E. POPE RE- SUBDIVISION OF PORT ARANSAS CLIFFS SUBDIVISION "D" SITUATED IN NUECES cauM. TEXAS, AND 0.73 ACRES, MORE OR LESS, OF LAND OFF OF TEE SOUTHWT SIDE OF LOT 6, SECTION "A" OF THE PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT SITUATED IN NUECES COUNTY, TEXAS, FROM GUARANTY TITLE AND TRUST COMPANY. A CORPORATION, TRUSTEE, AND JACK POPE, INDEPENDENT EXECUTOR OF THE ESTATE OF W. E. POPE, DECEASED, FOR THE SUM OF #)4,122.75 CASH, AND TITLE EX- PENSES AUTHORIZING AND DIRECTING THE SAID CITY MANAGER TO EXECUTE THE NECESSARY CONTRACTS AND INSTRUMENTS TO COMPLETE THE PURCHASE OF THE AFORESAID LAND; PROVIDING THAT PAYMENT FOR TEE PURCHASE OF THE SAME SHALL BE PAID FROM NO. 295 IM?ROVENENT BONDS 1918 CCHSTRUCTION FUND (STORM SEWER IMPROVEMENTS); AND DECLARING AN MMRGHNCY. BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized and directed, for and on behalf of the City, to purohase 2.34 acres of land described as follows, to -brit: Being a strip of land 6G feet in width and 1701.68 feet in length out of a portion Of the W. E. Pope Resubdivision of Port Aransas Cliffs Subdivision "D" as shown by Map of record in the office of the County Clerk of Nueces County, Tease# and recorded in Volume 14, page 57, of the Map Records of said county, said strip of land being more particularly dozer by metes and bounds as follows, to -wit: nsning at a 3/4" iron pipe set 12" below the natural ground, said point . being the intersection of the northwest boundary line of Everhart Road and the southwest boundary line of Alameda Boulevard; Thence N. 310 06, W. with the southwest boundary line of Alameda Boulevard a distance of 633.80 feet to a point for the southeast corner and beginning of this description; Thence S. 580 58, w. a distance of 1699.96 feet to a point in the northeast boundary line of the Dahlia McCord Carpenter 30.23 acre tract for the southwest ooraem of this description; Thence N. 340 151 W. with the northeast boundary line of said 30.25 acre tract a distance of 60.09 feet t0 a point for the northwest corner of this description. Thence N. 580 58t E. s distance of 1703.10 feet to a point in the southwest boundary line of Alameda Boulevard for the north- east corner of this description; Thence S. 310 06, E. with the southwest boundary line of Alameda Boulevard a distance of 60.00 feet to the place of beginning. Containing 2.314 acres, all of said lands to be used for the Gollihor Road Drainage Project now under oonstruction, and other municipal purposes. SECTION 2. That the City Manager is hereby authorised and directed, for and on behalf of the City, to purchase 0.73 acres of land described as follows, to -sits Being a strip of land off of the southwest side of Lot Six (6), Section "A" of the Paisley's Subdivision of the Hoffman Tract as shown by map of said subdivision of record in the office of the County Clerk of Nueoss County, Texas, in Vol. uAns page 28 of the Map Records of Nueces County, Texas, said strip of lend being more particularly described u follows, to -wit: Beginning at a point in the west boundary line of said Lot Six (6) Section "A" and the north boundary line of a 40 foot public road as shown by map recorded in Volume "A ", page 28 of the Map Records of Nueces County, Texas, for a corner of the tract herein conveyed, said point bears N. 280 lot 40" E. 20 feet from the common corner of Lots No. Five (5), Six (6), Eleven (11) and Twelve (12) in said Section "A "; Thence N. 280 102 40" E. with the west boundary line of said Lot 6, Section "A" a distance of 20 feet to a point for a corner of the tract hereby conveyed; Thence S. 610 47, 20" E. parallel to the northeast boundary line of said 40 foot public road a distance of 1220 feet to a point for a corner of the tract hereby conveyed; Thence N. 730 12, 40" E. a distance of 141.42 feet to a point in the east boundary line of said Lot 6, Section W. for a corner of the tract hereby conveyed; Thence S. 280 10' 40" W. with the east boundary line of said Lot 6, Section "A ", a distance of 120 feet to a point for a corner of the tract hereby conveyed. Thence N. 61 47, 20" W. with the north boundary line of said 40 foot public road, a distance of 1320 feet to the place of beginning. Containing 0.73 acme, more or less, all of said lands to be used for the Gollihar Road Drainage Project now under construction, and other municipal purposes. SECTION 3. That the City Manager is hereby authorized and directed to execute the necessary contracts for the purchase of said lands described in Sections 1 and 2 hereof and to do all things incident to or requisite to obtaining the title and possession of said lands. SECTION 4. That the purchase price of the property described In Section 1 of Three Thousand Five Hundred Ninety -five Dollars and Fifty Cents ($3095.50) and such additional silts as may be incurred as title expense incident to the acquisition of said land are to be paid from No. 295 Im- provement Bonds 1948 Construction Fund (Storm Sewer Improvements). SECTION 5. That the purchase price of the property described in Section 2 of Five Hundred Twenty -seven Dollars and Twenty -five Cents (3527.25) and such additional sums as may be incurred as title expense incident to the acquisition of said land are to be paid from No. 295 Improvement Bonds 190 Construction Fund (Storm Sewer Improvements). SECTION 6. The necessity for acquiring land at the location of said land herein described and the fact that the said land is required immsdistely for the use of the drainage project now under construction creates a public amergency and public imperative necessity requiring the suspension of the Charter rule that nonordinaace or resolution shall be passed finally on the date_ it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
