Howard Stark Gabe Lozano, Sr. MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING February 26, 1975 4:40 P.M. City Manager Marvin Townsend Acting City Attorney Jim McKibben City Secretary Bill G. Read Mayor Pro Tem Acuff called the meeting to order in the Council Chamber of the City Hall, and stated the purpose of the Special Meeting was to hold public hearings on zoning applications and any other business as may properly come before the Council. It was noted that a quorem of the Council and required Charter officers were present to conduct a valid meeting.' City Manager Townsend presented Application #673-11, Clifford Jackson Funeral Home & Others, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on Lots 26, 27C and 27D, Block 3, Laughlin Addition, located on the north side of Houston Street, east of Kostoryz Road. Chief Planner Wenger explained that the foregoing application was con- sidered by the Planning Commission on July 26, 1973 at which time "B-1" zoning was denied but a special permit for construction of a garage on Lots 27C and 27D was approved; that since this action, the staff has, on numerous occasions, contacted the applicant in regard to obtaining a site plan, and the applicant did not submit such a site plan until after the application was submitted to the Council for this hearing. He explained that the application was set for a hearing by the Council as a result of a pending application before the Commission that was affected by the recent text amendment passed on December 1974 in which the Planning Commission has 45 days to submit a final recommendation to the City Council. He stated that the site plan had been discussed with the applicant and on several occasions, he had been advised that these two lots would necessitate replatting in order to eliminate two primary uses on one individual lot. He stated that it was the staff's opinion that what was submitted by the applicant did not constitute a site plan. No one appeared in opposition to the foregoing application. Motion by Lozano, seconded by Branch and passed, that the hearing be closed. Motion by Stark, seconded by Ricardo Gonzalez, with Branch voting "Nay" (Thomas Gonzales absent), that the foregoing Application #673-11, Clifford Jackson Funeral Home et al, be denied. Special Council Meeting February 26, 1975 Page 2 City Manager Townsend presented Application #773-8, Elias Martinez, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on Lots 2, Block 3, Southwest Heights Addition, located on the west side of the 2500 Block of David Street north of Francis Street. The application was heard by the Planning Commission July 24, 1973 and forwarded to the Council with the recommendation that it be denied but in lieu thereof a special permit be granted for a florist shop subject to approval of a site plan to include off-street parking at the rear of the structure. It was the Planning Staff's opinion that if the request is granted, it will have a "domino" effect on other requests along this street, parti- cularly because of the favorable reaction of the neighbors, the lot is surrounded by single-family homes, it would constitute spot zoning, and therefore, recommended denial. Mr. Elias Martinez, applicant, explained that he had operated the flower shop for four years at this location; that he deals strictly with artificial flowers and there has been no refrigeration connected with the business. He stated there is adequate parking space as shown on the site plan which he has submitted; that the advertising is all done by telephone, no employees other than his own family, and if they ever decided to expand the business, they would seek another location properly zoned. Mr. Wenger explained that the site plan had not been acted upon by the Planning Commission but that it does meet all the requirements to comply with the ordinance. Relative to the off-street parking, City Manager Townsend commented that the City, in trying to protect the regulations and intent of the zoning ordinance, may be defeating its own goals by requiring persons with small businesses in their homes to meet such requirements as off-street parking. He explained that the main purpose should be to maintain the residential character of the neighborhood, but requiring a person to pave over his yard would tend to prevent the site from ever going back to a strictly residential use. He stated that perhaps home business requirements should be tied down in the ordinance rather than scaring residential neighborhoods. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Branch, seconded by Lozano and passed, that the hearing be closed. ni..utes Special Council Meeting February 26, 1975 Page 3 Motion by Branch, seconded by Lozano and passed (Thomas Gonzales and Ricardo Gonzalez absent), that the foregoing application be tabled for a more thorough study of home -occupancy businesses. City Manager Townsend presented Application #1173-1, Don R. Young, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on Lots 22 and 23, Block 1, Alameda Park, located on the northeast corner of Robert Drive and Gertie Street. The request was heard by the Planning Commis- sion November 13,1973 and forwarded to the Council with the recommendation that it be denied but in lieu thereof a special permit be approved subject to a site plan. The Planning Staff's opinion that the request be denied on the basis that it would be an intrusion into a residential zoned and used area and would have a detrimental effect on the neighborhood. Mr. Don R. Young, applicant, stated that there had been no complaints from the neighbors of this operation and he would like to continue using the garage on the northeast corner of the two lots for storage of supplies that he uses in connection with his plumbing business. Mr. Young presented a site plan of the property. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Branch, seconded by Lozano and passed, that the hearing be closed. Motion by Branch, seconded by Ricardo Gonzalez and passed, that Appli- cation #1173-1, Don R. Young for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on Lots 22 and 23, Block 1, Alameda Park, be denied, but in lieu thereof a special permit be approved according to an approved site plan and an ordinance be brought forward effectuating the change. There being no further business to come before the Council, motion by Branch, seconded by Lozano and passed, that the Special Meeting be adjourned at 5:10 p.m., February 26, 1975.
