HomeMy WebLinkAbout02529 ORD - 05/31/1949AN ORDINANCE CLOSING THE EAST 15 FEET AND THE WEST 15 FEET OF THE WIDTH OF DETTER STREET EXTENDING FROM THE NORTH LINE OF DODDRIDGE STREET TO A LINE 100 FEET SOUTH OF AND PARALLEL TO THE SOUTH LINE OF PROCTOR STREET, ALL IN PORT ARANSAS CLIFFS ADDITION TO TEE CITY OF CORPUS CHRISTI, NII„CES COUNTY, TEXAS; THEREBY REDUCING TEE RIGHT -OF -WAY OF SAID DENVER STREET FROM ITS PRESENT WIDTH OF 80 FEET TO A WIDTH OF 50 FEET, AND ORDERING AND DIRECTING TEE RETURN OF SUCH PROPERTY CLOSED FOP, STREET PURPOSES TO TEE ,ABUTTING PROPERTY 0IWERS; AND DECLARING AN EIdERGEIINCY. VOMEAS, the City Council of the City of Carpus Christi has been petitioned that a portion of Denver Street hereinetter described be closed for street purposes; and, P21EREAS, notice of the proposed closing of said street has been given by publication and by mail to the last known addresses of all owners abutting said street and within 450 feet therefrom, in accordance with the Charter of the City of Corpus Christi as provided for under Article II, Section 6 thereof; and, 'U]REAS, in accordance with the Notice given as above set out, a public hearing was held by the City Council of the City of Corpus Christi at 4 :00 otclock P. y. on the 17th day of play, 1949, in the City Council Chamber at the City Hall; and, 11N-711EAS, the public welfare, convenience and necessity will be better served by the closing of such street: NOW, TrZi EFORE, DE IT ORDAINED DY THE CITY ODUAICIL OF ThE CITY OF CORPUS CHRISTI, TEF.AS: SECTION 1. That a portion of Denver Street, described as follows, to -wit: The East 15 feet and the West 15 feet of the width of Denver Street extending from the north line of Dodd - ridge Street to a line 100 feet south of and parallel to the south line of Proctor Street, all in Port Aransas Cliffs Addition to the City of Corpus Christi, Idueces County, Texas, thereby reducing the right- of-way of said Denver Street from its present width of 80 feet to a width of .50 feet, be and the same is hereby closed as a public street and from public use. SECTION 2. That the City of Corpus Christi hereby quitclaims and relinquishes all right, title and interest it may have in and to the said street described in Section 1 hereof, to the property ovazers abutting said street. a5a� SECTION 3. The fact that publio convenience and necessity iNill be better served by the closing of said street creates a public emergency and a public imperative necessity requiring the suspensicn of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced, and that such Ordinance or Resolution shell be read at three regular meetings of the City Council; and the Mayor, having declared that such public emergency and imperative necessity exi-st, and having requested that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction, and take effect acid be in full force and effect fro. ar_d after its passage, IT IS ACCORDIil GLY SO ORDADT. -3D.
