WIJWJ S, Sranett C. Coker of Suecee Cously. Texas. is the owner
and developer of Belnoat Park Addition to the City of Corpus Christi, -
Texas, and is deairous of supplying water and gas to the said Additions
Now. THMUIK . this agressent made and entered into this
the day of April, A. D. 1948, by and between the City of Corpus
Christi, Tens, a — xicipal corporation, acting by and through its duly
authorised agents, hereinafter called "City ", and Sennett C. ficker of
puaces County, Texas, hereinafter termed "Devaloper ",

The City agrees for and in consideration of the rem of Saves
Thousand and Forty -four Dollars and Twenty Coats (67.044.20) cash in hand
paid by the Developer, receipt of which is hereby acknowledged and
confessed, to furnish the neeeasary water lines to serve Belmont lark
Addition in conformity with the water line layout of said Addition pre-
pared by Barry L. Hoag, ?�glneer, and on file in the office of the
Director of Public tsorks of the City of Corpus Christi, reference to
which water line layout plan is hereby made for all intents and purposes,
said installation of said water line to be at the expense of the City.

The City agrees to cwmtruct and install at its own expense
the necessary gas lines to serve said Belau Park Addition, as deter-
mined by the Department of Aiblio Utilities of said City.

It is further agreed and understood that upon completion of
this work all water and gas lines placed in said subdivision are to be-
coma the property of the said City. And it is understood and agreed that
the Developer conveys by the execution. of this instrument all right,
title, interest and *lain he may have in and to any and all water end
gas linos installed in accordance with this agreement.

TIE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE
FOR AND ON BEHALF OF SAID CITY AN AGREEMENT
WITH BE MT C. OCKER COVERING INSTALLATION OF
WATER AND GAS LINES IN BELMONT PARK ADDITION
TO THE CITY OF CORPUS CHRISTI, AND DECLARING
AN 3IlMCENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi,
Texas, be and he is hereby authorized end directed to execute for and
on behalf of said City an agreement with Bennett C. ticker covering in-
stallation of water and gas lines in Belmont park Addition to the City
of Corpus Christi, a copy of which agreement is attached hereto and
made s part hereof for all intents and purposes and reads as follows, to-
wit:

It is understood aced agreed that the Oity will begin work on
installing said water and gas lines as soon as reasonably possible, and
will prosecute the work diligently to conclusion, in aceordanee with the
terse hereof, but it is understood that said work is to he completed
within ens year from the date of this lastrunent, It is further under -
atoned and agreed that the parties hereto will cooperate with each other
and that developer will hold up oonetructioa of the paving of the .treats
In said addition until the said water and gas lines have been laid=
provided, however, that should any street be already laid, and it is
neosseary, in the course of complying with this contract, that the City
dig up any part of said street or streets, the City shall fill up such
holes or ditches as it nay have dug, but the City is under no obligation
to rsgrade, resurface or ratop any of such strast or streets.

SECTION 2. The necessity for providing adequate water and
gas facilities for the new subdivisions and additions to the City creates
a public emergency and public imperative necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date it is introduced and that such ordinance
or resolution shall be read at ti-s. several meetings of the City Council,
and the Mayor having declared that such public emergency and imperative
necessity exist, and 'having requested that such Charter rule be sus-
pended, and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINZD.

Gentlemen:
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that no
ordinance or resolution shall be passed finally on the date it is
introduced, and that such ordinance or resolution shall be read at
three meetings of the City Council; 1, therefore, hereby request that
you suspend said Charter rule or requirement and pass this ordinance
finally on the date it is introduced, or at the present meeting of
the City Council.
