HomeMy WebLinkAbout02582 ORD - 08/16/1949AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY, TO PURCHASE 5.028 ACRES OF LAND ' OUT OF THE W. S. HARMER TRACT SITUATED IN NUECES- COUNTY, TEXAS, FROM ORVILLE W. EASTLAND, TRUSTEE, AND OTHERS FOR THE SUM OF $2,076.91 GASH, AND TITLE EXPENSE; AUTHOR- IZING AND DIRECTING THE SAID CITY MANAGER TO &CUTE THE NECESSARY CONTRACTS AND INSTRUMENTS TO COMPLETE THE PUR- CHASE OF THE AFORESAID LAND; PROVIDING THAT PAYMENT FOR THE PURCHASE OF THE SAME SHALL BE PAID FROM N0. 295 IMPROVEMENT BONDS 1948 CONSTRUCTION FUND (STORM SEWER IMPROVEMENTS), AND DECLARING AN EMERGENCY. BE IT ORDILIM BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorised and directed, for and on behalf of the City to purchase the following described land situated in Nueoee County, Texas, All that certain tract or parcel of land, being a right of way 138 Peet in Width extending from the center- line of Ramsay Street, and at right angles thereto, in a Southeasterly direction across the Richardson, Sechrist- Hall and Kleeapies Tracts to a point in the Southeast boundary line of the said Kleespies tract, the tract here- in conveyed is a part of the W. S. Harney 1,000 acre tract in the E. Villareal Grant, Abstract No. 1 in Nueoee County, Texas, and is more particularly described by metea and bounds as follows; BEGINNING at a point in the centerline of Ramsey Street, also being in thejNorthweat line of the G. M. Richardson 10 acre tract, from Awhich the West oorner of the Corpus Christi Independent School District 9 acre tract bears North .450 001 39" East 362.09 feet, for the North corner of this tract; THENCE Southeasterly across ' the Richardson, Sechrist -Hall and Kleespies tracts, South -440 59, 21" East 1,587.19 feet to a point in the Southeast boundary line of said Hleespies tract for the East corner of this tract; THENCE Southwesterly along the said Southeast boundary line of the Eleespies tract, also being the Northwest boundary lines o oche McCall, Trustee and Margaret Chainaks tracts, South 45 Olt 24" West, at 50.00 feet peas the common cor- ner between the McCall, Trustee and Margaret Chainsks tracts, in all 138.00 ft. to a point for the South corner of this tract; THENCE Northwesterly across the Klesopies, Soohrist -Hall and Richardson tracts, North 4V 59' 21" West 1,587.16 feet to s point in the oenterline of Ramsay Street, also being the North- west line of the G. M. Richardson 10 acre tract, for the West corner of this tract; THENCE Northeasterly along the oenterline of Ramsey Street. also being the Northwest line of said G. M. Richardson 10 acre tract, North 45e Cot 39" East 138.00 feet to the place of beginning and containing 5.028 acres of land; all of said land to be used for the Proctor Street Drainage Project now under construction and abutting streets, and for other municipal purposes. SECTION 2. That the City Manager is hereby authorized and directed to execute the necessary contracts for the purohase of said land described in Section 1 hereof and to do all things incident to or requisite to obtaining the tiBe and possession of said land. •SECTION 3. That the aim of Two Thousand Seventy -six Dollars and Ninsty -one Cents (82,076.91) and suoh additional sums as may be incurred as title expense incident to the acquisition of said land are to be paid Prom No. 295 Improvement Bonds 194B Construction Fund (Storm Sewer Improvemants). SECTION 11. The necessity for acquiring lend at the location of said land herein described and the fact that the said land is required immediately for the use of the drainage project now under construction creates a public omergenoy and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it in introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. STS City Secretary APPROVED AS TO LEGAL FORM: Gny A torney G Ctty of Corpus Christi, Texas Corpus Christi, Texas 1949 TO THE MWBERS OF THE CITY COUNCIL 6 Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the fore- going ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
