'Vril 'RIiAS, by instrument of record in Volume 2 3, Pages
328 -330, of the Deed Records of I?ueces County, Texas, the City of
Corpus Christi, Texas, obtained an easement over three (3) acres
of land located in Nueces County, Texas, and fully described in
said instrument; and,
,- TTMEAS, the Department of Public 'forks has advised the
Council that this easement has been abandoned and that there is
no need for additional easements on this property at this time; and
VR1ERE.k:, Laude Elizabeth Jack, through her agent, Paul C.
Barion, has petitioned the Council to release said easement in order
to clear title on her property;

SEC'TIO14 1. That the City Manager is hereby authorized and
directed to execute a release of the easoment as set out in instrument
of record in Volume 253, Pages 328 -330 of the Deed Records of Nueces
County, Texas, to 1"aude Elizabeth Jack, a copy of said release is
attached hereto and made a part of this ordinance for a].1 pertinent
purposes.

COUNTY OF EUNCES I KNOW ALL MEN BY THESE PRBSENTSs
That the City of Corpus Christi, Texas, a municipal
corporation, acting through its duly authorised City Manager, for
and in consideration of the sun of One Dollar ($1.00) to it in hand
paid by Maude Elizabeth Jack of the County of Nueces, State of
Texas, receipt of which is hereby acknowledged, do, by these pro -
sonts, release sod forever quit, claim unto the said Maude Elisabeth
Jack, her heirs and assigns, all its right, title and interest in
and to an easerrsnt granting the City the right to maintain a sanitary
sewer across a certain tract of land in Nuec►s County, Texas, described
as follows, to -wits
Three (3) &ores of land, the same being a portion of
what is known as the C. U. Cannella Tract and taken out of
the East :mod of the said C. U. Cannella 27.7 &are tract, and
being the eastern three acres of a five sore tract, a por-
tion of the original Cannella Tract, which Cannella Tract
is described in a deed of date, Nexch 15, 1909, to W. J.
Montrief, of record in Val. 51, page 396, of the Deed Records
of Nueces County, Texas,
said easement being of record in the Deed Bsoords of Nueoes County,
Texas, in Volume 253, pages 328 -330.
The said easement mentioned above and the right of way
granted thereby has been abandoned and is of no further use to the
City of Corpus Christi and it is the intention of this instrument
to release and quit claim all right, title and interest the City has
in said easement to Maude Elizabeth Jack, her heirs, suooessor■ and
assigns.

SECTION 2. The fact that the easement mentioned above
in this ordinance has been abandoned and is of no further use to
the City and the fact that it is essential that title to the property
above mentioned be cleared creates a public emergency and public
imperative necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date it
is introduced and that such ordinance or resolution shall be read
at three several meetings of the City Council, and the 'Aayor having
declared that such public emergency and imperative necessity exist,
and havinU requested that such Charter rule be suspended, and that
this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its
passage, IT IS ACCORDr.-GLY SO ORD AHD.

Gentlemen:
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that no
ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution shall be read at
three meetings of the City Council; I, therefore, hereby request that
you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of
the City Council.
