For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that no
ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution shall be read at
three meetings of the City Council; I, therefore, hereby request that
you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of
the City Council.

COUNTY OF NUECES {�
KNOW ALL MEN BY THESE PRESENTS: That the City of Corpus
Christi, Texas, acting by and through its duly elected and consti-
tuted City Council by ordinance duly enacted on the 30th day of
July, $. D. 1946, determined the necessity for and ordered the improve-
ment of the following street within said city, to -wit:
LIPAN STREET from the west property line of
Tancahua Street to the east property line of
Brownlee Boulevard;
by constructing, reconstructing or repairing pavement thereon with
the materials specified in said ordinance in accordance with the plans
and specifications therefor as prepared by the.City Engineer, and by
constructing, reconstructing, or repairing curbs and gutters where `
deemed necessary by said City Engineer, and by construction of such
drainage facilities and other incidentals and appurtenances which are
found necessary in connection therewith.
vul. Yd1C,EI 58 The said ordinance above referred to expressly provides that
a portion of the cost of said improvements is to be paid by and specially
assessed (and has been, by subsequent ordinances, specially assessed)
against the properties abutting on said street within the limits above
defined, and the real and true owners thereof; and the costs of said
improvements within the area between rails, tracks, double tracks, turn-
outs and switches and two (2) feet on each side thereof of any railway,
street railway or interurban using, occupying or crossing such street or
any portion thereof within the limits above defined is to be paid by and
especially assessed against the respective real and true owners thereof,
and roadbed, ties, rails, fixtures, rights and franchises as provided
for in said ordinance; and said ordinance further provides that such por-
tion of the costs of said improvements which shall be payable by and
assessed against said abutting properties, and the real and true owners
thereof, shall be payable upon the completion
and acceptance of said improvements by the City Council of said city,
or at the option of said owners, in ten equal annual installments
due respectively on or before twenty days, one, two, three, four,
five, six, seven, eight and nine years from and after the date of said
acceptance by said City Council, and that said deferred payments shall
bear interest at the rate of five percent per annum, payable annually,
and that the amount to be assessed against and paid by the property
abutting upon said street within the limits defined, and the real and
true owners thereof, shall be secured by a first and superior special
assessment lien against said abutting property and the personal
liability of the real and true owners thereof.
WHEREFORE, the City of Corpus Christi, Texas, has caused this
notice to be signed by A. C. Molbeck, City Secretary, and the official
seal of said city to be hereto affixed on this the 1st day of August,
