For the reason set forth in the emergency clause,

and declaring an emergency', the proposed ordinance meets a public emergency

MiEREAS, heretofore on the 23rd day of March, 1948,
the City Council of the City of Corpus Christi, Texas, passed ordinances
calling an election to be held in said City on the 10th day of April, 1948,
on the following propositions:
PROPOSITION NLW R 1
"Shall the Cit;F Council of the City of Corpus Christi be authorized
to issue the bonds of said City in the sum of One vii i ion Four
hundred and Sixty Five Thousand Dollars (*1,465,000.00), maturing
serially in such installments as the City Council may prescribe
within a period of not exceeding thirty (30) years from the date of
the issuance of said bonds, bearing interest at a rate or rates not
to exceed Five (5A) per cent per annum, payable semi- apnually, and
to levy a tax on all of the taxable property within the City sufficient
to pay the annual interest and provide a sinking fund to pay the
bonds at maturity, for the purpose of improving, enlarging, and

authorized by the Constitution and the laws of the State of Texas and

Eighty Five Thousand Dollars (0585,000.00)3 maturing serially in
such installments as the City Council may prescribe within a period of
not exceeding thirty (30) years from the date of the issuance of said
bonds, bearing interest at a rate or rates not to exceed Five (5%)
per cent par annum, payable sari- annually, and to levy a tax on all
taxable property within said City sufficient to pay the annual interest
and provide a sinking fund to pay the -oonds st maturity, for the
purpose of making permanent street im--nts within the City, as
authorized by the Constitution and the p laws of the State of Texas
and the Charter of said City?"

to issue the bonds of said City in the sun of Nins Hundred and Fifty
Thousand Dollars ($950,000.00), maturing serially in such installments
as the City Council may prescribe within a period of not exceeding
thirty (30) years from the date of the issuance of said bonds, bearing
interest at a rate or rates not to exceed Five (5 %) per cent per annum,
payable semi annually, and to levy a tax on all taxable property with -
in said City sufficient to pay the annual interest and provide a
sinking fund to pay the bonds at maturity, for the purpose of improving,
enlarging and extending the sanitary sewer systems i<i and for said
City, as authorized by the Constitution and the laws of the State of
Texas and the Charter of said City ?"

authorised to issue the bonds of said City in the sum of Cne
Hundred Thousand Dollars ($100,000.00), maturing serially in such
installments as the City Council may prescribe within a period of
not exceeding Thirty (30) years from the date of the issuance of
said bonds, bearing intareat at a rate or rates not to exceed Five
(5qi per cent per annum, payable semi - annually, and to levy a tax
on all of the taxable property within the City sufficient to pay
the annual interest and provide a sinking fund to pay the bonds
at maturity, for the purpose of constructing improvements to the
municipal airport of said City, extending and improving the drainage
systems thereof, and purchasing the necessary sites and right of ways
therefor as authorized by the Constitution and laws of the State
of Texas and the Charter of said City?"

"Shall the City Counci -I of the City of Corpus Christi, Taxas, be
authorized to issue the bonds of said City in the sum of One Hundred
and Fifty Thousand Dollars (4150,000.00), maturing serially in such
installments as the City Council may prescribe within a period of not
exceeding thirty (30) years from the date of the issuance of said
bonds bearing interest at the rate or rates of not to exceed Five
(5 %) per cent per annum, payable semi- annually, and to levy a tax on
all of the taxable property within the City euffloi —t to pay the
annual interest and provide a sinking fund to pay the bonds at maturity,
for the purpose of the following permanent improvements, to -wit:
constructing, building, equipping and improving pleasure grounds,
parks and playgrounds in and for said City, for securing and acquiring
the necessary lands and sites therefor and for improving, extending
and equipping pleasure grounds, parks and playgrounds now owned by said
City, as authorized by the Constitution and the laws of the Stats of
Texas and the Charter of said City ?"

"Shall the City Council of the City of Corpus Christi, Texas,
be authorized to issue revenue bonds for said City in the sum of
Two hill' on Five Hundred Fifty Thousand Dollars (N2,550,000.00)
payable serially, within not to exceed thirty -five (35) years from
the date of such bonds, bearing interest not to exceed Five (5%)
per cent per annum, payable semi - annually, said bonds to oe
redeemable at the option of the City at any interest paying date
after the and of ten (10) years from the date of issuance, for
the purpose of making improvements, extensions, repairs or re-
placements of and to the waterworks system in aforesaid City,
to the extent and in the manna: expressly permitted by, and in
accordance with the limitations contained in the ordinance which
shall have been previously passed by the City Council. of the City
of Corpus Christi, Texas, authorizing the issuance of bonds
against the waterworks system of the City of Corpus Christi for
the payment of the judgment in the case of Fred F. Hayward, at al,
vs. The City of Corpus Christi, at al, No. 2666 on the docket
of the Court of Civil Appeals, 10th Supreme Judicial District,
iaeo, Texas, and as authorized by the Charter of the City rf
Corpus Christi and the general laws of the State of Texas
and in pursuance of Article 1110a of Vernon's Annotated Civil
Statutes of Texas, as passed by the 49th Legislature, Acts of
1945, page 605, Chapter 349, and in accordance with Article 1111
and Articles 1113 to 1718, both inclusive, of the Revised Civil
Statutes of Texas as amended, said bonds to be payable solely
out of and secured by a pledge of the revenues of the waterworks
system of the City of Corpus Christi, which shall include all
properties and everything pertaining thereto, awned or thereafter
acquired; said bonds to be issued for the purpose of improvements,
extensions, repairs or replacements of and to the said waterworks
system to be secured by a pledge of the revenues of such system,
and lien upon the properties constituting the System and upon
'I the franchise thereof of equal dignity with the pledge and liens
securing said bonds issued to pay off the said Hayward Judgment
under the ordinance hereinabove mentioned ?"

1. That the propositionsto issue the bonds was sustained

liby a majority of the resident, qualified electors who own taxable property
in said City and who have duly rendered the same for taxation voting at said

.'. election and the City Council of the City of Corpus Christi, Texas, is hereby
authorized to issue said bonds in accordance with said propositions.
2. The facts: That the contemplated improvements are
necessary for the orderly development and growth of the City of Corpus
Christi and for the protection of life, health and property and for the
general welfare of the citizens and residents of the City of Corpus Christi
and that it is necessary to make needed improvements and additions to the
waterworks system of the City of Corpus Christi, Texas, in order to give
1 adequate water facilities to the citizens of the City of Corpus
Christi and to prevent injury to the health and welfare of such citizens
and the fact that it is necessary to vote bonds to secure finances
necessary for the above mentioned work creates a public emergency and impera-
tive necessity requiring the suspension: of the Charter rule that no ordinance
or resolution shall be passed finally on the date it is introduced and that
such ordinance or resolution shall be read at three several meetings of The
City Council, and the Laz?or having declared that such public emergency and
imperative necessity exist, and having requested that such Charter rule be
ii suspended, and that this ordinance oe passed finally on the date of its
introduction and take effect and be in full force end effect from and after

its passage, IT IS ACCORDINGLY SO ORDAIhnD.
