D. 1946, by duly enacted ordinance closed the hearing given to the real and true ovriers of the property abutting upon portions of certain streets within the limits des- cribed in Sub- section "Area No. 2" and Sub- section "Area No. 4" and Sub- section "Area nJo. 5" and Sub- section "Area No. 6" and Sub - section "Area 110. 7" and Sub- section "Area Ido. 9" of Section 2 of Ordinance No. 1915, passed on the 18th day of June, 1946; and, 'JUSIPREAS, in the process of construction of sidewalks along the various streets and within the limits described in such areas No. 2, No. LLi No. 5, No. 6, No. 7 and No. 9, it was determined by agreement between the City of Corpus Christi, 'Texas, and the V. J. That Section 1 of said Ordinance No. 1998 is hereby amended to read and shall hereafter read as follows: "Section 1. That there being no further protests or testimony for or against said improvements, said hearing granted to the real and true owners of abutting property on the portions of certain streets within the City of Corpus Christi, Texas, within limits dofined, as follows: AREA NO. 2 West side Ocean Drive from Louisiana to Southern. :'Test side Ocean Drive from Cole to Buford. R. and of railways, street railways, and interurbans using, occupying, or crossing said streets, and to all persons, firms, corporations and estates owning or claiming same or any interest therein, be and the same is hereby closed, and all protests and objections whether specifically mentioned or not, shall be and the same are hereby overruled, except as pertain to the reductions and adjustments in the amount of the assessments as herein made and as are shown in the schedule appearing below in Section III hereof, which reductions and adjustments are hereby made and granted in order to -3- produce justice and equity and substantial equality between said assess- ments, considering the benefits to be received and the burdens imposed thereby. SECTION 2. That Section 3 of Ordinance No. 1996 is hereby amended to read and shall hereafter read as follows: "Section 3. That in pursuance of said ordinance, duly enacted, by said City Council, authorizing and ordering the improvement of said above described streets within the limits hereinabove named and defined, and in pursuance of said proceedings heretofore had and enacted by said City Council in reference to said improvements and by virtue of the powers vested in said city with respect to said street improvements by the laws of the State of Texas and the Charter of said City, with particular reference to Chapter 106 of the Acts of the First Called ,Session of the 40th Legislature of the State of Texas, known and shown as Article 1105 -b of Vernon's Annotated Civil Statutes of Texas, there shall be, and is hereby levied, assessed and taxed against the respective parcels of prop- erty abutting upon said portions of said streets, and against said railways, street railways and interurbans and their roadbeds, ties, rails, fixtures, rights and franchises, which properties and railways, street railways and interurbans are hereinbelow described, and against the real and true owner or owners thereof, whether such real and true owner or owners be named or correctly named herein or not, the several sums of money herebelow men- tioned and itemized opposite the description of the respective parcels of said property, railway, street railways, and interurbans, the descriptions of such properties, railways, street railways and interurbans, the number of front feet of each, and the several amounts assessed against same and the real and true owners thereof, the names of the apparent owners thereof, all as corrected and adjusted by said City Council, being as follows, to -wit: vlest side Oceen Drive Final Sidewalk ASSESSMENT from Louisiana to Southern AW4�;4 Sidewalk M. & J_ Conatruction,S4* 3eevi'1l e, Tgzas. The fact that portions of certain streets within the City of Corpus Christi as above described have not previously hereto had sidewalks and the fact that sidewalks have been constructed in such areas, but in order to finally accept said sidewalks and properly issue assessment certificates against the various abutting property owners, requires an amendment to Ordinance No. 1998 creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed -finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Counoil, and the Hayor having declared that such public emergency and imperative necessity exist, and havinE requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINK), PASSED and APPROVED this o7, day of Sept, A.
