HomeMy WebLinkAbout02370 ORD - 08/31/1948t• AN ORDINANCE � ' a?,776 AIMING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, AND APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, AND AS AMENDED FROM TILE ^10 TIM THEMEeFTER, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 21��26.6 PASSED AND APPROVED BY -BE CITY COUNCIL ON THE 4TH DAY OF MAY, 19158, AND APPEARING IN VOLUAM 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, BY AMENDING ARTICLE IX. SECTION 2, PARAGRAPH 5. - -LOT AREA-; ARTICLE %III, SECTION l., BY ADDING THERETO ADDITIONAL PERMITPID AREAS; AND ARTICLE %VIII, BY ADDING TO SAID ARTICLE BVIII, A SECTION TO BE DESIGNATM AS SECTION 6.; AMENDING TBE ZONING MAP ADOPTED BY THE CITY COUNCIL ON MAY 4, 1948, AS HEREIN SET OUT; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT ESRMPITH ARE HEREBY REPEALED; AND DECLARING AN MBMGENCY. WHEREAS, the Zoning and Planning Commission of the City of Corpus Christi has recommended to the City Council Of said City that it is advisable to make the hereinai`tar sat out ohcnges in the present Zoning Ordineaoo and the Zoning Map of the City of Corpus Christi; and, NHEREAS, the City Council at its regular meeting hold on July 27, 1948, ordered a Poblio Nearing to be held on the 17th day of August, 1918, t 4t00 .,.look P. M.; end, TEER& E, proper notice of said hearing was published three times in the offioial newspaper of the City of Corpus Christi in ,the manner pro- vided by law; and, WHEREAS, the City Council did on the said 17th day of August, 1948, hold such hearing, where all interested citizens, property owners, and other parties had the opportunity to be heard on the proposed amendments to the Zoning Ordinance and Map of the City of Corpus Christi, and at such hearing all parties interested and wishing to be heard were heard. NOW. THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TESAS; SECTION 1. That the Zoning Ordinance cad Map of the City of Corpus Christi passed on the 27th day of August, 1937, appearing in volume 9 at Pages 565 at seq of the Ordinance and Resolution Records of the City of Corpus Christi, and as emended from time to time, and in particular as amended by Ordinanoe No. 2266 passed and approved by the City Council of said City on the 1;.th day of May, 191x0, and appearing in volume 16, Pages 339 et seq of the Ordinanoa and Resolution Records of said City, be amended as follows; �v A CHANGES IN ORDINANCE 1. That Articlo I%, Section 2, Paragraph 5. - "lot Area" � be and the same is hereby amended by changing the last sentence thereof so that the same shall hereafter read as follows: "For Apartment Hotels, there shall be a minimum lot area per dwelling unlit Of five hundred (500) square feet, provided the minimum lot area of six thousand (6,000) square feet is maintained, provided that the minimum Of five hundred (500) square feet of lot area per dwelling unit shall not be required in any lots front- ing on Shoreline Boulevard. P. That Article %III, Section 1 of said Ordinance No. 2266 passed my 41 . 1948, be amended by adding to the US68 permitted thereunder the following uses: Art Shop Auditorium Bowling Allays Dance Nall & Dance Studio Luseum Natatorium Skating Rink provided that said uses be permitted only in on entirely enclosed building. 3- That Article ZPI1I of said Ordinance No. 2266 be amended by adding at the end thereof a section to be designated as SECTION 6., and reading as follows. "SECTION 6. In IB -11 Neighborhood Business Districts and tB -31 Secondary Business Districts the front and/or side yard area required under this ordinance, not exceeding 20 feet in depth, may be dedicated to the public as part of the street or streets adjoining the property involved, and the building line of such property along and adjoining said street or streets may be located at the property line." That that area described as Lots 1 to 13 inclusive, Block 2, of the proposed Naylor Subdivision, according to plat filed in the office of the Planning Engineer of the City of Corpus Christi on July 13, 1948, and approved by the Zoning and Planning Commission of the City of Corpus Christi, and more particularly described as follows: ze Being an irregular tract of land out of the Snodgrass 30 acre tract, situated in the City of Corpus Christi, Texas, more particularly described by mates and bounds as follows: Beginning at the southeast corner of the Blue- bonnet Addition to the City of Corpus Christi, Texas, as shown by map of record in the office of the County Clerk of Nueoes County, Texas; Thence 3 12059' 08" lY with the east boundary line of the Snodgrass 30 acre tra5, a distance of 325.32 feet to a point; Thence N 87 46, 13" W, a distance of 203.11 feet to a point for g corner and beginning of this desoription; Thence N 37 46' 13" W, a distance of 786.22 feet to a point, the beginning of a a"rva to the righ having s radius of 30 feet and a central —gls of 86 05. 13 ", Thence along said curve to the right a distance of 45-07 feet to a point; Thence 11 1041' iTi, a distance of 154.98 feet to a point for the northwest corner of this description; Thence S 86007' E, .a distance of 876.05 Peet to a point for the northeast corner of this des - oriptionj Thence S 12059' 08" W, a distance of 72.69 feet to a point, the beginning of a curve to the right, having a radius of 30 feet and a central angle of 790 14' 39 "; Thence along said curve to the right, a dis- tance of 41.49 feet to the place of beginning, be changed from "R -1" Single Family Use to "A -2" Second Apartment House District Zee. 2. That the area described as follows: Being an irregular tract of land out of the Snodgrass 30 acre tract situated in the City of Corpus Christi, Texas, more particularly described by metes and bounds as followse Begi=,ing at the southeast corner of the Blue- bonnet Addition to the City of Corpus Christi, Texas, as shown by Map of record in the Office of the County Clerk of Nusces County, Texas; Thence S 12059' 08" ;7 with the east boundary line of the Snodgrass 30 acre tract, a distance or 386.40 feet to a point for the northeast oorner and beginning of this description, Thence continuing s 12 59' 08" W with the east bound- ary line of said Snodgrass 30 acre tract, a distance Of 151.56 feet to a point for the southeast corner of this description; Thence S 870 55, 39" W, a distance of 1137.82 Feet to a point for the southwest corner of this description; Thence N 10 41t W. a distance of 221.29 feet to a point for the northwest corner of this description; Thence 3 870 46, 13" E, a distance of 1178.92 feet to the place of beginning, containing 5.08 acres of land. be zoned so that the entire said tract above described shall be zoned for Heavy Industrial U... 3. That lots 59 to 64, both inclusive, in Block 617 of the Fort Aransas Cliffs Addition to the City of Corpus Christi, Texas, as shown by Yap of record in Volume A, Page 27 of the Plop Records of Nueoes County, Texas, be changed from "H-2" Two Family Dwelling Use to "B -1" Neighborhood Business Use. =TICK 2. That the official Zoning `Sap of the City of Corpus Christi is hereby amended as herein ordained. SECTION 3. That this Ordinance be published one time in the official newspaper of the City of Corpus Christi, and shall become effective immediately upon such publication. SECTION 4. That all Ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That the said Zoning Ordinance and Map of the City of Corpus Christi, approved on the 14th day of MV, 1948, except as herein .hanged, shall remain in full force and effect. SECTION 6. The fact that it is of the greatest public importance to put in force immediately the changes in the Zoning Ordinance end Map as hereinabove provided, for the purpose of providing for the orderly and progressive growth of the City, and the necessary protection of the lives, health, property and welfare of the citizens creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution be passed finally on the date it is introduced and that such ordinenoa or resolution shall be read at three (3) several meetings of the City Council, and the Mayor, hawing declared that such public emergency and such imperative public necessity exist, re- quests that said Charter Rule be suspended, and that this Ordinance t&..e effect and be in full force and effect from and after its passage, and after its publication one time as is provided and required by the Charter of the City of Corpus Christi, AND IT IS SO ORDAIM. For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduoed, and that such ordinance or resolution shall be read at three meetings of the City Cornell; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is intro- duced, or at the present meeting of the City Counoil.
