SPECIAL COUNCIL MEETING
April 2, 1975

Mayor Luby called the meeting to order in the Council Chamber of the
City Hall, and stated the purpose of the Special Meeting was to hold public
hearings on zoning applications and any other business as may properly come before
the Council. It was noted that a quorum of the Council and required Charter
Officers were present to conduct a valid meeting.
City Manager Townsend presented Application #C475-1, City of Corpus Christi,
for change of zoning from "B-4" General Business District to "B-5" Primary Business
District, on Lot B-1, South Staples Center, fronting along South Staples Street
between Everhart Road and Caddo Street. The request was heard by the Planning
Commission April 1, 1975 and forwarded to the Council with the recommendation that
"B-5" zoning be denied, but in lieu thereof a Special Council Permit be approved for
a resistor'assembly facility in that portion of the building where the use is proposed,
according to a site plan. He reported that two letters had been received in opposi-
tion to the application and one in favor, the opposition being primarily on the
basis that the present zoning is desired. He presented a site plan and stated it
is the staff's opinion that this site is a logical site for the proposed structure
and will be an improvement to the existing unkempt condition of the premises.
Mr. Brodie Allen, Director of Industrial Development, described the proposed
operation stating there would be no change in the exterior of the Old Shopper's World
building; no outside storage but some changes in the parking area; and the firm
will employ 200 to 300 persons for three to five years. He stated the Fire Chief
had inspected and approved the building for fire hazards.
No one appeared in opposition to the recommendation of the Planning Com-
mission.
Motion by Acuff, seconded by Lozano and passed, that the hearing be closed.
Motion by Acuff, seconded by Ricardo Gonzalez and passed, that the recom-
mendation of the Planning Commission be concurred in and Application #C475-1, City
of Corpus Christi, for change of zoning from "B-4" General Business District to
"B-5" Primary Business District, on Lot B-1, South Staples Center, fronting along

South Staples Street between Everhart Road and Caddo Street, be denied but in lieu
thereof a Special Council Permit be approved for a resistor assembly facility in
that portion of the building where the use is proposed according to the site plan
presented to the Council, and an ordinance be brought forward effectuating the
change.
City Manager Townsend presented the proposed Text Amendment to Article 11,
"AB" Professional Office District as follows:
Amend Article 11, "AB" Professional Office District, Section 11-2 Use
Regulations, as follows:
1. Amend Item (7) by striking it in its entirety and in lieu thereof substituting
a new Item (7) to hereafter read as follows:

Business and professional offices and office buildings provided
the following conditions are met:
(a) No building may be constructed with, or altered to
produce a store front, show window, or display window;
(b) There shall be no display from windows or doors and
no storage of merchandise in the building or on the
premises; and
(c) There shall be no machinery or equipment, other than
machinery or equipment customarily found in professional
or business offices,used or stored in the building or on the
lot.
Amend Line 5 of Item (8) by striking the words "item (7) above"
and in lieu thereof adding the words "Item (13) of this section."
Amend Item (9) by striking the word "nurseries" and in lieu thereof
adding the words "care centers."
4. Amend the first sentence of Item (10) by striking the words
"provided that there shall be no exterior signs on the premises
except as provided in item (7) above" and placing a period after
the word "hotels. "
5. Amend Item (11) by striking it in its entirety and in lieu thereof substituting
a new Item (11) to hereafter read as follows:
(11) Beauty culturist and hair stylist shop, studio for an artist,
photographer, sculptor or musician including teaching of art,
music, dancing or other artistic instruction, provided the
following conditions are met:
(a) No building may be constructed or altered to
produce a store front, show window or display
window;
(b) There shall be no display from windows or doors;
(c) There shall be no storage of merchandise in the building
or on the premises, and no machinery or equipment other
than customarily accessory to permitted uses;

(d) No exterior signs shall be permitted except as provided
in Item (13) of this section; and
(e) There shall be no adverse effect created on adjacent or
neighborhood properties by reason of dust, odor, vibration,
glare or noise.
6. Amend Item (12) by striking it in its entirety and in lieu thereof
substituting a new Item (12) to hereafter read as follows:
(12) Unless expressly prohibited, one (1) sign identifying permitted
businesses, professional offices, or an office building for each
premise, provided the following conditions are met:
(a) The sign, if illuminated, shall be either internally
illuminated or back lighted;
(b) The sign shall not exceed twenty (20) square feet in
area;
(c) The sign must be attached either flat against the building
or the fence which it relates to;
(d) The sign, if attached flat against a building, shall not
project more than eighteen (18) inches from the wall and
shall not extend above the height of the building;
(e) The sign, if attached flat against a fence, shall not project
more than six (6) inches from the fence or extend above
the height of the fence and,further, no part of the sign or
fence shall project into or be located in a required yard
area; and
(f) When the sign is attached to a fence, the fence must meet
all structural and windload requirements set forth in the
City Building Code.
7. Amend Item (13) by striking it in its entirety and in lieu thereof substituting
a new Item (13) to hereafter read as follows:
(13) One (1) non -illuminated name plate identifying each office, use or
professional person occupying the building, provided the name plate
is attached flat against the wall of the building or fence and does, not
exceed one (1) square foot in arca and meets the requirements set
forth in Item (12) (e) and (f) of this section.
8. Add a new Item (14) to read as follows:
(14) Accessory buildings and uses customarily incidental to the
uses permitted in this district.
Chief Planner Wenger explained that the amendment is proposed to allow signs
pertaining to uses within this district to be placed not only flat against a building
but also flat against any fence located on the property according to specific standards;
also, the amendment places the existing sign requirements in one term, thereby
identifying more clearly the sign requirements pertaining to this district. He stated

the proposed amendment was heard by the Planning Commission April 1, 1975 and
forwarded to the Council with the recommendation that it be approved as written.
Motion by Branch, seconded by Acuff and passed, that the hearing be closed.
Motion by Branch, seconded by Stark and passed, that the foregoing proposed
Text Amendment to Article 11, "AB" Professional Office District, be approved as
written and presented by the City Manager and recommended by the Planning Commission,
and an ordinance be brought forward effectuating the amendments.
ORDINANCE NO. 12566
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF THE CITY OF CORPUS CHRISTI BY
GRANTING A SPECIAL COUNCIL PERMIT FORA RESISTOR ASSEMBLY PLANT, AS SHOWN ON THE SITE
PLAN, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A", AND MADE A PART HEREOF
ON PORTION OF LOT B-1, SOUTH STAPLES CENTER, AS MORE PARTICULARLY DESCRIBED HEREIN-
AFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT
ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the
following vote: Luby, Acuff, Branch, Tom Gonzales, Ricardo Gonzalez, Lozano and
Stark, present and voting "Aye".
ORDINANCE NO. 12567
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE
ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY
AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 11, "AB" PROFES-
SIONAL OFFICE DISTRICT REGULATIONS, BY AMENDING SECTION 11-2 USE REGULATIONS, BY
DELETING THE PRESENT ITEM (7) AND IN LIEU THEREOF ADDING A NEW ITEM (7) CONCERNING
BUSINESS AND PROFESSIONAL OFFICES AND OFFICE BUILDINGS; AMENDING THE LAST LINE OF
ITEM (8) BY STRIKING THE WORDS "ITEM (7) ABOVE" AND IN LIEU THEREOF ADDING THE
WORDS "ITEM (13) OF THIS SECTION"; AMENDING ITEM (9) BY DELETING REFERENCE TO "CHILD
NURSERIES" AND IN LIEU THEREOF ADDING THE WORDS "CHILD CARE CENTERS"; AMENDING THE
FIRST SENTENCE OF ITEM (10) BY STRIKING THE WORDS "PROVIDED THAT THERE SHALL BE NO
EXTERIOR SIGNS ON THE PREMISES EXCEPT AS PROVIDED IN ITEM (7) ABOVE"; AMENDING ITEMS

AND USES CUSTOMARILY INCIDENTAL TO THE USES PERMITTED IN THIS DISTRICT; KEEPING IN
EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.

There being no further business to come before the Council, the Special
meeting was adjourned at 4:10 p.m. April 2, 1975.
