MiEHEAS, by Ordinance No. 2181 passed and approved by the City Council of the City of Corpus Christi on the 25th day of November, 1947, the City Manager was authorized and directed to execute a con- tract with Leo A. McAlister leasing certain lands located at Cliff Maus Airport and which lease was fully described aid set out in said Ordinance; and, W, REAS, it is deemed necessary that the second covenant of said lease should be changed and amended and said change and amendment has been agreed on by the said Lessee, Leo A. McAlister; NOw, ThuYust'ORI, BE IT ORDAINED BY TIC: CITY COUNCIL OF TITS, CITY OP CORPUS CIiRI3TI, TEXAS; SECTION 1. That the City lvlanager is hereby authorized and directed to execute for and on behalf of said City a lease with Leo A. IvicAlister amending the second covenant of said lease set out in Section I of Ordinance No. 2181 so that said second covenant shall read as follows, to -wit; "SECOND; Lessen agrees to pay to lessor, not later than the 5th day of each and every month, rent in an amount equal to three per cent of the gross receipts and income up to and including 41,000.00 received during the preceding month in connection with the operation of the air- line commissary service conducted in said cuisine building; and five per cent on all gross income Wien Cross income is in excess of +' „1,000.00. Lessee agrees to keep and maintain accurate and complete records of all receipts and income received in connection with said airline commissary service, which records shall at all Limas be subject to inspection and audit by Lessor.” The remainder of said instrument hereby authorized to be executed by said City Manager is to be the same as the Contract: set out in Ordinanca No. 2181 with the exception of the amendment set out above. SECTION 2. The necessity for adequate commissary service for commercial airlines which are using Cliff luaus Airport creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be sus- pended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passabe, IT IS ACCORDINGLY SO ORDAIIu D.
