or resolution shall be passed finally on the date it
is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, hereby request
that you suspend said Charter rule or requirement and pass this
ordinance finally on the date it is introduced, or at the present
meeting of the City Council.
