HomeMy WebLinkAbout02272 ORD - 05/11/1948L,/ API ORDINANCE .2 ;2 72 AUTHORIZING AND DIRECTING THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE A CONTRACT FOR AND ON HF,EALF OF THE CITY OF CORPUS CHRISTI, TEXAS, KITH ASSOCIATED AVIATION UNDERWRITERS FOR RENTING OF SPACE FOR THE USE OF AN INSURAPICE P34DING MACHINE AT CLIFF D US AIRPORT, AND DECLARING Ali M ERGENCY. RE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF CORPUS UHRISTI, TEXAS: SECTION 1. That the City. Manager of the City of Corpus Christi, Texas, be and he is hereby authorized and directed to execute a contract for and on behalf of said City with Associated aviation Under- writers for renting of space for the use of an insurance vending nachine at Cliff Maus Airport, a copy of which contract is attached hereto and made a part hereof and reads as follows, to -wit: A G R E E M E N T In consideration of the payment of $10.00 per installed Airline Trip Insurance dispensing machine per month plus actual charges for current cons.uned, it is mutually understood and agreed between ASSOCIATED AVIATION UNDERWRITERS, having its principal place of business at 90 John Street, New York 7, New York, and the City of Corpus Christi, Texas, (an individual, a partnership, a corporation, a municipality ) hereinafter referred to as the Airport Operator that; 1. ASSOCIATED AVIATION UNDEMYRITERS is exclusively authorized to install, operate, service and maintain either themselves or through any designated agent acting for them such Airline Trip Insurance dispensing machines at locations on the premises which are mutually agreeable. 2. The manufacturer will enter into necessary agreements to hold the above described individual, partnership, corporation, municipality, harmless in connection with said installation, operation, service and maintenance of Airline Trip Insurance dispensing machines. 3. The Airport operator will perform normal custodial duties including-- (a) Dusting on and around each machine and removing any trash deposited thereon. (b) Taking reasonable precautions to prevent such machines from being tampered with, damaged, destroyed or marred. 4. Payments hereunder will be made on the first day of each month during the life of this agreement. The necessity for providing proper facilities for the convenience of the citizens using Cliff Maus Airport creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced end that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that auch public emergency and imperative necessity exist, and having requested that auch Charter rule be suspended, and that this ordinarce be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
