HomeMy WebLinkAbout02533 ORD - 06/07/1949r ' AN ORDINANCE RECEIVING AND ACCEPTING THE WORK OF CONSTRUCTION , OF STORM SEWER IMPROVEMENTS IN CULBERSON STREET FROM LEOPARD TO WINNEBAGO STREETS IN THE CITY OF CORPUS CHRISTI, TEXAS, SAME REIN], THE STORM SEWER IMPROVEMENTS AUTHORIZED UNDER CONTRACT DATED AUGUST 11, 1948, BETWEEN THE CITY OF CORPUS CHRISTI AND LEE AIKEN COMPANY; AUTHORIZING FINAL PAYMENT TO LEE AIKEN COMPANY UNDER THE CONTRACT FOR SAID IMPROVEMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION L. That the work of construction of storm sewer improve- ments along Culberson Street from Leopard to Winnebago Streets, in the City of Corpus Christi, Texas, performed by Lee Aiken Company, having been per- formed and compered in accordance with the terms and provisions of the coa- tract and the plans and specifications therein contained, said contract having been entered into by and between the City and Lee Aiken ComparT on the 11th day of August, 1948, and the Director:of public Works having inspected the same and certified to the completion of said work in accordance with said plans & specifications, and said work aforesaid is hereby found to have been completed in accordance with the plans and specifications and is here now accepted and received by the City Council of the City of Corpus Christi, Texas. SECTION 2. That final payment due under the contract and as set out in the final estimate prepared by the Director of Public Works dated June 6, 1949, in the sum of Twenty Thousand Five Hundred Eighty —Eight Dollars and Sixty —Four Cents ("$20,588.64) be made in accordance with the terms of No, 2g5 such contract and that such payment be made fron/storm Sewer Improvement Bonds 1948 Construction Fund, SECTION 3.. The necessity for providing adequate drainage on Culber- son Street between Leopard and Winnebago Streets within the City creates a pub- lic emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested ,�S53 �_. f ' that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY So ORDAINED. y PASSED AND APPROVED this ` d'ay of June, A.
