AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE A CONTRACT FOR AND ON BEHALF OF THE CITY
WITH A. J. MCCALL AND J. P. RATLIFF FOR THE IN-
STALLATION CF A WATER DISTRIBUTION SYSTEM TO
SERVE THE WYNWOOD ONE ADDITION IN THE CITY OF
COP.PUS CHRISTI, TEXAS; AND DECLARING AN RMGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized and
directed to execute a contract for and on behalf of the City with A. J. McCall
and J. P. Ratliff for the installation of a water distribution system to
serve the Wynwood One in the City of Corpus Christi, Texas, a copy of said
contract being attached hereto and made a part hereof for all pertinent
purposes.

liHERMS, E. J. McCall and J. P. Ratliff are the owners and
developers of the Nynwood One in the City of Corpus Christi, Texas, and are
desirous of supplying -eater to said subdivision.

Texas, a munieipal corporation, acting by and through its duly authorized
City Manager, hereinafter called °City", and A. J. MoCall and J. P. Ratliff
of Humes County, Tama, hereinafter termed •Devaloperss.

1.
The City agrees to furnish material and labor, and to construct
a water distribution system to serve the Wyawood One, as sham on Exhibit "A'
attached hereto, at its own cost and expanse, and the Developers agree to pay
the City the sus of $7,235.349 being the amount agreed upon by both parties
as being the portion of the cost allocated to the Developer, as determined by an
estimate of coat ae shown by A&i:oit "H^ hereto attached. Exhibit "A* covers
a plan of a water system proposed by the Developers, and_:aeoepted by the City
as adequate for the specific requirements of. the Yynnood one. It is expressly
understood however, that the City reserves the right to change the design and to
construct the distribution system, shown in ,Exhibit "A° f,.r the purpose of bane -
fiting the water distribution system to said addition or the City sys'am generally.
The City shall have the right to remove, altar, - replace, change, or repair any of
said lines, and may supply other properties than said addition through the use of
said lines. -

The City further agrees to complete the installation of said water
lines within six (6). months from the date of this contract.

It is further agreed and understood that upon completion of this
warty all water lines placed in said Subdivision are to become the property
of the City. And the Developers convey and quitclaim, by the execution of
this instrument, all right, title, interest and claim they my have in and
to any and an water lines installed in accordance with this .agreement to
the City of Corpus Christi, Texas, said Conveyance to be binding upon all
the parties hereto, their heirs, succeseora and assigns'. forever.

SECTION 2. The necessity for providing proper water facilities
for new subdivisions within the City creates a public emergency and public
imperative necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date it is introduced
and that such ordinane or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared that such public miergency
and imperative necessity moist, and having requested that such Charter rule be sus-
pended, and that this ordinance be passed finally on the date of its introduc-
tion and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED. -

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Couaoil; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinanoe finally on the date it is
introduced, or at the present meeting of the City Council.
