CONSTRUCTION COMPANY, A CORPORATIONi AUTHORIZING AND DIRECTING THE ISSUANCE OF SPECIAL ASSESSMENT CERTIFICATES AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That the work of improving the following streets and portions thereof in the City of Corpus Christi, Texas, to -wits AREA NO. 1 West Side Santa Fe from Louisiana to Rossiter St. East Side Santa Fe from Louisiana to Chandler Lane East Side Alameda from Louisiana to Hoffman South Side Hoffman Street from Alameda to Topeka South Side Sunset St. from Lawnview to Santa Fe North Side Sunset St. from Lawnview to Santa Fe South Side Breezeway Street from Lownview to Santa Fe North Side Breezeway Street from Lawnview to Santa Fe South Side Oleander St. from Lawnview, to Santa Fe North.Side Oleander St. from Lawnview to Santa Fe South Side Rosebud Ave. from Lawnview to Santa Fe North Side Rosebud Ave. from Lawnview to Santa Fe South Side Texas Ave. from Alameda to Santa Fe North Side Texas Ave. from Lawnview to Santa Fe South Side Indiana Ave. from Alameda to Santa Fe North Side Indiana Ave. from Alameda to Santa Fe South Side Ohio Ave. from Alameda to Santa Fe North Side Ohio Ave. from Alameda to Lawnview South Side Louisiana Ave. from Alameda to Santa Fe AREA NO. 3 East Side Niagara Street from Morgan to South Port West Side Niagara Street from Morgan to South Port ' 12� 0,5-0 by constructing sidewalks along the sides of the said portions of the described streets all as provided for in the plans and specifications for such improvements, having been performed and completed in accordance with the terms and provisions of the contract and the plans and speci- fications therein contained, dated July 17, 1946, between the City of Corpus Christi, Nueces County, Texas, and M. J. Construction Company; and the Director of Public Works of said City of Corpus Christi having examined, measured and caused to be tested the finished improvements by the means and manner provided by the terms of such contract and the plans and specifications therein contained, and the Director of public Works of said City having found that such improvements have been constructed and completed in full compliance with the terms and provisions of said contract and the plans and specifications thereof, and having heretofore issued his certificate of final acceptance and so certified to said City Council and recommended that said City Council accept and receive said work and the improvements as constructed by said M. J. Construction Company and said work and improvements having been accepted by the said Director of public Worksj and said work and improvements having been found by the Mayor and City Council of said City to have been performed and completed, in full compliance with said contract and plans and specifi- cations thereof, same are hereby found to have been performed and com- pleted by said M. J. Construction Company in full compliance with said provisions of said contract, and the plans and specifications thereof, and are here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That the Mayor and City Secretary of said City are hereby authorized and directed to issue to m. J. Construction Company special assessment cart ificates evidasscing the assessments against pro- perty approved along; AREA N0. 1 West side Santa Pe from Louisiana to Rossiter St. East side Santa Fe from Louisiana to Chandler Lane East Side Alameda from Louisiana to Hoffman South Side Hoffman Street from Alameda to Topeka South Side Sunset St. from Lawnview to Santa Fe North Side Sunset St. from lAwnview to Santa Fe -2- South Side Breezeway Street from Lawnview to Santa Fe North Side Breezeway Street from Lawnview to Santa Fe South Side Oleander St. from Lawnview to Santa Fe North Side Oleander St. from Lawnview to Santa Ft South Side Rosebud Ave. from Lawnview to Santa Fe North Side Rosebud Ave. from Lawnview to Santa Fe South Side Texas Ave. from Alameda to Santa Fe North Side Texas Ave. from Lawnview to Santa Fe South Side Indiana Ave. from Alameda to Santa Fe North Side Indiana Ave. from Alameda to Santa Fe South Side Ohio Ave. from Alameda to Santa Fe North Side Ohio Ave. from Alameda to Lawnview South Side Louisiana Ave. from Alameda to Santa Fe AREA NO. 3 East Side Niagara Street from Morgan to South Port West Side Niagara Street from Morgan to South Port within the limits above defined and against the real and true owner or owners thereof, which, by the terms of such contract, the City of Corpus Christi, Texas, has agreed and obligated itself to issue and deliver to said M. J. Construction Company in accordance with the provisions of the final assessment ordinance and other proceedings herstojtis8 and adopted by said City of Corpus Christij said assessment certificates to be executed in the name of said City by the Mayor and City Secretary thereof and im- pressed by the seal of said City, and such officials are hereby authorized and directed to execute said certificates in their official capacity on behalf of said City, and deliver same to the said M. J. Construction Company. SECTION 3. The fact that permanent street improvements in the nature of construction of permanent sidewalks along the streets hereinabove described within the City of Corpus Christi are immediately necessary for the health and public welfare of the inhabitants thereof and to prevent exposing the citizens to traffic hazards on said streets creates a public emergency and imperative public necessity requiring the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date of its introduction, and that said Ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and public imperative necessity exist, and requested that said Charter rule be suspended and that this ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect —3— from and after its passage, IT IS ACCORDINGLY SO ORDAINED. D. 1947• PRO TEM City of Corpus Christi, Texas ATTEST: City Secretary APPROVED AS TO LEGAZ��— / City Attorney -4- Corpus Christi, Texas April 1, 1947 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
