BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF CCRPi7S CHRISTI,

SECTION 1. That the City MaBager is hereby authorized and directed
to eaeoute a oontraot for and on behalf of the City with Brook & Anderson,
Architeots, for professional servioes to be rendered in connection zrith re-
modeling the present City Hall building, a oopy of said contraot being
attached hereto and made a part hereof for all pertinent purposes.

OWNER & ARGHITECT AGREXEM
City of Corpus Christi Texas hereinafter
called the Owner, and BROOZ & ANDERSON, hereinafter called The Architeot,
hereby agree as followss
WhIMEAB, the Owner intends to construct Re -model the present City
Hell Building
and whereas the Owner has employed the Architect to render professional
services in connection with said proposed work:
Now, TBERUORE, in consideration of the payment of the fees herein-
after provided to be paid by the Owner, the Architect agrees to furnish
and perform the following professional services in Connection with said
proposed building, for the general, structural and mechanical work, vizi
1. PRELIMMWY WORK. Prepare preliminary sketches and secure for the
Owner Preliminary estimates. No such estimates can be regarded as
other than approximations, and the Architect assumes no responsibil-
ity for their accuracy.
2. COBTRACT DRAW=. Zrepare general working drawings, specifications
and proposal forms.
3. JETTING COBTRACTS. Draft advertisements, if necessary; receive and
tabulate bids, advise as to letting contracts, draft forms of con-
tracts.
4. DETAILS A10 ,SHOP DRAWINGS. Prepare necessary full size details and
check shop drawings.

5• SUPyRVISION. Superri3e tile work generally, issue certificates of
payment to contractors; make final inspection for acceptance of the
work. The .Xchiteat: will endeavor. to guard the Owner against de-
fects and deficiencies of the work of contractors. but he does not
,guarantee the performance of their contracts.
ARMTEMIS M. The Owner agrees to pay the architect for the above
named services a sum equal to ten percent (10%) of the total cost of said
building, in connection with which such services have been performed in
eluding cost of all mechanical equipment and all fixtures, whether fixed ar
movable, made ftti= the-Architect-'s drawings, or purchased under the Architect's
supervision; provided that the Architect's fee shall not be included in Com-
puting the cost of said building.
PABINTS, whether the work be entirely executed or whether its
execution be suspended or abandoned in part or in whole, payment to the
Architect on his fee are to be made as follows, for service rendered in
execution or up to the time of such suspension or abandonment,
A sum equal to 20; of the basic rate computed upon a reasonable
estimated cost, upon completion of the Preliminary work.
Upon completion of Contract Drawings and Specifications, a
sum sufficient to increase payments on the fee to 75
computed upon a reasonable estimated cost, or if bids have
been received, upon the lowest bona fide bid or bids.
As the work progresses, payments shall be made in proportion to
the amount of service rendered, computed upon the final cost
of the work.
SURVEYS, BORINGS, & T WS. The Owner agrees to furnish, at his
own expense, complete and accurate surveys, borings, and tests as re-
quired by Architect.
DRAWINGS. The drawings and specifications to be prepared and fur-
nished by the Architect pursuant to this agreement shall be the property
of the Architect, copies thereof shall be furnished the Owner, but for
the purpose of this building only,
SITUS. The situs of this contract shall always be Nueces County,
Texas.,

MOTION 2. The amount due under said contract is to be paid
out of City Ball Improvemsnt Construction Funa.
SECTION 3. The necessity for malrin adequate repairs which are
badly needed at this time to the City Bell creates a public emergency and
public imperative necessity requiring the suspension of the Charter rule
that no ordinance or resolution shell be passed finally on the date it is
introduced and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that
such public emergency and imperative necessity exist, and having requested
that such Charter rule be suspended, and that this ordinance be passed
finally on the date of its introduction and take effect and be in full
force and effsot from and after its passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fare-
going ordinance, a public emergency end imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and that
such ordinance or resolution shall be read at three meetings of the City
Council; I, therefore, hereby request that you suspend said Charter rule
or requirement and pass this ordinance finally on the date it is introduced,
or at the present meeting of the City Council.
