HomeMy WebLinkAbout02608 ORD - 10/04/1949AN ORDINANCE AMENDING SECTION 52 OF ARTICLE V AND SECTION 61 OF ARTICLE IX OF ORDINANCE %.� NO. 22Lal, REGULATING TRAFFIC UPON THE PUBLIC STREETS, ALLEYS, AND OTHER THOROUGHFARES OF THE CITY OF CCRPUS CHRISTI, TEXAS, AND FIXING PENALTY FOR VIOLATIONS AND REPEALING ALL OTHER ORDINANCES AND SECTIONS OF ORDINANCES IN CONFLICT HEREWITH, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 52 of Article V of Ordinance No. 2241 be amended so as to read hereafter as follows: "SECTION 52. Speed in School Zones. - It is hereby determined upon the basis of an engineering and traffic investigation that, between the hours of 8:00 A. M. and 5:00 P. M. on any day when children are required to be in attendance at school, the maximum reasonable and pra- dent speed linit within any school zone is 15 miles par hour, and, between such hours on any such day it shall be unlawful for any person to drive or operate a motor or other vehicle within such zone at a greater rate of speed than fifteen (15) miles per hour. Provided, that the City Traffic Engineer is hereby given authority to change or modify the hours of enforcement when, in his discretion, the need develops and upon his giving suffi- cient public notice of such changes." SECTION 2. That Section 81 of Article IX of Ordinanos No. 22i:1 be amended so as to read hereafter as follows: "SECTION 81. Unlawfully riding. - The operator of a motorcycle or bicycle when upon a public street shall not carry any other person upon the beadle bar, frame, or tank of any such vehicle. No person shall ride on any vehicle or bicycle upon any portion thereof not designated or in- tended for thn use of passengers. This provision shall not apply to any employee engaged in the necessary discharge of a duty, or to persons riding wS,thin truck bodies in space Zo,? intended for merchandise." SECTION 3. The fact that it is necessary to the public safety and general welfare to protect and safeguard school children and other pedestrians in school zones, and the fact that restrictive measures are necessary to prevent unsafe riding practices on motorcycles and bicycles creates a public emergency and public imperative necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council, and the 1byor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this ordinance be passed finally on the date of its introduction and teke effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
