HomeMy WebLinkAbout02087 ORD - 05/20/1947AN ORDINANCE :' f , ' AUTHORIZING AND DIRECTING TIE CITY 1,WIAGER OF THE CITY OF CORPUS CriRISTI, TE XAS, TO PURCHASE RIGHT OF WAYS ON MORGAD� AVENU-13 FOR PAVING AND IMPROVIDIG SAID AVENUE, AND AFPRO- PRIATING THE SUM OF FIVE THOUSAND ONE HUNDRED AND SEVENTY -ONE DOLLARS ($5,171.00) FROMI STREET RTROVELTENT CONSTRUCTION FUND NO. 220 TO BE USED FOR THE PURPOSE OF PURCHASING AFORESAID RIGHT OF WAYS ON MORGAN AVEDWE AND DECLARING AN EMERGENCY. Council AHEREAS, the City/has determined that it is necessary to pave and improve Morgan Avenue; and, 4Y[H&REAS, on the 29th day of April, 1947, the City Council passed an ordinance same being ordinance No. 2077 authorizing and directing the City Manager to enter into arbitration agreements with George J. Merriman, Chick Fogaley, George Taylor, Joe 'd. Johnson, and lax Goltzman and wife, Eva Goltzman, for the purpose of purchasing right of ways on Morgan Avenue; and, WHEREAS, said arbitration was carried out according to said ordinance and said contracts authorized thereby and the Board of Arbi- trators found as follows: That George J. Merriman was entitled to receive Fifteen Hundred and Seventy -eight Dollars ($1,578.00) for a portion of right of way pur- chased from him; That Chick Fogaley was entitled to receive Eight Hundred and Ninety -two Dollars ($892.00) for right of way purchased from him; That George Taylor was entitled to receive Nine Hundred and Thirty Dollars ( 930.00) for right of way purchased from him; That Joe W. Johnson was entitled to receive Three Hundred and Seventy -three Dollars (0373.00) for right of way purchased from him; and That ivlax Goltzman and wife, Eva Goltzman, are entitled to receive Thirteen Hundred and 11inety -eight Dollars (ti1,1,398.00) for right of way purchased from them, making a total of Five Thousand One Hundred and Seventy -one Dollars 05,171.00) to be paid for the purchase of said right of way; and, �v V 7 uAHER.F.'A3, it is deemed necessary that said sum of Five Thousand One Hundred and Seventy -one Dollars 05,171.00) be paid for such right of ways in order to be g n widening and improving Mergan Avenue; and WHEREAS, there are sufficient funds in Street Improvement Construction Fund No. 220, which is now unencumbered and which funds are available for this purpose; NO'S, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRIOTI, TEXASs SECTION 1. That there is hereby appropriated the sum of Five Thousand One Hundred and Seventy -one Dollars ($5,171.00) from Street Improvement Construction Fund No. 220 which money is to be used for purchase of right of ways from the parties hereinbefore mentioned on Morgan Avenue. SECTION 2. That the City Manager of the City of Corpus Christi is hereby authorized and directed to purchase said right of ways on Morgan Avenue from George J. Merriman, Chick Fogaley, George Taylor, Joe '7J. Johnson, and Max Goltzman and wife, Lva Goltzman, as set out in Ordinance No. 2077 authorizing said City Manager to enter into arbitra- tion agreements for the purohsse of said right of ways. SECTION 3. The fact that it is essential to secure the right of ways mentioned above before Morgan Avenue can be widened, paved and improved and the fact that it is necessary that said Morgan Avenue, which is a main thoroughfare of the City, be widened and improved as soon as possible creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. -2- PASSED AND APPROVED this '2fday of Way, A. ATTEST: Li�1ty Secretary / APPROVED AS TO LEGAL FORM: / City Attorney Corpus Christi, Texas may LL_, 1947 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Cheater rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
