BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI
WHEREBY THE CITY PROPOSES To FURNISH DRAINAGE,
CURBS AND GUTTERS ON PORT. AVENUE BEGINNING AT ITS
INTERSECTION WITH MORGAN, THENCE NORTH AND NORTH-
EASTERLY ON PORT AVENGE TO ITS INTERSECTION WITH
COMANCHE STREET; PROVIDED THE TEXAS HIGHWAY DEPART-
MENT WILL PAVE AND MAINTAIN SAID PORTION OF FORT
AVENUE AND REQUESTING THE TEXAS HIGHWAY DEPARTMENT
TO MAINTAIN, AS A BY -PASS ROUTE, PORT AVENUE
BEGINNING AT ITS INTERSECTION WITH AGNES STREET
(STATE HIGHWAY lilt) EXTENDING NORTH AND EAST TO
MESQUITE STREET; AUTHORIZING AND DIRECTING THE CITY
MANAGER TO DO ALL THINGS REQUISITE AND NECESSARY
TO CARRY OUT THE PURPOSE OF THIS RESOLUTION; AND
DECLARING AN EMERGENCY.
WHEREAS, negotiations have been carried on between the City and
certain officials of the State Highway Department; and,
WHEREAS, it is believed it will be to the mutual advantage of the
City and the State Highway Department that they enter into an agreement for
the purpose of paving and maintenance of Port Avenue within the limits herein
after set out, and maintenance of - _port.. Avesuec within the limits hereinafter
set out;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS;
SECTION 1. That the City proposes to furnish drainage, curbs and
gutters on Port Avenue between the intersection of Morgan Avenue and Port
Avenue, thence north and northeasterly along Port Avenue to the intersection of
Port Avenue and Comanche Street, provided the Texas Highway Department will pave
and maintain said street from its intersection with Morgan Avenue to its inter-
section with Comanche Street.
SECTION 2. That the State Highway Department be requested and
authorized to take over the maintenance, as a State Highway by -pass route,
that portion of - :-peri Avenue.' beginning at its intersection with Agnes Street
(State Highway 44) extending north and east along -Port Avenue -, to its inter-
section with Mesquite Street near the Bascule Bridge in the City of Corpus
Christi.
SECTION 3. That the City Manager is hereby authorized and directed
to do the things requisite and necessary to carry out the purpose of this
resolution.
SECTION 4. The necessity for improving Port Avenue within the
limits above defined, wbich avenue is an important thoroughfare in the .City
and the necessity for proper by -pass routes within the City creates a public
emergency and public imperative necessity requiring the suspension of the
Charter rule that no ordinance or resolution shall be passed finally on the
date it is introduced and that such ordinance or resolution shall be read at
three several meetings of the City Council, and the Mayor having declared that
such public emergency and imperative necessity exist, and having requested
that such Charter rule be suspended, and that this resolution be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED.

For the reasons set forth in the —gonoy ciause of the foregoing
resolution, a public emergency and imperative necessity exist for the sus-
pension of the Charter rule or requirement that no ordinance or resolution
shall be passed finally on the date it is introduced, and that such ordinance

fore, hereby recuest that you suspend said Charter rule or requir —ent and
Pass tLis resolution finally on t'ne date it is introduced, or at the present
meeting of tide City Ceuncil.
