AMENDING AN ORDINANCE BEING ORDINANCE NO. 1969
AND ENTITLED "AN ORDINANCE CLOSING THE HEARING
GIVEN TO THE REAL AND TRUE OWNERS OF THE PROPERTY
ABUTTING UPON PORTIONS OF CERTAIN STREETS WITHIN
THE LIMITS DESCRIBED IN SUB - SECTION "AREA NO. 1"
OF SECTION 2 AND SUB - SECTION "AREA N0. 3" OF SEC-
TION 2 OF ORDINANCE NO. 1915, PASSED ON THE 18th
DAY OF JUNE, 1946, AND TO THE REAL AND TRUE OWNER
OF ANY RAILWAYS, STREET RAILWAYS AND INTERURHANS
USING, OCCUPYING, OR CROSSING SAID STREETS AS TO
SPECIAL BENEFITS TO ACCRUE TO SAID PROPERTY AND
SAID RAILWAYS, STREET RAILWAYS, AND INTERURBANS
AND TEE REAL AND TRUE OWNERS THEREOF BY VIRTUE OF
THE IMPROVEMENT OF SAID STREETS, BY CONSTRUCTING
SIDEWALKS WITHIN THE LIMITS DEFINED AND AS TO ANY
ERROR, INVALIDITY OR IRREGULARITY IN ANY OF THE
PROCEEDINGS OR CONTRACT THEREFOR, OVERRULING AND
DENYING ALL PROTESTS AND OBJECTIONS OFFERED EXCEPT
AS PERTAIN TO A REDUCTION AND ADJUSTMENT OF THE
AMOUNTS TO BE ASSESSED AGAINST THE SEVERAL PARCELS
OF PROPERTY AS APPEARS HEREIN AND ORDERING AND
GRANTING REDUCTION AND ADJUSTMENT IN SAID AMOUNT
ASSESSED AGAINST PARCELS OF PROPERTY AS HEREIN SET
OUT; FINDING and DETERMINING THAT EACH AND EVERY
PARCEL OF PROPERTY ABUTTING UPON THE PORTIONS OF
SAID STREETS WITHIN THE LIMITS DEFINED WILL BE
SPECIALLY BENEFITTED AND ENHANCED IN VALUE IN EX-
CESS OF THE AMOUNT OF THE COST OF SAID IMPROVEMENT
AS REDUCED AND ADJUSTED HEREIN PROPOSED TO BE AND
AS ASSESSED AGAINST SAID PROPERTY AND LEVYING AN
ASSESSMENT FOR THE PAYMENT OF A PORTION OF THE COST
OF IMPROVING SAID PORTIONS OF SAID STREETS WITHIN
THE LIMITS DEFINED; FIXING A CHARGE AND LIEN AGAINST
THE PROPERTY ABUTTING UPON SAID PORTIONS OF SAID
STREETS AND THE REAL AND TRUE OWNER OR OWNERS THERE-
OF; PROVIDING FOR THE ISSUANCE OF ASSIGNABLE CERTI-
FICATES UPON THE COMPLETION AND ACCEPTANCE OF SAID
WORK; THE MANNER AND TIME OF PAYMENT AND PROVIDING
FOR THE MANNER AND METHOD OF COMPLETION OF SAID
ASSESSMENTS AND CERTIFICATES; AND DECLARING AN
EMERGENCY" AND DECLARING AN EMERGENCY.
WHEREAS, the City Council of the City of Corpus Christi, Texas,
heretofore on the 29th day of August, 1946, by duly enacted ordinance
closed the hearing given to the real and true owners of the property
abutting upon portions of certain streets within the limits described in
Sub- section "Area No. 1" of Section 2 and Sub - section "Area No. 3" of
Section 2 of Ordinance No. 1915 passed on the 18th day of June, 1946; and
WHEREAS, in the process of construction of sidewalks along the
various streets in such Area No. 1 and Area No. .3, it was determined by
agreement between the City of Corpus Christi, Texas, and the M. J. Construc-
tion Company that it was impractical and not to the best interest of the
City of Corpus Christi, Texas, to place sidewalks along certain sbreets in
such area as follows;

West Side Alameda St. from Glazebrook to Minnesota

North Side Minnesota St. from Alameda to Santa Fe
South Side Glazebrook St. from Alameda to Lawnview
South Side Hoffman Street from Topeka to Lawnview
South Side Chamberlain St. from Alameda to Lawnview
South Side Harrison St. from Alameda to Lawnview
AREA No. 3
South Side Tarlton Street from byres to Churchill
WHEREAS, since sidewalks were not placed along the above des-
oribed streets within the limits defined but assessments had been made
against property owners along such streets by virtue of Ordinance No.
1969, it has become necessary to am®ndsaid Ordinance No. 1969 to reflect
the true and correct action of the City Council.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Section 1 of said Ordinance No. 1969 is hereby
amended to read and shall hereafter read as followsz
"Section 1. That there being no further protest or testimony
for or against said improvements, said hearing granted to the real and
true owners of abutting property, on the portions of certain streets
within limits defined as follows:
AREA NO. 1
West Side Santa Fe from Louisiana to Rossiter Street
East Side Santa Fe from Louisiana to Chandler lane
East Side Alameda from Louisiana to Hoffman
South Side Minnesota from Ft. Worth to Alameda
South Side Hoffman Street from Alameda to Topeka
South Side Sunset Street from Lawnview to Santa Fe
North Side Sunset Street from Lawnview to Santa Fe
South Side Breezeway Street from Lawnview to Santa Fe
North Side Breezeway Street from Lawnview to Santa Fe
South Side Oleander St. from Lawnview to Santa Fe
North Side Oleander St. from Lawnview to Santa Fe
-South Side Rosebud Ave. from Lawnview to Santa Fe
-North Side Rosebud Ave. from Lawnview to Santa Fe
South Side Texas Ave. from Alameda to Santa Fe
North Side Texas Ave. from Lawnview to Santa Fe
South Side Indiana Ave. from Alameda to Santa Fe
North Side Indiana Ave. from Alameda to Santa Fe
South Side Ohio Ave. from Alameda to Santa Fe
North Side Ohio Ave. from Alameda to Lawnview

East Side Niagara Street from Morgan to South Fort

and of railways, street railways, and interurban using, occupying,
or crossing certain streets, and to all persons, firms, corporations,
and estates owning or claiming same or any interest therein, be and
the same is hereby closed, and all protests and objections whether
specifically mentioned, or not, shall be and the same are hereby overruled.
SECTION 2. That Section 3 of Ordinance No. 1969 is hereby
amended to read and shall hereafter read as follows:
"Section 3, That in pursuance of said ordinance, duly enacted,
by said City Council, authorizing and ordering the improvement of said
above described streets within the limits hereinabove named and defined,
and in pursuance of said proceedings heretofore had and enacted by said
City Council in reference to said improvements and by virtue of the
powers vested in said city with respect to said street improvements by
the laws of the State of Texas and the Charter of said city, with particular
reference to Chapter 106 of the Acts of the First Called Session of the
40th legislature of the State of Texas, known and shown as Article 1105 -b
of Vernon's Annotated Civil Statutes of Texas, there shall be, and is
hereby levied, assessed and taxed against the respective parcels of property
abutting upon said portions of said streets, and against said railways,
street railways and'interurbans and their roadbeds, ties, rails, fixtures,
rights and franchises, which properties and railways, street railways and
interurban are hereinbelow described, and against the real and true owner
or owners thereof, whether such real and true owner or owners be named
or correctly named herein or not, the several sums of money herebelow
mentioned and itemized opposite the description of the respective parcels
of said property, railway, street railways and interurban, the descrip-
tions of such properties, railways, street railways and interurbans, the
number of front feet of each, and the several amounts assessed against same
and the real and true owners thereof, the names of the apparent owners
thereof, all as corrected and adjusted by said City Council, being as

SECTION 3. The fact that portions of certain streets within
the City of Corpus Christi as above described have not previously hereto
had sidewalks and the fact that sidewalks have been layed in such areas
but in order to finally accept said sidewalks and properly issue assess-
ment certificates against the various property owners requires an amend-
ment to Ordinance No. 1969 creates a public emergency and public imperative
necessity requiring the suspension of the Charter rule that no Ordinance
or Resolution shall be passed finally on the date it is introduced and
that such Ordinance or Resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such public
emergency and imperative necessity exist, and having requested that such
Charter rule be suspended, and that this Ordinance be passed finally on
the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the
foregoing Ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that
no Ordinance or Resolution shall be passed finally on the date it
is introduced, and that such Ordinance or Resolution shall be read
at three meetings of the City Council; I, therefore, hereby request
that you suspend said Charter rule or requirement and pass this
Ordinance finally on the date it is introduced, or at the present
meeting of the City Council.
