HomeMy WebLinkAbout02526 ORD - 05/17/1949AN ORDINANCE AAMMING THE ZONING ORDINANCE OF TEE CITY OF CORPUS CHRISTI ADOPTED ON TEE 27TH DAY OF AUGUST, 1937, AND APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF TEE CITY OF CORPUS CHRISTI, AND AS AkMORD FROM TD--, TO TIME THEREAFTER, AND IN PARTICULAR AS AIENDED BY ORDINANCE NO. 2266, PASSED AND APPROVED BY THE CITY COUNCIL ON TEE 4TH DAY OF MAY, 1948, AND APPEARING OF RECORD IN VOLUME 16, PAGES 339 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS OF THE CITY OF CORPUS CHRISTI BY AMMING TEE ZONING MAP APPROVED BY THE CITY COUNCIL ON MAY 4, 1948, BY REZONING BLOC% A, BALDlf= PARK ADDITION, AS SHOMT BY MP OR PLAT OF BALD= PARE ADDITION, ON FILE AND OF RECORD IN THE- MAP OR PLAT RECORDS OF NUECES COUNTY, AND BEING THAT AREA LYING .BETWEEN KEYS STREET ON THE SOUTH AND BALDVMT BOULE- VARD ON Ti1E NORTH, RIGGAN STREET ON THE EAST AND PRESCOTT STREET ON THE WEST, SO THAT SAID AREA SHALL BE REZONED, CHANGING TEE USE FROM "R -2^ TYPO FAMILY DIYELLING DISTRICT USE AS PRESENTLY ZONED TO "B -la NEIGHBORHOOD BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF TEE EXISTING ORDINANCES AS AMENDED; AND DECLARING AN E6MRGZNGY. - r7HEREP.S, the Zoning and Planning Commission of the City of Corpus Christi has recommended to the City Council of said City that it is advisable to make the hereinafter set out changes in the present Zoning Ordinance and the Zoning Nap of the City of Corpus Christi; and, 1WEREAS, the City Council at its regular meeting held on' April 19, 1949, ordered a Public Hearing to be held on the 10th day of May, 1949, at 4:00 o'clock P. M.; and, WHEREAS, proper notice of said hearing was published in the manner provided by law; and, VHERIAS, the City Council did on the 10th dkv of May, 1949, hold such hearing, where all interested citizens, property =ers, and other s parties had the opportunity to be heard on the proposed amendments, and that at such hearing all parties interested and wishing to be heard mere heard; NUff, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance and Map of the City of Corpus Christi passed on the 27th day of August, 1937• aPPearing in Volume 9. at Pages 565 at seg of the Ordinance and Resolution Records of the City of Corpus Christi, and as amended from time to time, and in particular as amended by Ordinance No. 2266 passed and approved by the City Council of a5"a� r said City on the 4th day of May, 1948, and appearing in Volume 16, Pages 339 at seq of the Ordinance and Resolution Records of said City be amended as follows: I That Block A, Baldwin Park Addition, as shown by map or plat of Baldwin Park Addition, on file and of record in the Map or Plat Records of Nueces County, Texas, and being that area lying between Keys Street on the south and Baldwin Boulevard on the north, Riggan Street on the east and Prescott Street on the west, be and the same is hereby ro- zoned from "R -2" Two Family Dwelling District Use to "B -1" Neighborhood Business District Use. SECTION 2. That the official Zoning Map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That the said Zoning Ordinance and Map of the City of Corpus Christi, approved on the Lpbh day of May, 1948, as amended from time to tine. except as herein changed shall remain in full force and effect. SECTION 5. The fact that it is of the greatest public importance to put in force immediately the changes in the Zoning Ordinance and Lap as hereinabove provided, for the purpose of providing for the orderly and progressive grm+,th of the City, and the necessary protection of the lives, health, property and welfare of the citizens creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule providing that no ordinance or resolution be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three (3) several meetings of the City Council, and the Wayor, having declared that such public emergency and such imperative public necessity exist, re- quests that said Charter Rule be suspended, and that this Ordinance take effect and be in full force and effect from and after its passage and after its publication one time as is provided, and required by the Charter of the City of Corpus Christi, AND IT IS SO ORDAINED . MAYOR qty eere ary City of Corpus Christi, Texas APPROVED AS TO LEGAL FORM: 2 ity Attor Corpus Christi, Texas, May f' , 190 TO THE MMERS OF THE CITY COUNCIL Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it it introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this or- dinance finally on the date it is introduced, or at the present meet- ing of the City Council.
