HomeMy WebLinkAbout02495 ORD - 03/29/1949AN CRDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, AND APPEARING OF RECORD IN VOLUBLE 9, PAGES 565 ET SEQ OF THE ORDINANCE ARID RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, AND AS AMENDED FROM TIME TO TIME THK FTRR, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 2266, PASSED AND APPROVED BY THE CM COUNCIL CN THE 4TH DAY OF MAY, 19LO, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI BY AMENDING ARTICLE VIII, SECTION 3. ITEM 5 OF SAID ORDINANCE N0. 2266; AND AMENDING THE ZONING MAP APPROVED BY THE CITY COUNCIL ON MAY 4. 1948, IN THE PARTICULARS HEREIN SET FORTH; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HERE- WITH ARE HEREBY REPEALED; AND DECLARING AN EMERGENCY. WhEREAB, the Zoning and Planning Commission of the City of Corpus Christi has recommended to the City Council of said City that it is advisable to make the hereinafter set out changes in the present Zoning Ordinance and the Zoning Map of the City of Corpus Christi; and, TMERW, the City Council at its regular meeting held on March 8, 1949, ordered a Public Hearing to be held on the 29th day of March, 1949, at 4:00 o +Clock P. M., and, WHEREAS, proper notice of said hearing was published in the manner provided by law; and, WHEREAS, the City Council did on the 29th day of March, 1949, hold such hearing, where all interested citizens, property owners, and other parties had the opportunity to be heard on the proposed amendments, and at such hearing all parties interested and wishing to be heard were heard; NOPf, THEREFORE. BE IT ORDAINED BY THE CITY CO(JNCIL OF THE CITY OF CORPUS CHRISTI, TEP. , SECTION 1. That the Zoning Ordinance and Map of the City of Corpus Christi passed on the 27th day of August, 1937, appearing in'llp Volume 9, st Pages 565 at seq of the Ordinance and Resolution Records of the City of Corpus Christi, and as amended from time to time, and in par - tioular as amended by Ordinance No. 2266 passed and approved by the City Council of said City on the Loth day of May, 19118, end appearing in Volume 16, Pages 339 at seq of the Ordinance and Resolution Records of said City be amended as follows: I. That Article VIII, Section 3, Item 5 of said Ordinanoe No. 2266 is hereby amended so that same shall hereafter read as follows, to -wit: "Lot Area- The minima lot area shall be six thousand (6,000) square feet. For multiple family uses the mini— lot area shall not be less than sixteen hundred (1,600) square feet per unit. For Apartment Hotels the minimum lot area shall be not less than 750 square foot per unit." 2. That Section 5 of Article XX of said Ordinance No. 2266 Is hereby amended and same shall hereafter read as follows, to -wit: "ARTICLE X%. SPECIAL COUNCIL PEBMITS. SECTION 5. Tourist Courts and Trailer Camps. Tourist Courts may be permitted in the iB -3', and 'B -4' Business Districts and Trailer Camps may be permitted in the "A -4" Tourist Court District, and in any Business District north of the Basoule Bridge onl under the some restrictions as provided in the "A -P' Tourist Court District. The Zoning and Planning Commission may recommend and the City Council may, after a public hearing, prescribe special requirements as part of the permit for these special uses." SECTION 2. That the said Zoning Map approved by the City Council on May 4, 1948, be end the same is hereby amended in the following respects: I. That Lots 1 and 2 of A. p. Cobb Subdivision in the City of Corpus Christi, Texas, be and the same are hereby rezoned from "R -1" One Family Dwelling District Use to "A -1" First Apartment House District Use. 2. That all of that portion of Section VIII of Paisley Subdivision of the Hoffman Tract in the City of Corpus Christi, Texas, be end the sae is hereby rezoned from "R -1" One Family Dwelling District Use to "A -1" First Apartment House District Use. 3. That the West 4-7 acres off the South 10 acres of Lot 1, Section G of the Paisley Subdivision of the Hoffman Tract in the City of Corpus Christi, Texas, be and the same are hereby rezoned from "R -1" One Family Dwelling District use to "A -1" First Apart- ment House District Use. 4. That all of Lots 1, 2, 3. 4. 5 6, 7 and 8, in Block 608; Lots 1, 2, 3 61, 62, 63 and 64, in Block 708, Lots 63 and b4 in Block 608; and all of Block 609 located in the Aransas Cliffs Sub- division in the City of Corpus Christi, Texas, be and the sans are hereby rezoned from "R -1" One Family Dwelling District Use to "R -2" Two Family Dwelling District Use. 5. That the West 150 feet of Lot 11, Hillorest Addi- tion (Cue -Acre Tracts) in the City of Corpus Christi, Texas, be and the same is hereby rezoned from "R-l" One Family Dwelling District Use to "E-1" Heavy Industrial District use. 6. That the portion now zoned for aR +ls use of the East one -half of Block 11405, Merchants Addition No. 6, in the City of Corpus Christi, Texas, be and the same is hereby rezoned from sR -1" One Family Dwelling District Use to aR -213, Two Family Dwelling District Vse. _ SECTION 3. That the official Zoning Map of the City of Corpus Christi be and the same is hereby amended as herein ordained. SECTION 4. That all ordinances or parts of ordinances in confliot herewith are hereby repealed. SECTION 5. That the said Zoning Ordinance and Map of the City of Corpus Christi, approved on the 14th day of May, 1948, as amended, except as herein changed shall remain in full force and effect. SECTION 6. The fact that it is of the greatest public importance to put in force immediately the changes in the Zoning ordinance and Map ee hereinabove provided, for the purpose of providing for the orderly and progressive growth of the City, and the necessary protection of the lives, health, property and welfare of the citizens creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three (3) several meetings of the City Council, and the Mayor, having declared that such public emergency and such imperative public necessity exist, re- quests that said Charter Rule be suspended, and that this Ordinance take effect and be in full force and effect from and after its passage and after its publication one time as is provided and required by the Charter of the City of Corpus Christi, AND IT IS SO ORDAINED.
