TANG SEMOE COMPANY FOR WORK AND REPAIRS TO BE DONE CH WATER TANKS AND TOMM OWNED BY THE CITY, AND DECLARING AN mm Cy. BE IT ORDAINED BY TER CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That the City Tanager of the City of Corpus Christi$ Texas, is hereby authorized and directed to execute a Contract for and on behalf of the City with Water Tank Service Gcmpany for work and repairs to be done on water tanks and towers owned by the City, a copy of said Contract being attached hereto and made a part hereof for all pertinent purposes. a3� a WATER TARS SRMGE COMPARY 8850 Swaribms& Street Roueton b, Texas 00RTRA0T This contract is to *over work to be done on the 250,000 gallon elevated Water tank and tower located at Corpus Christi, Texas, and the 800,000 gallon elevated water tank and tower located at Corpus Christi. Texas: These two tanks and towers are owned by the City of Corpus Cbristl, Corpus Obristi. Texas, THIS AGREEMM MADE AND ENTERED INTO THIS THE 23rd Day of July, 1938, by and between WATER TM SERVICE MUM, Houston, Texas, Party of the First Part. and THE CITY OF OORP'QS CIPRISTI, Corpus Christi, Texas, Party of the Second Part: TITHESSM That for and in consideration of the sum of Q 9,084.00, NIBS THOUSAND EICRTY -SEM and no%100 - Dollars, for cleaning. painting and repairing, to be paid to the Party of the First Part by said Second Party, Party of the First Part hereby agrees to do and perform the following described work at its own risk and without liability whatsoever to said Second Party for any accident, injuries or damages to employees of the First :arty: And First Party agrees to save and keep harmless the Second 1•arty from any damages which might arise to the public by virtue of the work done under this oontracty and First Party further agrees and it is un- derstood that the First Party shall furnish all steel, bolts, rode, ate., required for the job herein contracted, and said First Party shall furnish all labor, tools and equipment necessary for the performance of this contract. REPAIRS: (280.000 gallon tank and tower) 1. To remove roof of tank and to install nou roof of 3/18° steel. All seams in new roof to be welded. Roof to have 7° aver -hang. 20 To replace entire balcony floor With new steel plate to con- form with existing oonstruction. 3. To replace all bolts that are needed in tank and tower. 4. To remove bands around riser -pipe and clean all rust out. Repair any holes that are found under these bands and remount bands and brace -rode as they originally were. S. To brush paint the inside of the tank one (1) coat of Bituminous Base Interior Tank (coating that will not impart taste to water; Paint to be epproVed by the City before application. Roof and above water line to be painted with red -lead. 10. To thoroughly clean the outside of the roof, the tank and the tower of all scale, rust and loose paint. This Includes every. thing from the foundation up. PAI&TIRet (880,000 Rallan tank and tower) 1. To apply a complete coat of primer to the roof, the outside of the tank and the tower including everything from the foundation up. 2. To apply a complete coat of Aluminum paint to the roof, the tank and the tower including everything from the foundation up. 3. Party of the Pirst Part to furnish Interior paint. 4. Party of the second Part to furnish outside primer and paint. If, in the opinion of Second Partyfa Engineer, it in not advisable to drain the tank, at the time of the outside work for the Inside work, Party of the First Part hereby agrees to return at a later data when this tank Gan be drained for the work and do thin work. In such ease Party of the Second Part will retain the amount of 0 400.00 from the contract price until such time as the work is completed. When this inside work is completed in accordance with this contract, Party of the Second Fart hereby egross to Pay said Party of the First Part the sum of $ 400.00 for the work. To replace as necessary 2° % S° angle -iron in hand -rail of balcony. S. To replace brackets for ladder on hand -rail. 7. To replace all bolts that are needed on tank and tower. 8. To replace or repair defeotive swag -rods. 9. To replace defeotive ahannai- irons, top channel of Cross- beams, in top and bottom section of tower. 10. To repair any defeotive gusset - plates on the legs of tower. Weld as required for proper repair. 11. To thoroughly Olson the inside of the tank of all scale and rust by mechanical method. 19. To brush paint the inside of the tank one (1) ooat of Bituminous Base Interior Tank Coating that will not impart taste to water, Paint to be approved by Second Party before application. In Gush case Party of the Second Part will retain the amount of 8 840.00 from the contract pries until such time as the work to completed. OTHER CONDITIONS: Party of the First Part to furnish completion Bond and Certificate of Insurance. Completion Bond to be Beef with contract. Certificate Of Insurance to be cent direct to Party of the Second Part by Party of the First Part's Carrier. Thin agreement shall inure to the benefit of and be binding upon the legal representatives, hairs successors and assigns of the Parties hereto, respectively. The fact that certain water teaks and towers owned by the City are badly in need of painting and repairs at this time, and the fact that same is essential to provide proper water facilities to the citizens of this City creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution aball be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be sus- pended, and that this ordinanoe be passed finally on the date of its introduction and take affect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
