AUTHORIZING AND DIRECTING THE CITY MANAGER TO
ESECUTE A CONTRACT ON BEHALF OF THE CITY OF
CORPUS CHRISTI WITH F. BERT SMITH & COMPANY;
PROVIDING THAT SAID F. BERT SMITH & COMPANY
SHALL ACT AS FISCAL AGENTS FOR THE CITY IN
THE MAKING OF AN INVESTIGATION, STUDY AND
REPORT, IN WRITING, IN REGARD TO THE CITY'S
PRESENT FINANCIAL POSITION AND THE CITY-S
ABILITY TO ISSUE BONDS AND TO FINANCE THE
COST OF SUCH IMPROVEMENTS, SUCH AS A CITY
COLISEUM, PUBLIC BUILDINGS OF VARIOUS KINDS,
STREETS, SEWERS AND OTHER PERTINENT UTILITIES,
AND TO REIMBURSE THE CITY FOR THE COST OF ORDI-
NANCES, RESOLUTIONS, NOTICES AND OTHER INSTRU-
MENTS IN CONNECTION WITH THE ELECTION PERTAIN-
ING TO BONDS, THE ISSUANCE OF BONDS AND THE
SALE OF BONDS; PROVIDING. COMPENSATION FOR THE
SAID F. BERT SMITH & COMPANY; PROVIDING FOR
NEGOTIATION FOR THE PURCHASE OF SAID BONDS;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,

SECTION 1. That the City Manager of the City of Corpus Christi
is hereby authorized and directed to execute a contract with F. Bert Smith
& Company, a copy of such contract is hereby attached and herein made a
part of this ordinanoe.

SECTION 2. The fact that the Legislature of Texas is now in
session and will not again be in session for nearly two years; that it
may be necessary to procure the passage of legislation to enable the
City to issue bonds for the financing of the improvements contemplated;
that the City is now in need of the public facilities contemplated and
the fact that the said F. Bert Smith & Company are specialists in the
handling of municipal bonds and the fact that their services are essen-
tial and will be greatly beneficial to the City of Corpus Christi creates
a public emergency and public imperative necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
an the date it is introduced and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared that such public emergenoy and imperative necessity exist, and
having requested that such Charter rule be suspended, and that this ordi-
nance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORD-
INGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of
the City Council, I, therefore, hereby request that you suspend said
Charter rule or requirement end pass this ordinance finally on the date
it is introduced, or at the present meeting of the City Council.
