on behalf of said oity an agreement with E. B. Cole, acting through

lines in Cole Place Addition to the City of Corpus Christi, a copy
of which agreement is attached hereto and made a part hereof for all
intents and purposes and reads as follows, to-wit,

Place Addition to the City of Corpus Christi, Tau, and is desirous
of supplying water and gas to the said tdditioni

the _ day of April. A. D. 19480 by and between the City of Corpus
Christi, Texas, a snSioipal corporation, acting by and through its
duly authorised agents, hereinefter called ^City`, ands. B. Cole,

hereinafter termed 'Developer ",

1.
The City agrees for and in consideration of the Developer
furnishing 144 fast of 4" out iron pipe and in consideration of the

eight C--t. 02.129.38) cash in hand paid by the Developer, the re-
ceipt of which is hereby acknowledged and confessed, to furnish the
necessary water lines to serve Cola Place Addition to the City of
Corpus Christi in Conformity with the water line layout of said addi-
tion prepared b;r Harry L. Hoag, Engineer, and on file in the office
of the Director of Public corks of the City of Corpus Christi, reference
to which water line layout plan is hereby made for all intents and
Purposes, said installation of said water line to be at the expense
of said City except the out iron pipe above mentioned which is to be
provided by the Developer.

The City agrees to coastruut and 1—tall at its con expense
the necessary gas lines to Morro said Cole Place Addition. as determined
by the Department of public Utilities of said City.
3.
It is farther agreed and understood that upon osmpletim of
this work all water and gas lima placed in said &dditica errs to be-
come the property of the said City. And it is understood and agreed
that the developer convoys by the e=oution of this instrmeat all
right, title, interest and claim he car have in and to wW and all water
and gas lima installed in asoordanoe with this sgrearat, to the City.

It is understood and agreed that the City will begin work on
installing said water and gee lines as soon ere reasonably possible, and
will prosecute the work diligently to conclusion, in accordance with the
terns hereof, but it is understood that said work I. to be completed
within one year from the data of tug instrument. It is further under-
stood and agreed that the parties hereto will cooperate with each other
and that ,.svaloper will hold up ohostruation of the paving of the streat.
In said addition until the said water and gas lines have been laidm pro-
vided, however, that should any street be already laid, and it is
neosaaary. in the course of complying with this contract, that the City
dig up any part of said street or streets, the City shall fill up such
holes or ditcoas as it my have dug, but the City is under no obligation
to regrade, resurface Or'rstop SAY of such street or street&.

SECTION 2. The necessity for providing adequate water and
gas facilities for the new subdivisions and additions to the City creates
a public emergency and public imperative necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date it is introduced and that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such public emergency and imperative
necessity exist, and having requested that such Charter rule be sus-
pended, and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED.

finally on the date it is introduced, or at the present meeting of
