BE IT ORDAIN}I) BY THE CITY COUNCIL OF THE CITY OF COF.PUS CHRISTI, T_MS:
SECTION 1. That the City panager is hereby authorized and
directed to execute a contract for and on behalf of the City with Herbert
J. Jones for the installation of a water distribution system to serve the
Dellwood Addition, Unit 1, in the City of Corpus Christi, Texas, a copy of
said contract being attached hereto and made a part hereof for all pertinent
purposes,

developer of the Dellwood Addition, Unit No. 1, in the City of Corona Christi,
Texas, and is desirous of supplying crater to said subdivision.

a municipal corporation, acting by and through its duly aatis6rised City Vanager,
hereinafter called *City", and Herbert J. Jonas, of "Nueees County, Texas herein-
after called "Daveloperm.

The City agrees to furnish material and labor, and to construct a
water distribution system to serve the Dellrood Addition, Unit No. 1, as shown
on Exhibit "A* attached hereto, at its own cost and expense, and the Devaloper
agrees to pay The City the am of $4,9Z.07, being the mount agreed upon by
both parties as being the portion of the cost allocated to the Developer, as
determined b_ an estimate of coat as shown by Eshihit "B* hereto attached.
Exhibit "A" covers a plan of a water system proposed br the Developer and ascapted
by the City as adequate for the specific requirement* of the De3lwood Addition,
Unit 1. It is expressly understood, however, that the City reserves the right
to change the design and to construct the distribution system, sham in �xhibit
"A" for the purpose of benefiting the water distribution system to said addi-
tion or th.e City system generally. The City shall have the right to remove,
alter, replace, change, or repair any a said lines, awid may supply other pro-
parties than said addition through the use of said lines.

The City further agrees to cosn)leta the installation of said water
lines within six (b) months from the date of this contract.

It is farther agtedd and understood %sat upan complauaa of this
work, all water liner placed in raid Subdivision are to become the propery
of the City. And the Developer emwaym and quito]aiae, by the emsau" of
this instrusent, all right, title, interest and claim they mV have in and
to any and all rater lines installed in accordance with this agreement to 1$e
City of Corpus Christi, Texas, said conveyance to be binding upon all the
parties hereto, their heirs, suceessors and assigns forever.

ordinance or resolution shall be passed finally on the date it is introduced
and that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared '.hat such public emergency
and imperative necessity exist, and having requested that such Charter rule be
suspended, and that this ordinance be passed finally on the date of its intro-
duction and take effect and be in full force and effect from and after its

imperative necessity requiring the suspension of the Charter rule that no
ordinance or resolution shall be passed finally on the date it is introduced
and that such ordinance or resolution shall be read at three several meetings
of the City Council, and the Mayor having declared 'chat such public emergency
and imperative necessity exist, and having requested that such Charter rule be
suspended, and that this ordinance be passed finally on the date of its intro-
duction and take effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED.

For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
"Solution shall be passed finally on the date it is introduced, and
that such, ordinance or resolution shall be read at three meetings of the
City Council= I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
introduced, or at the present meeting of the City Council.
