TO RMCUTE FOR AND Off BEHALF OF SAID
CITY AN AGBEEIO;NT BY AND BETWEEN THE
CITY OF CORPUS CHRISTI, TEM. AND THE
CCRPUS CHRISTI INDEPENDENT SCHOOL DIS-
TRICT, FOR THE PURPOSE OF CONSTRUCTING
A SEWER LINE TO SAVAGE SCHOOL; AND DE-
CL&RING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXASe
SECTION 1. That the City Manager of the City of Corpus Christi,
Texas, be, and he is hereby authorised and directed to execute an agree -
neat, for and on behalf of the said City, by and between the City of
Corpus Christi, Texas, and the Corpus Christi Independent School District
for the purpose of constructing a sewer line to Savage School, a copy of
which contract is attached hereto and made a part hereof, and reads as
follows, to -wit:

THIS AGREEMENT made and entered into this the 25th
day of July, A.D. 1949, by and between the City of Corpus
Christi, a Municipal Corporation, hereinafter called "City ",
and the Corpus Christi independent uchool District, a public
school corporation, acting herein by and through its duly
elected and authorized President and Secretary of its' Board
of Trustees, hereinafter called "District ".

'aH;RLAS, it is imperative that the newly enlarged
Alice Borden Savage school be connected with the canitary
sewer system of the City of Corpus Christi before the re-
opening of said school, September 5, 1949, and
WIMP-,AS, said school is located outside the city limits
and said City has no available funds at the present time out
of which it can defray the cost of laying such sanitary sewer
from said school to the nearest connection within the City, and
WHLREAS, said City has agreed that if said District
will defray the cost of the construction of said sanitary sewer
line to the Savage School, it will prepare the necessary plans
and specifications and take bids for the construction of same,
and supervise the construction tznereof, and
WHEREAS, in consideration of said District defraying
the entire cost of said sewer line and turning same over to
the City as a part of the City'a sewerage system, the City
agrees to waive the usual and customary monthly rental, that
would otherwise be charged to the Savage School if the City
had constructed said line at its own cost and expense, until
such time as such accumulative rentals equal the amount of
money expanded by said District on the construction of said
line; and after said District has been dilly reimbursed for
the construction of said line out of the accumulated credit
of such rentals, the District shall begin paying the City
such monthly rentals.
IT IS TB.EW= AGREED between the parties hereto as
follows:
The City will:
(a.) Prepare the necessary engineering data for
the construction of the sanitary sewer line
of the Alice Gorden Savage School, to the
nearest connection that can be ,ads to an
established sewer line within the City of
Corpus Gnristi, Texas.
(b.) Take bids and let the contract for the con-
struction of said line and supervise the
installation thereof, according to the
specifications prepared by the Lngineering
Departtaent of the City.

Upon completion of said line said City will notify said
District of such fact in writing, and attach thereto a state -
ment showing the entire cost of construction of said line and
upon receipt from said City of said Certificate of Completion
and statement of coat, said District will promptly pay to said
City the full amount of such construction costs and no further
connections shall be made to said line by third parties without
the consent of said District and City, and all tap charges de-
rived from said Connections shall be paid to said District.

In consideration of said District defraying the
entire cost of said sewer line, the City does hereby agree
to waive the usual and customary monthly rental that would
otherwise be charged to the Savage School, if the City had
constructed said line at its, own cost and expense, until
such time as such accumulated rental equals the amount of
money paid by said District for the construction cost of
said line, after which time the District shall have no
further interest in said line other than the uses thereof
for the usual and customary rental to be ;aid to the City
by said District.

SECTIM 2. The public importanos of the furnishing of Sewer
service to the public schools of the City of Corpus Christi creates a
Public emergency and public imperative necessity requiring the suapea-
sion of the Charter role that no Ordinance or Resolution shall be passed
finally on the date it is introduced and that such Ordinance or Resolu-
tion shall be read at three several meetings of the City Council, and
the Mgvor having declared that such public emergency sad imperative
necessity exist. and having requested that such Charter rule be sus-
pended, and that this Ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and
after its passage. IT IS ACCORDINGLY SO ORDAffiED.

Gentlemen:
For the reasons set forth in the emergency clause of the
foregoing ordinance, a public emergency and imperative necessity
exist for the suspension of the Charter rule or requirement that
no ordinance or resolution shall be passed finally on the date it
is introduced, and that such ordinance or resolution shall be read
at three meetings of the City council; I, therefore, hereby re-
quest that you suspend said Charter rule or requirement and pass
this ordinance finally on the date it is introduced, or at the
present meeting of the City Council.
