HomeMy WebLinkAbout02523 ORD - 05/17/1949AN ORDINANCE CLOSING THhT PORTIG.�: OF KAKITOU STREET, BEING THE NORTH 10 FEET OF SAID MANITOU STREET, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TTTKAS, AND 01LDERING AND DIRECTING THE RETURN OF SUCH PROPERTY CLOSED FOR STREET PURPOSES TO THE ABUT- TING PROPERTY OWNERS, AND DECLARING AN EMERGENCY. —RE-4S, the City Council of the City of Corpus Christi has been petitioned that a portion of Manitou Street hereinafter des- cribed, he closed for street purposes; and, WHEREAS, notice of the proposed closing of said street has been given by publication and by mail to the last known address of all owners abutting said street and within 450 feet therefrom, in accordance with the Charter of the City of Corpus Christi as pro- vided for under, Article II, Section 6 thereof; and, ',^JTHEREaS, in accordance with the notice given as above set out, a public hearing was held by the City Council of the City of Corpus Christi at 4;00 otclock P.M. on the 10th day of 14ay, 1949 in the City Council Chamber at the City Hall; and, WHEREAS, the public welfare, convenience and necessity will be better served by the closing of such street: NO[d, THEREFORE, BE IT ORDAINSD BY THE CITY COUNCIL OF TEE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a portion of Manitou Street, described as follows, to-wit! Situated in the City of Corpus Christi, Nueces County, Texas, being a tract of land 50 feet by 10 feet and being the North 10 feet of said Manitou Street, as dedicated on the map of H.F. Nolte Subdivision, recorded in Vol. 6, at page 58,,of the Kap Records of Nueces Gounty, 'Texas, sp a !0 feet being as s mm by plet atbecned, be, and the same is hereby closed as a public street and from public use. SECTION 2. That the City of Corpus Christi hereby quitclaims and relinquishes all right, title and interest it may have in and to the said street described in Section 1 hereof, to the property owners abutting said street. �_5a3 SECTION 3. The fact that public convenience and necessity will be better served by the closing of said street creates a public emergency and a public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such Or- dinance or Resolution shall be read at three regular meetings of the City Council; and the Mayor, having declared that such Public emergency and imperative necessity exist, and having requested that such Charter rule be suspended; and that this Ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. BATE. f` Corpus Christi, Texas Alay ! a,_, 1949 TO THE 11EMBERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, there- fore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
