HomeMy WebLinkAbout02211 ORD - 01/20/1948AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER CF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE A CONTRACT FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, WITH J. DHPUY AND SON FOR THE CONSTRUCTION OF PUMPING PLANTS A AND B, GENERAL CONTRACT, BAYFRONT IMPROVEMENT PROJECT AND SETTING UP A SPECIAL FUND TO DISCHARGE THE CITY +S OBLIGATION UNDER THE TERMS OF AFORESAID CONTRACT AND DECLARING AN EMERGENCY. WfMREAS, pursuant to authority therefor heretofore given by the order of this Council, due advertisement for bids for building and installation of machinery and equipment on the bayfront improvement pro- ject of the City was made in accordance with the requirements of law; and, WHEREAS, pursuant to said advertisements and on December 23, 1947, bids were tendered this Council for the hereinabove mentioned work to be done on the bayfront project and said bids were at such time pub - lioly opened and considered; and, WHEREAS# thereafter on December 30, 1947, this Council, upon due consideration, accepted the bid or proposal of J. DeRW and Son; and, WHEREAS, by the terms of said bid said J. DePtV and Son are to receive the sum of Three Hundred and Six Thousand Seven Hundred and Sixty ($306,760.00) Dollars for completing the work set out in such pro- posal; and, WHEREAS, it is the judgment of this Council that authority should be given the City Manager to execute a contract for and on behalf of the City and authority should be given the City Secretary to attest said con- tract in his official capacity and on behalf of the City; and, WHEREAS, it is further the judgment of the Council that provision should be made for payments due under said contract and that said payments should be made from funds available for this purpose and there are sufficient funds available for this purpose in Seawall and Breakwater.Construotion Fund No. 258; NOR, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXASs SECTION 1. That the findings and declarations made in the preamble hereof be and the same are hereby adopted as the findings and judgment of this Council and as a part of this Ordinance. ZZI SECTION 2. That the City Manager and the City Secretary are hereby empowered, ordered and directed to execute a formal contract between the City of Corpus Christi and J. DePuy and Son for the doing of all the work and furnishing all necessary superintendence, labor, machinery, equip- ment, tools, and materials, and to complete all the work as provided by specifications and plans submitted by the City of Corpus Christi. SECTION 3. That the sum of $306,760.00 now in hand in the City Treasury, legally available to pay and discharge the City's obligations under the aforesaid contract with J. DePuy and Son be and the same is hereby pledged to said purpose. The Director of Finance is hereby ordered and directed to set aside said sum in a special fund to be designated Fund No. 258, J. D®Puy and Son Contract, and to make payments therefrom for, and only for, dis- charging the Cityts obligations under the terms of the aforesaid contract upon vouchers or warrants duly drawn against said special fund. SECTION 4. The fact that the work and things to be done as set out in the contract described in this ordinance is essential in order to provide proper facilities for the protection of the health and general welfare of the citizens of the City of Corpus Christi creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having re- quested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. City of Corpus Christi, Texas Corpus Chr�jqti, Texas January ' 1948 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinanoe finally on the date it is introduced, or at the present meeting of the City Council.
