AN ORDINANCE NO.
APPROPRIATING THE SUM OF $491.31 FROM AIRPORT,
DRAINAGE AND IMPROVEMENT OONSTRUCTION FUND NJ.
245 FOR THE PURPOSE OF CLEARING TITLE TO EASE-
MENT FROM EDNA LENNOX AND DECLARING AN EMER-
GENCY.
WHEREAS bf instrument dated April 19, 1942 and recorded
in Volume 278, Pages 345 -344 of the Deed Records of Nueces County, Texas,
EDNA LENNOX, a fame sole, did grant the City of Corpus Christi, Texas,
an easement over a strip of land one hundred feet (100 feet) in length
located in Nueces County, Texas, and
WHEREM , as a part of the consideration for said easement
said City of Corpus Christi did obligate itself to build, erect and con-
struct a culvert on and across the drainage ditch intended to be built
by the said City on said premises covered by said easement, and
WBEREdS, BOY SMITH, RAY E. SMITH, and J. T. SMITH are
now the owners of all right, title, and interest in and to the land over
which said easement extends, and
WHEREAS, the said ROY SMITH, RAY E. SMITH, and J.T. SMITH
are agreeable to take in lieu of said culvert the sum of Four Hundred and
Ninety One Dollars and Thirty One Cents ($491.31) in full satisfaction
of the terms of said contract and have agreed to release the City from
any obligation due them upon payment of said amount, and
WHEREAS, there are sufficient funds in the Airport, Drainage,
and Improvement Construction Fund No. 245 which is unencumbered and which
funds are available for the purpose;
NOW, THEREFORE. BE IT ORDAINED BY THE CITY OOUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS,
SECTION 1. That there is hereby appropriated the sum of
Four Hundred and Ninety One Dollars and Thirty One Cents ($491.31) from
the Airport, Drainage and Improvement Construction Fund No. 245 which
money is to be used for payment to ROY SMITH, RAY E. SMITH, AND J. T.
SMITH in full settlement of any claim or claims they may have against
the City by virtue of the said easement contract heretofore mentioned.

SECTION 2. The fact that it is essential to obtain
easement for the purpose of drainage ditches in the City of Corpus
Christi, creates a public emergency and public imperative necessity
requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date it is introduced and
that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such public
emergency and imperative necessity exist, and having requested that such
Charter rule be suspended and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
I have examined the accounts and fund from Which the
appropriation is made, as provided for in the ordinance attached here-
to, and I do certify that the money required for such appropriation is
in the Treasury to the credit of the fund from which such appropriation
is to be drawn, and that there are monies in such fund which are not
appropriated for any other purpose and which are available at this
time.

Gentlemen;
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity exist
for the suspension of the Charter rule or requirement that no ordinance
or resolution shall be passed finally on the date it is introduced,
and that such ordinance or resolution shall be read at three meetings
of the City Council; 1, therefore, hereby request that you suspend said
Charter rule or requirement and pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
