HomeMy WebLinkAbout02256 ORD - 04/13/1948AN ORDINANCE REPEALING ORDINANCE N0. 1973 PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON THE 6th DAY CF SEPTEMBER, 1946; AND PROVIDING FOR THE PROMOTION OF PUBLIC HEALTH AND WELFARE, REGULATING THE KEEPING OF CERTAIN ANIMALS WITHIN THE CORPORATE LIMITS OF THE CITY OF CORPUS CHRISTI; PROVIDING FOR HEALTH MEASURES AND RULES INCIDENT TO THE PRESERVATION OF THE HEALTH OF THE CITIZENS OF CORPUS CHRISTI; PROHIBITING THE KEEPING OF SWINE WITHIN THE CCRPORATE LIMITS OF THE CITY; PROVIDING & FOR THE VIOIATICN THEREOF, AND DECLARING AN BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CCRPUS CHRISTI, TEXAS, SECTION 1. That Ordinance No. 1973 passed and approved by the City Council of the City of Corpus Christi, Texas, on the 6th day of September, 1946, and recorded in Volume 15, Page 121, of the Ordi- nance and Resolution Records of said City, is hereby repealed and declared to be of no further force or effect. SECTION 2. Wherever in this ordinance the following terms are used, they shall have the meanings respeotively ascribed to them in this section. ANIMALS. Horses, mules, donkeys, cattle, goats and sheep. E'EEPER. Person, firm or corporation owning and /or actually keeping or maintaining any of the animals referred to in Section 3 hereof. PERMIT. Any permit granted by the City Health Officer pur- euant to power granted to him in this Ordinance. PERSON. Individual, firm or corporation. RATPROOF. State of being constructed so as to effectively prevent entry of rats. SANITARY. Any condition of good order and cleanliness which precludes the probability of disease transmission. SECTION 3- It shall be unlawful for any person to keep or main- tain any of the following described animals without having a valid permit from the City Health Officer authorizing the keeping of the same- horses, mules, donkeys, cattle, goats and sheep. Each such permit, unless revoked by the City Health Officer, shall be valid and effective for not more than twelve (12) months from the date of the issuance thereof. SECTION 4- Keeper. of any of said animals shall be granted permit. by the City Health Officer upon their making application there- for and complying with the provisions of this Ordinance. Application for a permit shall be submitted to the City Health Officer on a form prepared by him, which form shall require applicant to furnish general information reasonably needed by the City Health Officer in administering the provisions of this Ordinance, including such information as the number and kind Of animals to which the application pertains, the loca- tion and description of the place said animala are proposed to be kept, the shortest distance between the exterior limits of such place and the exterior limits of the nearest dwelling resided in by anyone other than applicant, and further including a statement that applicant will at all times keep said animals in acoordance with the provisions of this Ordinance. SECTION 5, The failure of any keeper of any of said animals to comply with the provisions of this ordinance shall be cause for the City Health Officer to refuse to grant a permit for the keeping of such animals, or, if a permit shall have been previously granted to such keeper, shall be cause for the revocation of same. SECTION 6. hbery keeper of any of .aid animals shall confine the same in an enclosure sufficient to prevent their running at large and such enclosure shall be maintained in a clean and sanitary condi- tion at all time and an approved insecticide shall be used. as often as deemed necessary by the City Health Officer. - SECTION 7. -very keeper of any of said animals shall cause the litter and droppings therefrom to be collected daily in a con- tainer or receptacle of such a type that when closed it is ratproof- and fly -tight and after each such collection shall cause such container or receptacle to be kept closed. At least once each week, each such keeper shall cause all litter and droppings so collected to be disposed of in such a way as not to permit fly breeding. SECTION 8. Every keeper of any of said animals shall cause all feed provided therefor to be stored and kept in a rat - proof, fly - tight building, box, container, or receptacle. -2- SECTION 9. dithin one hundred (100') feet of any dwelling resided in by anyone besides their owner, it shall be unlawful to keep any horses, mules, donkeys, cattle, goats and sheep. Animal. shall be deemed to be kept within one hundred (100') feet of a dwelling when- ever any part of the exterior limits of the place or area within which they are confined is less than that distance from the exterior limits of such dwelling, exeept the one hundred (1001) feat distance requirement shall not apply in areas in the City zoned for heavy industry or here- after zoned for heavy industry. SECTION 10. It shall be unlawful for any person, firm or corporation to keep or cause to be kept for any purpose whatsoever any swine within the corporate limits of the City Of Corpus Christi, Texas. SECTION 11. This ordinance shall not apply to the keeping of dogs as set out in Ordinance No. 2079, passed and approved by the City Council on the 6th day of 1%y, 1947, which shall govern in regard to the regulations of the keeping of dogs in the City limits of the City of Corpus Christi and this ordinance shall in no manner affect, nor shall same repeal, Ordinance He. 2079 and said Ordinance :Io. 2079 shall remain ' in full force and effect. SECTION 12. Any keeper in violation of the terms of this ordi- nance at the time of its passage shall have ninety (90) days from the effective date of said ordinance to conform to same. SECTION 13. Violation of azW provisions of this Ordinance by any person, firm or corporation shall constitute a misdemeanor upon con- viction of which in the Corporation Court of the City of Corpus Christi a fine of not less than Five ($5.00) nor more than Two Hundred ($200.00) Dollars shall be imposed, and each day that such violation continues shall be a separate offense. SECTION 14. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this Ordinance shall be held invalid, it shall not affect any valid provisions of this or any other Ordinance of the City of Corpus Christi to which these rules and regulations relate. SECTION 15. This Ordinance .hall take effect and shall be in force from and after the time of its passage and publication as provided by law. SECTION 16. The necessity for protecting the health and welfare of the citizens Of the City Of Corpus Christi by passing proper health ordinances such as this ordinance creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings Of the City Council, and the Mayor having declared that such public emergency and .imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAIPTF_D.
