HomeMy WebLinkAbout02105 ORD - 06/24/1947AN ORDINANCE �( 5 AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, TEXAS, TO ENTER INTO A CONTRACT V4ITH SINCLAIR PRAIRIE OIL COM- PANY FOR THE SALE OF RAW WATER TO BE USED IN THE DRILLING OF AN OIL WELL FOR PHILLIPS PETROLEUM COldANY AND DECLARING AN EMERGENCY, WHEREAS, on January 14, 1910, the City Council of the City of Corpus Christi, Texas, entered into an agreement with Sinclair Prairie Oil Company and Southern Alkali Corporation wherein the said City agreed to sell raw water to said Sinclair Prairie Oil Company, but in such contract limited the use of such water and the purposes for which Sinclair Prairie Oil Company could sell such water to other persons for oil well drilling operations, etc.j and, WHEREAS, Phillips Petroleum Company is desirous of drilling an oil well outside of the area authorized to be served by water in said contract, said well to be drilled at a location 1980 feet from the west line and 4620 feet from the south line of State Tract #706 in Nueces Bay, Nueces County, Texas; and, WHEREAS, it is found advisable to allow Sinclair Prairie Oil Company to purchase water and re -sell same to Phillips Petroleum Company for the purpose of drilling said well; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEAS; SECTION 1. That the City Manager of the said City of Corpus Christi be authorized and directed to enter into a contract with Sinclair Prairie Oil Company to allow Sinclair Prairie Oil Company to purchase necessary water from the City of Corpus Christi at the rate or rates set out in the above mentioned contract, said water to be used by Phillips Petroleum Company for the drilling of one oil well, the location of which is herein - above described. Upon completion of said well, no future water is to be fur- nished the said Phillips Petroleum Company unless further agreed upon by the City. SECTION 2. The necessity for supplying water for the drilling and exploring for oil in the above area creates a public emergency and public CNN' �r imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
