HomeMy WebLinkAbout02246 ORD - 03/23/1948AN ORDINANCE iV.. �.7fCG TRANSFERRING THE TAXICAB FRANCHISE NO;i HELD BY MARCUS DE Li GAHM, d/b/a LEOPARD CAB COMPANY TO FELIX SERNA AND PEDRO RODRIGUEZ AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of Corpus Christi, Texaa, did on the 27th day of May, 1947, pass and approve an ordinance granting a franchise to Marcus de Is Garza, d/b/a Leopard Cab Company, said ordinance being numbered 2088 and of record in Volume 15, Page 449 of the Ordinance and Resolution Records of the City of Corpus Christi, Texas; and, WHEREAS, Felix Serna and Pedro Rodriguez have purchased the franchise of Marcus de Is Garza, d/b/a Leopard Cab Company, including the five (5) permits granted by the City of Corpus Christi, Texas, such sale being subject to the approval of the City Council of the City of Corpus Christi; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXASI SECTION 1. That the taxicab franchise and all rights and privileges incident thereto which was issued to Marcus de la Garza, d/b/a Leopard Cab Company, is hereby transferred to Felix Serna and Pedro Rodriguez and said transfer is hereby approved. SECTION 2. That the said Felix Serna and Pedro Rodriguez shall be bound by all the terms, covenants and obligations of the original franchise issued to Marcus de la Garza, and said Felix Serra and Pedro Rodriguez shall acknoeledge by letter acceptance of the terms of this transfer of franchise. SECTION 3• The fact that Felix Serna and Pedro Rodriguez cannot legally operate cabs under aforesaid franchise �i.thout approval of the City Council creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at throe several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. Dawson aaq� Corpus Christi, Texas Parch 16, 1948 TO' The City Council of the City of Corpus Christi, Texas FRCN: Marcus De La Garza, d/b /a Leopard Cab Company Gentlemen: On the 27th day of Nay, 1947, the City Council of the City of Corpus Christi, Texas, granted to Marcus De La Gars,, d/b /a as Leopard Cab Company, a permit or franchise to engage in the taxicab business in Corpus Christi and to operate five taxicabs. The ordinance was duly published and provisions thereof were accepted in writing by Marcus He La Garza. Section 17 of the said ordinance provides that the said franchise, and the permits held by the grantee in connection with said franchise, may be sold, transferred and in- herited; provided, however, that any sale or transfer shall be first presented in writing to the City Council for its approval or disapproval and the City Council may disapprove such proposed sale of transfer if it be found that such proposed sale or transfer is not in good faith or that the proposed purchaser or transferee is not capable Of continuing the operation under such franchise in such a manner as to render the services demanded in the best interest of the public; the City Council in approving or disapproving any such sale or transfer Of this franchise, and the permit- owned in connection therewith, .W take into consideration all of the requirements and qualifications of a regular application, and apply same as necessary qualifications of any proposed purchaser or transferee. The grantee, Marcus De La Garza, proposes to sell and transfer his franchise and permits to Felix Serna and Pedro Rodriguez, citizens of Corpus Christi, Texas, and hereby requests approval by the City Council of the proposed sale and transfer. Marcus De La Garay would show: I. That the proposed sale or transfer is in good faith. II. That the proposed purchasers or transferees are capable of continuing the opeagtion under such franchise in such manner as to render the services demanded in the beet interest of the public. A IHO III. Feliz Serna is 94 years of age, is married and has two children. He has his home qt 1406 Musset Street in Corpus Christi. He served in the Armory and is a disabled veteran drawing a small pension. He served for a year in the South Pacific. Since his discharge from the Army fifteen months ago he has been driving a taxi and now drives for Leopard Cab Company. He has a clean record with the Taxicab Inspector. he is of good moral character and is a man of sober habits. He will manage the business. Iv. Pedro Rodriguez is 42 years of age, married, and has his home at 1721 Coleman Street in Corpus Christi. he works at the Naval Air Station and has been employed there for about seven years. He is of good moral character and of sober habits. V. The buyers have sufficient funds to pay cash for the business and have sufficient property and funds to operate the business In the beat interests of the public. They will use only first -class equipment, will keep and maintain their equipment in good condition, and will take out insurance to protect the public against damage.
