HomeMy WebLinkAbout02500 ORD - 04/05/1949AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST. 1937, AND APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI, AND AS AMENDED FROM TIME TO TIME THEREAFTER, AND IN PARTICULAR AS AMENDED BY ORDINANCE NO. 2266, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 4911 DAY OF MAY, 1948, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP APPROVED BY THE CITY COUNCIL ON MAY 4, 1948, IN THE PARTICULARS HEREIN SET FORTH; PROVIDING THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED; AND DE- CLARING AN EMERGENCY. WHEREAS, the Zoning and Planning Commission of the City of Corpus Christi has reacmmended to the City Council of said City that it is advisable to make the hereinafter set out changes in the present Zoning Ordinance and the Zoning Map of the City of Corpus Christi; and, WHEREAS, the City Council at its regular meeting held on March 15, 1949, ordered a Public Hearing to be held on the 5th day of April, 1949, at 4 :00 o'clock P. M.; and, WHEREAS, proper notice of said hearing was published in the manner provided by law; and, WHEREAS, the City Council did on the 5th day of April, 1949, hold such hearing, where all interested citizens, property owners, and other parties had the opportunity to be heard on the proposed amendments, and that'at such hearing all parties interested and wishing to be heard were heard; NOW, THEREFORE, BE IT ORDAINED BY TEE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance and Map of the City of Corpus Christi passed on the 27th day of August, 1937, appearing in Volume 9, at Pages 565 at seq of the Ordinance and Resolution Records of the City of Corpus Christi, and as amended from time to time, and in partioular as emended by Ordinanoe­.Xq. 2266 passed and approved by the City Council of said City on the 4th day of May, 1948, and appearing in Volume 16, Pages 339 at seq of the Ordinance and Resolution Records of said City be amended as follows: e A. That the said Zoning Map approved by the City Council on May Li, 1918, be and the same is hereby amended in the following respects: 1. That the following described tract of land located in the City of Corpus Christi, Tpxas, to-wit: Beginning at a point ° ' g g p 35 feet S. �LN - 59 - 24" W. from a 3/4 inchpipe in Norton Street marling the North Corner of the A. J. McCall, Trustee 63.6 acre tract, thence s. 444 - 59' 224L}} " Nt. 387 feet to a point, thence S. 890 - 58' - 36" E. 257.3 feet to a point, thence S. 45° - 0' - 36 ".E. 318 feet to a point, thence N. 1�LN° - 59' - W' E. 205 feet to a point, thence N. LW 0' - 36" E. 500 feet to the point of beginning, be and the same is hereby re- zoned from "R -1" One Family Dwelling District Use to "13-1" Neighborhood Business District Use. 2. Thence S. 570 - 30' - 36" E. 110 fast to a point, thence N. 360 - 30' - . 24" E. 150 feet to a point, thence N. 140 - 59' - y+" E. 300 feet to a point, thence N. 1150 - 0' - 36" W. 160 feet to a point thence S. 440 - 59' - vF" W- 205 feet to a point. Thence N. 1150 - 0' - 36" W. 318 feet to a point, thence N. 890 - 58' - 36" W. 257.3 feat to the point of beginning, said tract being shown as Lots 1 through 6 inclusive, in Block 18, Lots 1 through 28 inclusive, in Block 15, and Lots 1 through 24 inclusive, in Block 16 in I—dale No. L: Addition on a preliminary plat of Lawadale 3 and 4 on file in the office of the Zoning and Planning Commission of the City of Corpus Christi, be and the same is hereby rezoned from "R -1" One Family Dwelling District Use to "R -2" Two Family. Dwelling District IIse, SECTION 2. That the official Zoning Map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION LN. That the said Zoning Ordinance and Map of the City of Corpus Christi, approved on the loth day of May, 194x, as amended from time to time, except as herein changed shall remain in Hill force and effect. SECTION 5. The fact that it is of the greatest public importance to put in force immediately the changes in the Zoning Ordinance and Map as hersinabove provided, for the purpose of providing for the orderly and progressive growth of the City, and the necessary protection of the lives, health, property and welfare of the citizens creates a public emerpacy and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three (3) several meetings of the City Council, and the Mayor, having declared that such public emergency and such imperative public necessity exist, re- quests that said Charter Rule be suspended, and that this Ordinance take effect and be in full force and effect from and after its passage and after its publication one time as is provided and required by the Charter of the City of Corpus Christi.
