HomeMy WebLinkAbout02556 ORD - 07/19/1949AN OHDiNANCE CLOSING THE MRINGS AND ADOPTING AND APPROPING THE MAP AND ESTABLISH- IM BUILDING IBM FOR AGNES STEM, EXTENDING FROM PORT AM= ON THE WEST TO TANCAHNA STREET ON THE EAST, DECIAR, -- ING SAID AGNES STREET OPENED AS SHOWN- , ON SAID MAP, SAID MAP ATTACHED HERETO AND MARKED "EXHIBIT A "; AND DECLARING AN M4MMNCS. WHEREAS, Notice of the Hearings on the matter of the widening of Agnes Street and fixing a building line thereon, and opening and extending same, as to that portion of Agnes Stramt extending from Port Avenue on the West to Tanoahua Street on the East, all In the City of Corpus Chriati, has been given by publication and by registered mail to the last ]mown addresses of all owners abutting said street and withim four hundred and fifty feet (4500 thereof, and WH6AEAS, pursuant to said Notice, a Public Hearing was held by the City Council of the City of Corpus Christi, Texas, in accordance with the pro- visions of Section 6, Article II of the City Charter and in accordance with the provisions of Article 1105 (a) of the Revised Civil Statutes of Texas, said Hearings being held on the 21st day of June 1949, and the 5th day of July, 1949, in accordance with said Notices; and recessed until the 12th day of July, 1949; end, WHEREAS, it has been determined by the City Council after such Public Hearings that the said street, Agnes Street, extending from Port Avenue on the West to Tancahna Street on the East, is necessary and of vital importance to the proper bgrAling of traffic in and out of the City of Corpus Christi and in connection with State Highway No. 44; and WHEMM, the widening of said street necessitates the mediate establishment of new building Linea that will prevent expensive building encroachments upon territory that is to be included in the street when widened, which building or buildings would increase the burden of expense, upon the City in securing future right- of-way for the street, and a 550 WMWA.4, the City Engineer of the City of Corpus Christi has prepared and submitted to Council a Map showing the proposed improvements of said street, which map has been approved by the City Zoning and Planning Commission and the State Highway Commission and which Map is attached hereto and marked "Exhibit A ": NOW, TREBEPORE, HB IT ORDADW BY THE CTTY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That the building lines for Agnes Street from the East property line of Port Avenue to the West property line of Tancabua Street, shown on the Map attached hereto as "Exhibit A " -, be, and they are hereby approv- ed and adopted as the building lines on said street at the locations shown on said Map and from and after the date of this Ordinance, building encroaching upon said lines is forbidden. SECTION 2. Said Agnes Street is hereby ordered opened and widened as shown on said Map attached hereto. SECTION 3. The fact that the public convenience and safety of the public and the necessity of the people of the City of Corpus Christi require immediate widening of Agnes Street to alleviate the traffic conditions now existing thereon, and the fact that the prevention of further erection of buildings encroaching upon the territory to be included in the thoroughfare when widened is necessary to save the City from additional burden of expense in securing the rights -of -way, create a public emergency and an imperative public necessity requiring the suspension of the Charter rule or requirement that no Ordinance or Resolution shall be passed finally on the date of its introduction, and that said Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and public imperative necessity exist, and requested that said Charter rule be suspended and that this Ordinance be passed finally on the date of its introduction, and take effect and be in full force and effect from and after its passage, PT 33 ACCORDINGLY SO ORDAINED.
