Cause No. 39068-B, in the 117th District Court of llueoes County, Texas,
has ordered and decreed that the City Council submit to the electorate
of the City on April 5, 1949, a proposed amendment to the City Charter.

SUCTION 1. An election is hereby ordered to be held on the 5th
day of April, A. D. 1949, in the City of Corpus Christi, Texas, at which
election shall be submitted to the qualified voters of the City, the follow-
ing amendment to the City Charter of the City of Corpus Christi, Texas, as
set cut in the Official Ballot hereinafter prescribed.
SECTION 2. The Official Ballot for said election shall be as
hereinafter set out, and the proposition to be voted on at said election
is set out in such Official Ballot, said Official Ballot shall be as
follows:

From and after the effective date of this amendment there
is hereby established in the Fire Division of the City of Corpus
Christi, Texas, the following minimum salary rates for the respect-
. ive positions designated:

Provided further that the above enumerated job classifications
in the Fire Department of the City of Corpus Christi, Texas, shall re-
main permanent and fixed as herein designated, and under the title here-
in designated; provided that like or similar duties for each enumerated
classification as was required by this Charter, Ordinance, or rule or
regulation of the City of Corpus Christi, Texas, as of July let, 1918,
shall 'no regarded as the standard to determine each respective classifi-
cation under this act.
Provided that the above shall be deemed a minimum salary
scale and is not to be construed as in anywise placing any limitation
upon the City Council in increasing the compensation or making what-
ever other adjustments in connection with any of said positions as
they may deem expedient.
All provisions of the City Charter or Ordinances or parts
of Ordinances in conflict herewith arc 'hereby expressly repealed."

The presiding judges shall be authorized to select such clerks
or other assistants as provided by law, as may be deemed necessary and
said election shall be held in accordance with the provisions of law re-
lating to elections for the submission of amendments to munioipal charters
and tie general laws of the State of Texas shall be observed insofar as
they are applicable. The polls shall be open from 8;00 otclock A. Ni. until
7:00 o'clock P. M. on the date of the election.
SECTION Ly. A copy of this Ordinance signed by the Mayor of the
City of Corpus Christi, Texas, shall constitute the notice ordering said
election, and the Mayor is directed to cause a copy of this Ordinance,
signed by him, to be posted at the City Hall, and at each of the polling
places in each precinct not less than fifteen (15) days prior to said
election, and to have a copy of this Ordinance published in the Corpus
Christi Times, the official newspaper of the City of Corpus Christi,
Texas, it being a newspaper Of general circulation, published within the
City of Corpus Christi; said publication to be made on the same day in
each of two (2) successive weeks prior to the date of the election, and the
date of the first publication to be not less than fourteen (14) days prior
to the date of said election.
SSCTION 5. The fact that the laws of the State of Texas require
the submission of charter amendments within a certain period of time, and
the fact that there are certain requirements set up by the laws of the State
of Texas in regard to publication, and the further fact that the law requires
a copy of all such amendments to be mailed to the qualified voters of the
City, and the further fact that it is impossible to complete all of the re-
quirements of the law within the period allotted if this Ordinance is read
at three several meetings of the City Council, creates a public emergency
and an imperative public necessity requiring the suspension of the Cherter
rule or requirement that no ordinance or resolution shall be passed finally
on the date it is introduced, and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the 14ayor having
declared in writing that such public emergency and imperative necessity
exist, and having requested that such Chaxter rule be suspended, mid that
this Ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from wad after its passage, I'T IS

Gentlemen,
For the reasons set forth in too emergency clause of the fore-
going ordinance, a public emergency and imnerat ive necessity exist for the
suspension of the Charter role or requirement that no ordinance or resolu-
tion shall be passed finally on the date it is introduced, and that such
ordinance or resolution shall be read at throe meetings of the City Council;
I, therefore, hereby request that you suspend said Charter rule or require -
ment and pass this ordinance finally on the date it is introduced,
