The purchase price is Fifty Nine Thousand Four Hundred and no /100 ($59,400.00) Dollars, which the Purchaser agrees to pay seller, as follows: Fifty bias Thousand Four Hundred and no /lO0 _(_$39_400.00) Dollars cash to be paid when deed to said land is executed and delivered to Purchaser. 3. seller agrees to furnish Purchaser a policy of title insurance to be issued by the Guaranty Title and Trust Company of Corpus Christi, Texas, in the usual and customary form, which policy shall be issued immediately upon the closing of this deal, and filing of Purchaser's deed for record. Pending eloein;^ of deal, the opinion of the examining attorneys for the Guaranty Title and Trust Company showing title to said property good in the :Seller, and the Company's agreement to issue said policy upon closing of deal and filing of deed, shall be deemed ­sufficient for closing, and aeal shall be closed thereon, and policy thereafter issued in accordance herewith. The opinion of the examining attorneys for Guaranty Title and Trust t;ompany on said title shall be deemed conclusive as to the status therco£. 4. In case my objections to title are raised in said opinion, then the seller shall have a re.asorable time in which to cure said objections and show ,good title, anu se.cu a the final a, proval of said title by amid Guaranty Title and Trust Company's attorneys. In the event of failure to cure such defects, then this contract shall be considered null and void ar.a of no force and effect. 5. Seller agrees upon approval of said title insurance by said Guaranty Title and Trust Company's attorneys, and agreement to issue title policy as above set out, to deliver a rood and sufficient general warranty deed drawn in accordance with the provision of this contract, properly conveying said property to said Purchaser, and Purchaser agrees thereupon to make the cash payment herein provided for. 1. -7— 6. The purchase price for the land above described in Section 1, and the costs incideab to the purchase of same are to'be paid from Street Improvement Bonds 1948 Construction Fund. SECTION 3• The necessity for providing sufficient Hight -of- Way for U. S. Highway No. 181 within the corporate limits of the City of Corpus Christi in order to provide batten traffic facilities for the oitizens of the City creates a public emergenoy and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meet- ings of the City Council, and the Mayor having deolared that suoh public emergency and imperative necessity wrist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO CHDAnTED.
