AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER
OF THE CITY OF CORPUS CHRISTI TO PURCHASE A ,
STRIP OF LAND 20 FEET IN WIDTH ON THE EAST
SIDE OF WATER STREET ABUTTING AND OFF OF THE
WEST END OF THE SOUTH ONE -HALF (SJ) OF LOT 6,
BLOCK B OF THE SUBDIVISION OF THE HARNEY TRACT
IN THE CITY OF CORPUS CHRISTI, NIECES COMM,
TEXAS, AND PROVIDING PAYMENT FOR SAME IN THE
SUM OF NOT EXCEEDING $1,500,00 BE MADE OUT OF
FUND NO. 258 SEAWALL AND BREAKWATER CONSTRUCTION
FUND; AND DECLARING. AN EMERGENCY.
WHEREAS, the City is now engaged in a program of widening
and improving Water Street between Fitzgerald and Furman Streets and
needs the western 20 feet of the south one -half (Sa) of Lot No, 6,
Block B of the Subdivision of the Harney Tract; and
WHEREAS, some dispute has arisen between the owner of said
property and the City regarding the riparian rights attached to said
land and the cost of filling of said land, and it is desirable that
said disputes be settled; and
WHEREAS, a settlement agreement has been reached and the owner
of said land is agreeable to selling the said 20 feet of said land on the
eastern side of Water Street to the City of Corpus Christi for the sum of
Fifteen Hundred Dollars ($1,500.00);
NOW, THEREFORE, BE IT ORDAINED BY TEE CITY COUNCIL OF TEE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager of the City of Corpus Christi
be, and he is, hereby authorized and directed to execute for and on behalf
of said City with the said owner of said land a oompranise settlement
agreement concerning the riparian rights and paving costs on the eastern
end of said land and settlement of an item of damages heretofore claimed
by the owners of said lend by reason of the bayfront improvements placed
on said land and adjacent thereto.
SECTION 2. That the City Manager of the City of Corpus Christi
be, and he is, hereby authorized to contract for the purchase of and to
purchase for the City of Corpus Christi the western 20 feet of said land
adjacent to Plater Street at a cost of not to exceed Fifteen Hundred
Dollars ($1,500.00), and that payment therefor be merle out of Fund No.
256 SeswaIl and Breakwater Construction Fund.
SECTION 3. The fact that certain differences have existed
for many years concerning damages ocoasioned by reason of the placing
of bayfront improvements on said property and adjacent thereto and
concerning the right of ownership of the riparian rights of said land
owners and the City and concerning the acquisition by the City of 20 feet
for the widening of Water Street, and the further fact that the contem-
plated improvement of Water Street is now under contract and should be
eosmenced as soon as possible create a public emergency and public im-
perative necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date it is
introduced and that such ordinance or resolution shall be passed finally
on the date it is introduced and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor
having declared that such public emergency and imperative necessity
exist, and having requested that such Charter rule be suspended, and
that this ordinance be passed finally on the date of its introduction
and ta]o: effect and be in full force and effect from and after its
passage, IT IS ACCORDINGLY SO ORDAINED.

Gentlemen:
For the reasons set forth in the emergency clause of the fore-
going ordinance, a public emergency and imperative necessity exist for
the suspension of the Charter rule or requirement that no ordinance or
resolution shall be passed finally on the date it is introduced, and
that such ordinance or resolution shall be read at three meetings of the
City Council; I, therefore, hereby request that you suspend said Charter
rule or requirement and pass this ordinance finally on the date it is
Introduced, or at the present meeting of the City Council.
