HomeMy WebLinkAbout02059 ORD - 04/14/1947AAT ORDINANCE -= GZ_ APPROPRIATING MONEY FROM STREET IMPROVEMENT FUND FOR THE PURCHASE OF RIGHT OF WAYS IN CONNECTION WITH OPENING AND WIDENING OF NINE- TEENTH STREET AND DECLARING All EMERGENCY. WHEREAS$ it is necessary that 11ineteenth Street in the City of Corpus Christi be opened and widened; and WHEREAS, to do so it is necessary to obtain right of ways from Fred Frank of the following property, to-'wit: A certain tract of land situated in Corpus Christi, Nueoes County, Texas, and being described as follows: Being an irregular tract of land 251 in width out of the NE corner of Lot 9, Block 12, Segrest Addition, an addition to the City of Corpus Christi, Nueoes County, Texas, and being more particularly described as follows Beginning at a point in the present South R.O.W. line of Morgan Ave. and the N. E. boundary line of Lot 9, Block 12, Segrest Addition, for the NE corner of this tract. Said point being also the present NE corner of Lot 9, Block 12, Segrest Addition. Thence S 27001110" E along the present NE boundary line of Lot 9, Block 12, Segrest Addition, a distance of 49.40 ft. for the SE corner of this tract. Said point being in the West R.O.W. line of Niagara Street. Thence S 280201 W along the West R. 0. W. line of Niagara Street, a distance of 30.34 ft. for the 34 corner of this tract. Thence N 27001110" W parallel to and 25 ft. Yl of the present NE boundary line of Lot 9, Block 12, Segrest Addition, a distance of 79.33 ft. to a point in the present South R.O.W. line of Morgan Ave. for the NW corner of this tract. Thence S. 88052120" E along the present south R.O.W. line of Morgan Avenue a distance of 28.06 ft. to the place of beginning. Con- taining 0.0413 acre of lands and WHEREAS, the City Council has determined that the said right of ways be purchased from Fred Frank, the owner of said land; and WHEREAS, the estimated cost of purchasing the land aforesaid is the sum of Twelve Hundred Dollars ($1,200.00); and WHEREAS, there are sufficient funds in the Street Improvement Fund No. 220 which is now unencumbered and which funds are available for this purpose; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That there is hereby appropriated the sum of Twelve Hundred Dollars ($1,200.00) from the Street Improvement Fund No. 220 which money is to be used for the purchase of the premises for the right of ways above mentioned. SECTION 2. The fact that it is essential, to the general welfare of the citizens and to relieve the congestion of traffic on Nineteenth Street and in that vicinity, that Nineteenth Street be opened and widened creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or rem lution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction, take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
