HomeMy WebLinkAbout02505 ORD - 04/07/1949AN ORDINANCE CANVASSING TAE RETURNS AND DECLARING TIM RESULTS OF AN ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON THE 5TH DAY ' OF APRIL, A. D. 1949, UPON THE r4UESTICN OF ADOPTING AN AMENDMENT TO THE CITY CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLARING AN EMERGENCY. WHEREAS, heretofore, on the lat day of March, A. D. 1949, the City Council of the City of Corpus Christi passed as ordinanoe calling an election to be held on the 5th day of April, 1949, on the proposition set out in the Official Ballot attached hereto and marked Exhibit "A ", and made a part hereof as though copied herein verbatim; and, WHEREAS, it appears that the requirements of the law as to mail- ing copies of the proposed amendment to the qualified voters, the giving of proper notice regarding the election, and all requirements of the law respecting the submission of amendments of a City Charter to the qualified voters were in all respects lawfully and properly performed and executed; and, WHEREAS, said election was duly and legally held on the 5th day of April, 1949, in conformity with the election ordinance heretofore passed by this Council end the result of said election has been duly certified and returned to this Council by the proper judges and clerks thereof; and, WHEREAS, this Council has canvassed the returne of said election on the propositions hereinabove stated; and, WHEREAS, .it appears to the Council that said election was in all respects lawfully held and said returns duly and legally made, and that the following votes were cast at said election, same being tabulated as follows: RETURNS ON THE EI.6Mow - Ann 5, 1949 xrrs ut PUCINCT us no TOTAL 2 35 11 46 3 26 21 47 23 14 38 6 22 21 7 34 16 66 8 21 27 5500 17 5 13 20 20 i9 5 27 21 23 17 40 31 54 6 33 33 24 9 33 38 52 37 91 39 40 31 18 69 86 41 42 93 29 35 123 43 121 74 24 163 100 57 5 46 8 1416 34 53 12 72 48 14 6 20 49 31 16 49 50 52 43 101 41 67 me 56 44 �5 73 64 1.14 58 59 10 58 70 60 22 55 77 44 14 5588 62 30 19 Total 1380 1103 2328 NOW, THEREFORE, BE IT ORDAINED BY TBE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TESAS: , SECTION 1. That the proposition to amend the said Charter of the City of Corpus Christi was sustained by a majority of the legally qualified voters voting in said election, and the City Council of the City of Corpus Christi is hereby authorised to adopt and place in full force and effect the amendment to the City Charter of the City of Corpus Christi, in accordance with the proposition so voted on at said election. SECTION 2. The public importance of said proposed Charter amendment creates a public emergency and public imperative necessity re- quiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
