FROM WEST BROADWAY TO SOBEY DRIVE IN TEE CITY OF '
CORPUS CHRISTI, TEXAS, SAES BEING THE STORM SEVVBEt
IMPROVEMENTS AUMCRI22D UNDER CONTRACT DATED
JULY 27. 1948, BETWEEN THE CITY OF CORPUS CHRISTI
AND HElDEMLB BROTHERS UNDER THE CONTRACT FOR SAID
IMPROVEEd;NTSS AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEAS,
SECTION 1. That the work of oonstruotion of atom sewer
improvements along Nueces Bay Boulevard from West Broadway to Sobey
Drive, in the City of Corpus Christi, Texas, performed by Heldenfels
Brothers, having been performed and completed in accordance with the
terms end provisions of the contract and the plane and specifioations
therein contained, said contract having been entered into by and between
the City and Heldenfele Brothers on the 27th day of July, 1948, and the
Director of Public Works having inspected the same and certified to the
completion of said work in accordance with said plans and specifications,
and said work aforesaid is hereby found to have been completed in accord-
ance with the plans and specifications and is here now accepted and re-
oeived by the City Council of the City of Corpus Christi, Texas.
SECTION 2. That final payment due under the contract and as
set out in the final estimate prepared by the Director of Public Works
dated August 26, 1949, in the sun of Seventy -Your Thousand Two Hundred
Forty -aix Dollars and Fifty -four Cents ($74,246.54) be made in accord-
moo with the terms of such contract and that such payment be made from
No. 295 Storm Sewer Improvement Bonds 1948 Construction Fund.
SECTION 3. The necessity for providing adequate drainage on
Nueces Bay Boulevard from West Broadway to Sobey Drive within the City
creates a public emergency and public imperative necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date it is introduced and that such ordinance or
resolution shall be read at three several meetings of the City Council.
and the Mayor having declared that such public emergency and imperative
necessity exist, and having requested that such Charter rule be suspended,

and that this ordinance be passed finally on the ate of its introduction
and take effect and be in fall force and effect from and after its passage.
IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Conooil; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
