HomeMy WebLinkAbout02043 ORD - 03/07/1947AN ORDINANCE AMENDING THE ZCHING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, AND APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RMC OLDS OF THE CITY OF CORPUS CHRISTI AND AS AMENDED FROM TIME TO TIME THEREAFTER BY ZONING OR CLASSIFYING AS HER SET OUT THAT AREA DESCRIBED AS FOLLOWS3 THAT AREA COMMONLY REFERRED TO AS THE E. B. COLE TRACT, WITHIN THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, WHICH IS BOUNDED ON THE NORTH BY LOUISIANA AVENUE, ON THE WEST BY SOUTH STAPLES STREET (OLD DUMP ROAD), ON THE SOUTH BY MINNESOTA STREET, AND ON THE EAST BY ALAMEDA STREET, AND ALSO THAT TRACT OF LAND CONSISTING OF APPROXI- MATELY TWELVE ACRES ALSO LYING WITHIN THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI, TEXAS, AND BOUNDED BY ATAMEDA STREET. MINNESOTA AVENUE, FORT WORTH STREET, AND THE SOUTH LINE OF THE ORIGINAL U. LOTT TRACT, AND DECLARING AN EMERGENCY. WHEREAS, the City Zoning and Planning Commission of the City of Corpus Christi, Texas, ordered a public hearing to be held on the 15th day of November, 1946, for the purpose of hearing objec- tions or recommendations in respect to zoning that area commonly referred to as the E. B. Cole tract, within the City limits of the City of Corpus Christi, Texas, which is bounded on the north by Louisiana Avenue, on the west by South Staples Street (Old Dump Road), on the south by Minnesota Street, and on the east by Alameda Street, and also that tract of land consisting of approximately twelve acres also lying within the City limits of the City of Corpus Christi, Texas, and bounded by Alameda Street, Minnesota Avenue, Fort Worth Street, and the south line of the original U. Lott tract, and WHEREAS. notice of such hearing was published in the Corpus Christi Press, and pursuant to such notice the City Zoning and Planning Commission did on said 15th day of November, 1946, hold such hearing where all interested citizens, property owners and other parties had the opportunity to be heard on the proposed zoning classification of the said area; and .1. afMREAS, the City Zoning and Planning Commission, as a result of the hearing held on said 15th day of November, 1946, and after due deliberation did thereafter file its report and recom- mendations to the City Council as to the manner of classifying the said above described area for zoning purposes; and vVHERF.AS, the City Council did order a public hearing to be held by the City Council on the 9th day of January, A. D., 1947, for the purpose of giving all interested parties, citizens and property owners the opportunity to be heard on the proposed zoning classification of the said area, and notice of such hearing was published in the Corpus Christi Press on the 19th and 26th days of December, 1946, and on the 9th day of January, 192;7; and VCHEREAS, the City Council did on the 9th day of January, 1947, hold such hearing where all interested citizens, property owners and other parties had the opportunity to be heard on the proposed amendment to the Zoning Ordinance and map of the City of Corpus Christi; and WHEREAS at such hearing all discussions and proposals in regard to said zoning by parties appearing thereat were heard and considered by the City Council: NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OP CORPUS CaISTIs SECTION 1. That the area hereinabove described in the first paragraph hereof be zoned for retail use district, "A" area apartment district, and "A" area dwelling district as shown on the following map attached hereto and made a part of this ordinance for all purposes. SECTION 2. That the official zoning map of the City of Corpus Christi is hereby amended as herein ordained. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. The fact that it is of the greatest public importance to immediately put in foree zoning regulations in the area -2- hereinabove described, which at present is without adequate zoning classification, for the purpose of providing for the orderly and progressive building and improving of the said area and for the orderly and progressive growth of the City, and the necessary protection of the lives, health, property and welfare of the citizens in said area, as well as the general public, creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution shall be passed finally on the day it is introduced and that such ordinance or resolution shall be read at three (j) several meetings of the City Council, and the Mayor, having declared that such public emergency and such im- perative public necessity exist, requests that said Charter Rule be suspended, and that this Ordinance take effect and be in full force and effect from and after its passage and after its publica- tion one time as is provided and required by the Charter of the City of Corpus Christi, -A D IT IS SO ORDAINED. 'ZONING PLANNING ENGINEER Corpus Christi, Texas UIarch �, 3.947 TO THE MEMBERS OF THE CITY COMICIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting; of the City Council.
