Jurach for grazing riJ;hts, ,a cony of :^ihich contract is attached hereto and made a part hereof and reads as follows, to -wit; STATE OF TEXAS I COUNTY OF NUECFS $ This agreement made and entered into this the day of December, A. D. 1947, by and between the City of Corpus Christi, Texas, a municipal corporation, hereinafter called "City" and J. B. Jurach of Nueoes County, Texas, hereinafter called "Lessee ". IITNESSETH The City of Corpus Christi, Texas, does by theme presents lease and demise unto the said J. 8. Jurach, Lessee, the following described premises, to -exit: Being approximately 35.15 acres of land out of a oer- tain LSO wore tract of land purchased from L. 14. Kasse- baum and being Lots 9 and 10 in Section 21 of the Flour Bluff and 'inoival Farm and Garden Tracts of Nueoes County, Texas, according to the map and plat records thereof of record in the flap Records of Nueoes County, Texas, less 4.el.le acres of land heretofore deeded to the County of Nueces by the City of Corpus Christi. Texas, for the term of one year beginning: 19'1 ' and ending on —, 194 i the Lessee is to pay therefor the sum of seventy -five Dollars ( M.00) per year, subject to the following conditions and covenantas 1. That the Lessee shall pay the rent in advance as afore- said as same shall fall due. 2. It is understood and agreed that the leased premises are to be used for grazing purposes for livestock only. That premises are not to be used for any other purpose than these herein specified unless consented to by the City in writing. 3. Losses agrees not to sub -let the leased premises or any portion thereof without the consent of the City in writing. 4. The Lessee agrees that he will take good care of the property and its appurtenances, and suffer no waste, ar4d shall keep the said premises in good repair at his own expense, and at the end or other expiration of the term of this lease, shall deliver up the demised promises in good order and condition, as same are now in. natural woor and tear and damage from the elements only excepted, Pro- vided, however, either party may terr,ir_:ate th-_a loo-,e before its date of expiration by :living to the other xarty thirty (?0) d ^; s written notice of suer in.- taaition. 5. The City reserves the right to enter the said premises at any time during the existence of this lease for the purpose of inspecting the same in order to determine whether the terms of said lease are being observed and carried out. 0. Lessee agrees not to use said premises for say illegal or immoral purposes and agrees to conform to all the laws of the State, the United States, and all rules set out by the City Manager of the City of Corpus Christi, Texas, for the operation of the leased premises. 7. The Lessee shall promptly execute and fulfill all the ordinances of the City of Corpus Christi applicable to said promises, and all orders and requirements imposed by the .Board of ffealth, Sanitary and 'Police Departments, for the correction, prevention and abatement of nuisances in, upon, or connected with said premises during the term of this lease at his own expense. The Lessee further agrees that in case of any default in any of the covenants and conditions of this lease, the City may en- force the performance thereof in any modes or manner provided by law, and may declare the lease forfeited at its discretion, and its Its agents or attorney shall have the right, without further notice or demand, to re -enter and remove all persons therefrom, without being doomed guilty of any manner of trespass and without prejudice to any remedies for arrears of rent or breach of covenant, or the City, its agents or attorney, may resume possession of the premises and re -let the some for the remainder of the term at the best rent they may ob- tain, for the account of the Lessee, who shall make good any deficiencys and the Lessor (the City) shall have a lien as Security for the rent aforesaid, or any rent dim and unpaid under said lease, upon all livestock, goods, wares, chattels, implements, fixtures, furniture, tools and other personal property which are now located an said premises or which may be placed on said premises by the Lessee, which lien shall be oumu- lative of the statutory lien created by law and in addition theroto. -2- 9. Lessee agrees to save and keep harmless the said City of Corpus Christi, Texas, from any claims or damages of any nature whstao- ever due to any negligence of Lessee or his employees in the operation of the leased premises.
